THAT why in all the court injunction cited in the FHC order you won't find section 77... Cos that provision is talking about what parties must do pre convention.
The appropriate section of the electoral act that Imale provision for timeframe before widows closes to take a party member detail is SECTION 29 (1) it's on this premises FHC set aside inec timetable that they don't have jurisdiction, even inecc can not quote section 77 in court cos it talks about party not what inec must do.. It's irrelevant in this case
please Read section 29 (1) and tell us the provision or clause that gave inec the power to alter/amend it 77(4) is not talking about notification at all. The court rules on the date INEC gave parties to submit their particulars but the registers submitted not later than 21 days as stated by 77(4) has shut the door against defection bro. 77. (1) A political party registered under this Act shall be a body corporate with perpetual succession and a common seal and may sue and be sued in its corporate name. In all of these sections where is stipulated Inec can shortten the timeframe of 120 days to election enacted in section 29..thats what I want to see I'm shocked that you saw the thing written boldedly and still say another thing  77(4): Each political party shall make such register available to the Commission not later than 21 days before the date fixed for the party primaries, congresses or conventionsI decide to highlight some of the keywords boldly for you so that maybe you see them well. What did INEC do? They fixed the timeframe for political parties to conduct their primaries (ie from X-Y). Section 77(4) stated that political parties must make their registers available on or before 21 days to X. This registers will determine who to vote or be voted for or chose by consensus in the course of the primaries. Remember that INEC hasn't ordered political parties to submit the particulars of their candidates which is where 120 days comes to play. In that case, the 120 days timeframe is when political parties can sort out issues post primary and possibly make changes in their candidacy if need arises but must be someone in the register submitted to INEC earlier. Read and stop shouting 120 days as if INEC is forcing any party to submit the particulars of their candidates. Here is the submission of the court; This honourable court hereby declared that the defendant requesting for membership register of political parties and giving timeframe within which to conduct primaries is not ultra vires the powers of the defendant |
