The Court of Appeal, Port-Harcourt at a virtual hearing today via Zoom gave its Ruling on two Motions filed by Martins Amaewhule and the other defected lawmakers challenging the order of injunction granted by the Rivers State High Court restraining them from acting as lawmakers. The Court in Ruling on the first Motion, granted the Appellants’ prayers for leave to compile and transmit the Records of Appeal, deeming the Appellants’ Brief of Argument as filed, accelerated hearing and a stay of further proceedings at the High Court. The Court of Appeal however refused to grant the prayer for stay of execution and setting aside the interim order of the Lower Court as there is a presumption of correctness of an order of a Court. It held that granting same would be tantamount to determining the appeal at this stage. The Court went on to order that the present status quo should be maintained pending the hearing of the Appeal. Ruling on the 2nd Motion which was brought to set aside the interlocutory injunction of the Lower Court, the Court of Appeal also refuse the prayer, and reiterated that the ‘present’ status quo should be maintained. The Respondents are to filed their Briefs within 72 hours of being served. The case has been adjourned to 20/6/24 for Hearing of the Appeal. |

One man wants almost 10billion of Rivers funds handed over to him every month so he can maintain his hold on PDP and run for presidency in 2027. One greedy man! Well, I trust my Rivers people. Honourable Justice Dagogo-Jack has COURT NULLIFIES AMENDMENT OF SECTION 3 OF RSHA SERVICE COMMISSION A State High Court, sitting in Port Harcourt and presided over by Justice Mrs Kariba Dagogo Jack, on Tuesday, nullified the amendment of Section 3 of the Rivers State House of Assembly Service Commission Law by the Martin Amaewhule-led Assembly, which sought to strip the Governor of the constitutional power to appoint the Chairman and Members of the Rivers State House of Assembly Service Commission. Delivering judgement on the matter which was brought before the court for consideration in a suit by an NGO, Association of Legal Legislative Drafting and Advocacy Practitioners, the presiding Judge said the amendment law no 3, 2024, was inconsistent with the provisions of the Constitution, and as such null and void. She said the Constitution unambiguously state that the Governor should constitute the board of the house of assembly service commission, and some other commissions, boards and Institutes, but based on the confirmation of the Assembly. She declared that the amendment which shifted the power to constitute the House of Assembly Service Commission to the Speaker, contravene the doctrine of separation of powers which guarantees the right of the various arms of government to operate independently of each other. The presiding Judge further stated that the Rivers State House of Assembly is not authorized by law to exercise executive powers which includes the constitution of the Rivers State House of Assembly Commission, which is among bodies described in part two of the third schedule of the Constitution whose membership are to be constituted by the Governor. Speaking with Journalists shortly after the judgement, lead counsel for the NGO, Association of Legal Legislative Drafting and Advocacy Practitioners, Barr. Boma Owunabo, the suit was instituted in public interest to challenge the usurpation of executive powers by the Amaewhule-led Rivers State Assembly through the amendment. Barr. Owunabo said the NGO was dedicated to ensuring that every legislation in the country is in tandem with the provisions of the Constitution. He commended the presiding Judge for her forthrightness, due assessment and evaluation of evidence before delivering the judgement, stating that the judgement was a victory for good governance and the rule of law |

MARTINS AMAEWHULE AND HIS FRIENDS ARE GONE AS FORMER ASSEMBLY MEMBERS AND CAN ONLY BE SAVED BY SUPREME COURT, SO DISREGARD THE OBVIOUS FALSEHOOD AND MISREPRESENTATION OF A COURT JUDGEMENT BY MISGUIDED FAWNERS OF CHIEF WIKE. By Ezebunwo Ichemati. Earlier today the media space has been saturated by a court judgement delivered by Justice Okogbule Gbasam of the Rivers State High Court Degema Division, wherein alot was alleged to have emanated from his court as judgement. Most significant of the numerous judgement that is in circulation, is the part that clearly states that •The suit of the claimants was struck out for want of locus standi and jurisdiction and also for being an abuse of court process which robbed the trial court of jurisdiction to adjudicate on the matter• What this means is that, The presiding Judge made it explicit that he lacked the jurisdiction to preside over the matter and thus declined further hearing of the matter, reasons why the suit of those that brought the matter before it was outrightly struckout. The principle that a court has no jurisdiction to entertain a matter, is an indisputable fact and pointer that it cannot exercise judicial power nor authority in respect of that matter. At best it can only be trashed (struckout), just as Justice Okogbule delivered in his verdict and couldn't have said otherwise as alleged by mischief makers. Furthermore, I think it'd be instructive to also add that once a judge has declined jurisdiction in a matter, every other thing he says is considered an OBITER DICTUM. It is also noteworthy to state clearly as against the speculation of some misguided and informed nitwits, that suit before the Justice Okogbule Gbasam was not instituted by Rt Hon Oko Jumbo, neither was it initiated by the Rivers State Government or any of their affiliates. Rather it was brought by associates and affiliates of Hon Martins Amaewhule and his committee of friends, named Mr Hycent Amadi & Ors, just like the invincible Ibrahim Umar & Ors of 2018. We understand that when a group of people have lost out in a battle they were so confident they will effortlessly win, they will surely resort to all manner of unfounded falsehood with an intent to paint a picture of false hope to their gullible fawners, but what we did not envisage, is how desperate they can be to the extent of misrepresenting court verdict. We know that Hope will be wielded as a tool of deceit by CHIEF WIKE on his followers, after Martins Amaewhule and his friends were wrongly deceived into defecting to APC as their only option of gaining PRESIDENT TINUBU'S Federal Might against GOVERNOR SIM but it's obvious today that they cannot avoid the pitfalls of that false expectation. We knew they had failed, the very moment his supporters started making posts and comments denying that Martins Amaewhule and his Friends never defected even after swearing to an affidavit stating their reasons for defecting from the PDP to the APC. If it is not madness then I wonder what it is, for a people that widely celebrated the defection of Martins Amaewhule and even used it to mock Governor Sim, an act they used to hail Wike for being incharge by telling them to defect, same people today are turning around to say that there was no defection, and that it was just Wike's political pattern of the more you look the less you see, And I ask, to what end? By making Martins Amaewhule jump from one court to another? As at today, Martins Amaewhule and his Friends are no longer Assembly members in Rivers State until the matter is decided by Supreme Court, something that even Justice Okogbule Gbasam couldn't have done otherwise in a matter that his brother Judge, in the person of Justice Nwali had already given judgement that is today before an appeal Court. Once your opponent start misrepresenting and interpreting court orders, you know the rest is history. Mumulity is truly a Mumulity. NOTE👇 💥JUSTICE OKOGBULE GBASAM deliberately declined jurisdiction and couldn't have reinstated Martins Amaewhule knowing fully well that, in September of 2021 he was alleged to be amongst 3 judges that were sanctioned by NJC for conflicting rulings and is on their watch list. 👉In a statement issued by the Director, Information, NJC, Soji Oye, in Abuja in 2021, he explained that the judges were said to have granted conflicting ex parte orders in matters with the same parties and subject matters. As a result, he Justice Okogbule Gbasam and others were barred from promotion to the higher Bench for a period ranging from two to five years whenever they were due for such promotion. 👉The NJC took the above decision at the end of its meeting held on December of 2021. The meeting, which was chaired by the then Deputy Chairman of NJC, JUSTICE MARY PETER-ODILI, agreed with the recommendations of the investigation committee set up in September that Justice Okogbule Gbasam of the High Court of Rivers State be barred from elevation to the higher Bench for two years as he failed to exercise due diligence in granting an ex parte order in suit No: PHC/2183/CS/2021 between Ibealwuchi Earnest Alex & four others and Prince Uche Secondus & another, as there was no real urgency in the circumstances of the matter that would have required an ex parte order. 👉Justice Gbasam was also issued with a warning letter to be circumspect in granting such ex parte orders in the future. So JUSTICE OKOGBULE GBASAM knows better and couldn't have fallen for the antics of those against due process and democracy, except he wants to be revisited by the NJC. E. P. I.
