Accordingly to an eyewitness who narrated to Eyes Of Lagos said he was caught removing a phone from the pocket of a man standing at the Ajala Bus Stop Ijaye Alagbado which some people were watching him from distance, so has he removed the man's phone he was confronted by those people watching him and they search and saw the missing phone with him.In a rage he was attacked by people and he was beaten mercilessly he later confessed that he stole the phone because he needed the money to buy food for his younger ones. Lagos surveyor accused of raping a woman source :http://www.eyesoflagos.com/2017/01/lagos-surveyor-accused-of-raping-woman.html The Lagos State Police Command has started investigation into the alleged torture and rape of a single mother of two, identified only as Ola, by a surveyor, Femi, on Destiny Estate, Abijo, Lekki. Ola alleged that one Monday, who was working for the suspect, brutalised and subdued her, before Femi raped her. Although a report from the Mirabel Centre of the Lagos State University Teaching Hospital, Ikeja, confirmed that there was forceful penetration, Femi, said the sex was mutual. He added that Closed Circuit Television recordings of the hotel where they copulated also showed that Ola only wanted to blackmail him for refusing to give her N2m. But Ola in her statement, said she was lured into the hotel by Femi. She explained that a woman she met at a shopping complex had tried to match-make her with Femi, but she turned him down. She said, “In 2014, I went to the Ikota Shopping Complex to buy clothes from a woman called Mrs. Bashorun. The clothes were for my children who wanted to celebrate the end of session party. “I became friends with the woman and later, she told me that someone saw me in her shop and was interested in me. When I met the person, he did not appeal to me. So, I turned him down. “I lost my uncle around that period and invited Mrs. Bashorun. She gave me N100,000 and said it was from the man. I told her collecting the money did not mean I had accepted his advances, and she said no problem.” Ola, who sold jewelry, said after the party, the woman started mounting pressure on her to date the suspect, adding that she stopped patronizing her because of the pressure. She explained that sometime in October 2016, she ran into Femi in the Petrocam, Sangotedo area of Ajah, after which they exchanged pleasantries. She said, “He said I should forget about the past and that we could be friends with no strings attached. He gave my children N20,000 before leaving that day. We discussed my business, which I told him wasn’t doing well because of recession. He proposed that if I could get buyers for his land, he would pay me a commission on it.” She said the suspect gained her trust and she felt free with him, adding that he always invited her to land meetings, but was always disappointed whenever she went with her children. Ola said she later got a visa to America and informed the suspect so he could assist her in selling off her property as she planned to relocate abroad. The victim said around 7.30pm on December 30, 2016, Femi called to tell her about a party going on in a hotel in the area. She said, “He said there was someone interested in buying my car and the person attended the party. I sent him a text message that I would come. “That day, I didn’t take my kids along because it was late. When I got there, there was no party going on. I parked my car and went to meet a lady at the reception. I asked her if there was a party going on at the hotel and she said no. “I was driving out of the hotel when Femi called my line and said he was upstairs and that I should go back to the reception. “While going upstairs, I suddenly saw a man behind me. He showed me a knife. He said if I didn’t cooperate, he would kill me and no one would know. “He took me to a door and someone pulled me in and slapped me. He gave me a blow and turned on the light. I saw the person was Femi; he pushed me to the wall and almost strangled me. “He called the man with the knife, Monday, to pull off my trousers and he did. He told him to go out and be on the watch. He dragged me to the center of the room and the pressure from the strangulation made me lose consciousness.” She said she woke up to see the suspect, who had stripped naked, pouring water on her. She said she reported the case to the police at the Ajiwe Police Station the following morning after she escaped from the hotel. The victim said she also handed over to the police the evidence of the assault, including her torn panties. Our correspondent learnt that the police referred the victim to the Mirabel Centre, where tests were conducted on her. A report of the test, confirmed that the said Ola was indeed physically assaulted and sexually abused. It was learnt that the police at the Ajiwe division invited the suspect and promised to charge the matter to court. However, he was said to have been released on bail. The case was said to have been taken up by the Lagos State Office of the Public Defender, which petitioned the Commissioner of Police, Fatai Owoseni, over the conduct of the police at the Ajiwe division. The Director of the OPD, Mrs. Salami Olubukola, said in the petition, dated January 6, 2017, that the agency had requested that the case be charged to court based on the directive of the Attorney General and Commissioner of Justice, Lagos State, adding that the Ajiwe Divisional Police Officer had promised to do that. “As our office awaited arraignment details, the petitioner, who had been in contact with the DPO Ajah, informed our office that the alleged suspect had been released on bail by the DPO and was now on the run. I have also put several calls to the DPO, but I have yet to get a response. “I must express my deepest dismay about the conduct of the DPO and other officers for compromising the case by not charging the alleged suspect to court, but granting him bail instead. I humbly request that your office investigate this matter and do the needful,” the petition read in part. When contacted, Femi said Ola had demanded N2m from him and threatened that if he didn’t pay the money, she would blackmail him. He said, “Please don’t mind her, she is a scammer. Actually, she is my girlfriend and she always collected money from me. If you investigate, she has blackmailed many other men in Ajah. “Anytime she asked me for money, even when I was not in Nigeria, I would send money to her. Sometimes, she would say she was in debt, and I would bail her out. “She called me on the day and said we should meet at a hotel, that she wanted to groove with me. “When we got to the hotel around 2am, she said she needed N2m to travel abroad. The way we both entered into the hotel and even the text message she sent to me; I have all the evidence. After we were done and I took her out of the hotel to see her off into the car, I have all the recordings.” His counsel, Bola Olugbani, said the matter had been transferred to the Inspector General of Police Monitoring Unit, adding that her client had become the complainant. She said, “They have a long time relationship and she invited him to a hotel. They ate, drank and retired into a room. She is a mother of two children and she is not a virgin or an under 18 girl. She is an adult who entered into a hotel with a man; she cannot likely be somebody who was raped. The CCTV recordings show that only she and my client entered the room. She told the police that other persons held down her legs for my client to sleep with her. The CCTV footage showed something different: no human being entered the room with them. “She held my client’s shirt at 2am, demanding between N2m to N5m or else she would scream rape. My client petted her up till 4am when she loosened her grip and he escaped. She then made a defamatory report at Ajiwe Police Station, Ajah. “The case file has been transferred to the IG Monitoring Unit at Kam-Salem House, Ikoyi. Legally, my client is now the complainant, while she is the suspect in a case of false information, false petition, blackmail, attempt at extortion and assault. Sooner than later, investigative police report will show that someone is on the wrong side of the law and will be charged to court.” The Police Public Relations Officer, SP Dolapo Badmos, said the police were on the case. She said, “The case is under discreet investigation; the division is still awaiting a medical report. At the conclusion of investigation, proper action will be taken. “All the divisional police officers know that the Commissioner of Police does not tolerate anyone who compromises cases that have to do with domestic and sexual violence, hence no DPO will want to take such risks.

The tipper driver didn't stop driving after the incident happened because he knew the Lasema will be after him. He later parked the trailer beside a filing station at salolo bus stop Abeokuta expressway and fled away from the scene, it was confirmed to us by a Petrol attendant and some people around that they saw two Igbo men parking the trailer, they ran away immediately they parked the trailer which later some policeman and Lasema respond unit(LRU) stormed the place looking for the trailer driver and asking people around question if they see the trailer driver . A summary of collections at the disposal of Sunday Vanguard indicated that only N 299,802,506,588.50 was collected as Company Income Tax (CIT), which was a far cry from the expected N867 billion contained in the 2016 budget. However, Value Added Tax (VAT) yielded N 473,464,201,273.68 as against the budgeted N198 billion; while Annual Luxury Surcharge and Capital Gains Tax brought in N 389,215.00; and N 5,181,085,834.74, respectively. Education Tax generated N 46,868,726,865.07; Foreign Travels Surcharge, N 50, 000; NITDEF N 7,592,280,052.74; Pay As You Earn (PAYE), N 47,236,020,074.34; Personal Income Tax, N 632,690,077.20; Pre-Operational Levy, N 391,008,052.89; Stamp Duties, N 5,878,279,893.53; and Withholding Tax, N 320,849,522,390.45. The recession has forced the Federal Government to reduce its CIT budget for 2017 to N808 billion, representing a 7 per cent cut. However, the VAT budget has been increased from N198 billion in 2016 to N242 in the 2017 budget, That increase was N44 billion of 22 per cent.

Nigerian Immigration Service to increase the cost of acquiring international passport Source : http://www.eyesoflagos.com/2017/01/nigerian-immigration-service-to.html The plan to, once again, hike the cost of acquiring International passports is not only confounding to Nigerians who are already over-burdened as they reel under the prevailing harsh economic conditions, its contemplation at all by the Nigerian Immigration Service is really insensitive. That plan should be shelved and all outstanding applications should be granted without further delay. Every citizen has a right to a passport, the issuance of which should be seen as a duty of the government to the people. That being the case, it is absolutely wrong to make Nigerians pay through their noses to get their country’s passport, perhaps the most valid identification INSTRUMENT every citizen is entitled to. As such, its issuance should not be predicated on the economic circumstances at any time and it should be made easily accessible as well as affordable, especially since it serves the purpose of enhancing the national database. President Muhammadu Buhari should therefore reject the request for any increase in passport fees in the public interest. Instead, government should work on the processes of ensuring the production of passport booklets locally, as contracting the job to foreign companies is one of the major reasons for its high cost, a situation that is unacceptable for both economic and national security reasons. Indeed, the statement by the Comptroller-General of the National Immigration Service, Muhammad Babandede, the other day that Nigerians would have to pay more for international passports should not be taken LIGHTLY by the government and everything must be done to keep the cost down. Also, the suggestion that Nigerians would need to present their tax clearance certificates before being issued their passports is unnecessary and should be disregarded. If anything at all, such a measure would merely complicate the processes while not really helpful to the intended goal of making people pay their taxes. According to Babandede, the proposed hike has been necessitated by the high cost of producing the passport booklets abroad, which he said has become unsustainable and uncompetitive under the current dispensation. Indeed, according to him, it has become increasingly difficult for the Immigration Service to pay for the passport booklets being printed outside the country because of the fall in the value of the naira. The NIS also reminded Nigerians that it is a revenue-generating agency and that “service delivery would improve as soon as the Federal Government approves the new fees for passports.” Really? The passport booklets are currently produced under a private-public partnership arrangement and is not funded by government. That, by implication, makes passport issuance more of a business than a service. Hence, according to the immigration agency, Nigerians must pay for it according to the prevailing economic circumstances. Roughly two years ago, in August 2014, the Nigerian Immigration Service increased the cost of passport acquisition from around N7, 000 to the present N20, 000. Even at that, unscrupulous elements within the service have colluded with touts to charge over N25, 000 or extort much more from desperate applicants. Even so, efficiency has never been the hallmark of the service. Today over 4, 000 applications are currently stuck at various passport offices across the country due to lack of booklets. It is baffling and, indeed, shameful that Nigeria still cannot produce international passport booklets in the country, which is why the cost rises every now and then according to the extant EXCHANGE RATE. What kind of country, it must be asked, prints every security document, including her currency abroad, even when it has a Nigerian Security Printing and Minting Company? That the NSPMC cannot meet the country’s security documents need has been known for a long time and something should have been done to upgrade its capacity. The result of dependence on foreign companies, like terribly bad currency notes in circulation or scarcity of international passport booklets, has always been a certain monumental embarrassment to Nigeria. These are in addition to such cases of national disgrace as occasioned by the printing of polymer banknotes in far-away Australia by the Central Bank of Nigeria (CBN) or the printing of election materials in South Africa by the Independent National Electoral Commission (INEC). Now, Nigerians are confronted with the printing of passport booklets in Malaysia by the NIS. It is safe to say that the Nigerian system has deliberately left gaps for corruption to thrive as far as printing security documents is concerned for it can be assumed that it pays corrupt government officials to award over-priced contracts to foreign companies instead of getting the job done in Nigeria or fixing the printing facility in the country. Certainly, Nigeria can save herself this monumental international embarrassment.

An eyewitness said the inferno was caused by an explosion from a tanker that was discharging petroleum at the station. A worker at the station, who did not want his name in print, explained that the fire started around 2:30 pm, when the tanker was discharging fuel to the tanks of the petrol station. He, however, said no casualty was recorded; neither did anyone sustain injury, but that some SECTIONS of the station with other valuables were affected by the inferno. He said that officers and men of the State Fire Service promptly responded to a distress call to put out the fire. It was gathered that the prompt response of fire service prevented the inferno from spreading to adjourning buildings, including an MTN mast located within premises of the station. Some eyewitnesses, who were students of the Benue State University confirmed that the prompt response of the fire service saved the day. Efforts to get the state chief fire officer, Mr. Andrew Onmakpo to speak on the incident proved abortive, but his men were seen at scene of the incident.

The State’s Commissioner for Housing, Prince Gbolahan Lawal, has unveiled the Rent-To-Own and Rental Housing Policies of Governor Akinwunmi Ambode’s administration. The Rent-to-own policy targets the low and medium income earners in both the formal and informal sectors. Under this arrangement, individuals are required to pay 5 per cent of the value of the housing unit as commitment fee and the balance is spread over 10 years. The programme allows the tenant to live on the property while paying towards ownership as a fixed rent within the period of ten years. “ There are eligibility criteria to be met though. Applicants must be primarily resident in Lagos State and will be required to submit a copy of their Lagos State Residents Registration Card., must be a First Time Buyer, over 21 years of age, tax compliant and 33% of his/her earnings must cover the monthly rental payments. 12 Housing Estates have been dedicated for this `Scheme and they cover all parts of the Lagos Metropolis, from Lekki, Surulere, Ikorodu, Alimishosho etc (see list of estates and payment plans below). 20 years ago, the only thing I had was a dream. Though I had beautiful dreams, the physical resources to meet my heart desires were beyond my reach. I was homeless, worked as a motor boy or bus conductor (Nigerians will understand this).... Despite all these challenges, I dedicated at least 2 hours each day to develop myself. I was told several times to quit trying. I was told to stop dreaming.... To keep the story short, in 2006 I had my first degree and I graduated top in my class. I have been following closely the activities of this government and whenever I have the opportunity, I try to find out the opinions of people as regards the performance of this government. I just realized that the hardship faced by many Nigerians is simply as a result of the fact that almost everyone of us benefited from the cycle of corruption. The bricklayer, plumber, laborers, tiler are all complaining because building construction has slowed down massively cause the thieves no longer have money to spend on real estate. The car dealers are grumbling because their cars are begging for buyers. Thieves can no longer spend wastefully. The private school owners are shouting because parents can no longer pay outrageous sums and are withdrawing their wards. I was shocked when I learn that in a popular private University in Abuja, parents are writing undertaking at the account section for their children to be allowed to write exams... and it goes on and on. The fact is, a lot of people are returning to what someone referred to as ''default mode''. We mostly have been living above our REAL MEANS. We have been staying in houses that ordinarily our incomes can't afford. Our children going to schools we can't afford. Driving cars we ordinarily can't maintain. We have been living a FAKE LIFE all along. Now the reality is before us and we don't want to accept it. This shows how morally bankrupt we are. You can't eat your Cake and have it. Take Note..."GOD HELP AND BLESS NIGERIA" You got billions from bank without collateral using your political influence. You put half into your business and spent the other half on exotic cars, jeweleries, etc. Your business employs 100 people normally. You get illegal waivers and concessions to import raw materials at rock bottom prices, you get over-inflated contract to supply government some goods your company produce....in short your company is kept afloat by corruption. Now the new SHERIFF in town says: no more ridiculous waivers, no more inflated contracts, no more bank loans without collateral, in fact its time you or your company pay off the billions of debt owed..... AMCON takes over your company, staff are laid off......And you go on air and say the new sheriff is killing business and causing unemployment.. The truth is....you and your company were never in business, you were only feeding off the system. Too many companies and banks are funded by corruption. Remove corruption from the system and they collapse.......and we end up blaming the person that removes corruption for the collapse of the corruptly run fake company. The current senators who once served as governors are Bukola Saraki of Kwara, Rabiu Musa Kwankwaso of Kano, Kabiru Gaya of Kano, Godswill Akpabio of Akwa Ibom, Theodore Orji of Abia, Abdullahi Adamu of Nasarawa, Sam Egwu of Ebonyi, Shaaba Lafiagi of Kwara, Joshua Dariye of Plateau Jonah Jang of Plateau, Aliyu Magatakarda Wamakko of Sokoto, Ahmed Sani Yarima of Zamfara, Danjuma Goje of Gombe, Bukar Abba Ibrahim of Yobe, Adamu Aliero of Kebbi, George Akume of Benue and Isiaka Adeleke of Osun. The former deputy governors in the Senate are Ms Biodun Olujimi of Ekiti and Enyinaya Harcourt Abaribe of Abia. Danladi Abubakar Sani served as the acting governor of Taraba state. Many former governors are also in Buhari's Cabinet as Ministers. This includes: Ngige, Fayemi, Amaechi and Fashola (SAN).). In Akwa Ibom State, the law provides that ex governors and deputy governors receive pension equivalent to the salaries of the incumbent. The package also includes a new official car and a utility vehicle every four years; one personal aide; a cook, chauffeurs and security guards for the governor at a sum not exceeding N5 million per month and N2.5 million for his deputy governor. In Rivers, the law provides 100 percent of annual basic salaries for the ex-governor and deputy, one residential house for the former governor “anywhere of his choice in Nigeria”; one residential house anywhere in Rivers for the deputy, three cars for the ex-governor every four years and two cars for the deputy every four years. It is alledged that in Lagos, a former governor will get two houses, one in Lagos and another in Abuja, estimated at N500 million in Lagos and N700 million in Abuja. He also receives six new cars to be replaced every three years; a furniture allowance of 300 percent of annual salary to be paid every two years, and a N30 million pension annually for life. This is the reality for all the 21 ex govenors and deputy governors who are currently serving as senators. This same is also true of ex governors who are now serving as Ministers. NOW I ASK: How many years did these guys serve their states as governors and deputy governors? Is it more than 8years? Is that a reason to be entitled to pensions for life? Even if they are entitled to pension for life, must it be so outrageous? As if that is not enough: HOW on earth can any public servant with conscience collect salaries and allowances as a senator or minister, and still have the audacity to claim pensions equivalent to the salaries of a serving governor in Nigeria? The victim Ibrahim narrated to eyesoflagos "On my way home, I greeted a lady friend happy new year. This lady is an old friend of mine. As I continued my journey home, a short young dark in complexion soldier called me, asking me to come over. He was with 3girls , He asked me why I greeted the lady and I reply him that the lady I greeted is an old friend of mine .The soldier asking me questions whispered to his other drunk soldier friends. The next thing I know, they all gathered around me beating me mercilessly". The victim had several and severe injury on his head and other part of his body, blood stains everywhere. According to Ibrahim "I barely made it back home alive and this was all because I greeted an old female friend". The residents in that area confirmed to us that the soldiers were drunk. Ibrahim was beaten to pulp, soaked in blood and humiliated by the 4 drunk soldiers his way home for a very flimsy reason. Is this an act to prove superiority? These force men are meant to protect and not oppress us with their power and authority.

Today the 30th of December 2016, protesters took to the street all the way from Lekki Ajah Lagos Islands to Alawusa Ikeja protesting over demolished buildings at Olokonla Gardens Estate near Lagos business school Ajah Lagos state. It all started on the 16th of December 2016 when suddenly a very quiet peaceful and beautiful neighborhood was turned into dust by four heavy duty bulldozers. More than 200 buildings with a value price of more 20 million naira were demolished by the Lagos state government at Olokonla Gardens Estate near Lagos business school Ajah Lagos. It was gathered that four bulldozers escorted by soldiers turned to dust over 200 buildings out of the estimate 1,000 buildings to be demolished in the estate. Speaking to one of the protesters, he recalled how he was mistreated, beaten and wounded by the soldiers that escorted the bulldozers when dared to protest. Another protester narrated bitterly how he and his family where forced out of their homes and left homeless even for the Christmas celebration. According to him "We were not only forced out of our home, our valuable possessions were also stolen by hoodlums before we could move them to a more secured environment." BREACH OF AGENCY AGREEMENT Prince Joel ESQ | November 5, 2016 | Land Verification | No Comments An agency agreement is the creation of a contract entered into by a mutual consent between a principal and an agent. A principal is a person that grants authority to an agent to act on behalf of and under the control and instructions of the principal. Therefore, the law governs and regulates the legal relationship in which an agent dealing with a third party for his/her principal. Both parties, that is; the Agent and the Principal owe certain duties towards each other. The extent of these parties duty is usually determined by the terms of the agreement between the parties and extent of the authority and obligation conferred on the agent by the principal. An agent’s primary duties are: To act on behalf of and be subject to the control of the principal; To act within the scope of authority or power delegated by the principal; To discharge his/her duties with appropriate care and diligence; and To avoid conflict between his/her personal interests An agent cannot acquire any material benefit from a third party in connection with transactions conducted or through the use of his/her positions as an agent. He must act with the care, competence, and diligence normally exercised by agents in similar circumstances. He must also take action only within the scope of his/her actual authority and comply with all lawful instructions received from the principal and persons designated by the principal. An agent must act reasonably and refrain from secret profit or conduct that is likely to damage the principal’s enterprise An agent is liable to a principal when he/she acts without actual authority, and liable to indemnify a principal for loss or damage resulting from his/her act. A principal on the other hand owes certain contractual duties to his/her agent. A principal must compensate the agent as agreed and also indemnify and protect the agent against claims, liabilities, and expenses incurred in discharging the duties assigned by the principal. A principal owes his/her agent a duty to act in good faith and fair dealing. However, a principal can be relieved of contractual obligations by an agent’s prior breach of contract. An agent can be relieved from his duty by the principal through termination because the agent is in breach of their agency agreement If the agent fails to perform any of the duties instructed by the principal and the principal suffers damages as a result, the principal may be able to win a case against the agent for breach of duty. In addition, it should be noted that anyone whom the agent injures while dealing on the principal’s behalf may choose to sue the principal for damages based on the third party’s injuries. Some courts will hold the principal liable even if there was no express contractual agency relationship, as long as the injured person reasonably believed that the agent was acting on behalf of the principal when the injury occurred. WOMEN’S RIGHT TO INHERITANCE Prince Joel ESQ | October 19, 2016 | Land Verification | No Comments In Nigeria, female child and widows rights to inherit their father/ husband’s property in most tribes and cultures are somewhat similar. Generally in the inheritance system, female child or widows are usually excluded or limited to inherit their father/ husband’s property. This principles or custom has raised arguments, debates on equality and discrimination of the female gender. However, some of this principles and customs have been changed or amended by the court of justice as we shall see below. In most Igbo traditional societies, females and widows do not exercise rights of inheritance over their father/ husband’s property. Though they could benefit from the estate or property. Such gestures are normally extended to them by their father/ husband out of his personal consideration while he is alive. And even at that, such gesture cannot include any portion of land within his ancestral home. The right to succession of the entire estate belongs exclusively to the first or eldest son of a deceased person who acts as Trustee for the other children. Such first son can inherit absolutely to the exclusion of other children. However, by some modifications, the eldest son can allocate land to his other male siblings upon their making of a request for allocation of land. In the case of Ejiamike v Ejiamike (1972) 2 ENLR p. 11, the court held that the right of the eldest surviving son to succeed his father in the headship of the family is AUTOMATIC and arises from seniority. Only the father who is the owner and creator of the family property can deprive the eldest son of this right by a valid direction. This direction might be made to ensure that the affairs of the family are properly managed by a person competent on the grounds of intellect and education. In the absence of any such direction by the father, the right of the eldest son cannot be taken away without his consent. In the Igbo land WOMEN are excluded from succession and entitlement to inherit the property of their father/husband. A widow has no right of ownership over any property of her deceased husband, rather the widow’s right in the land is to mere possession of a parcel of family property subject to her good behavior and it is immaterial whether she has surviving sons or not. However, as modernization evades our country, some customary laws are getting reformed. The reformation of unfavorable customary laws of women inheritance in the Igbo land is evident in the decision of the Supreme Court on female right to inherit property. On April 15th 2014, the Supreme Court based its decision of that of the Lagos state High Court and the Court of Appeal. This has made women succession and entitlement to inherit property in the Igbo land possible and valid. In Northern part of Nigeria, which is largely dominated by Muslim, women’s inheritance is governed by Islamic law which is the Sharia law. Under the Sharia law, women can acquire and retain their own property, pass it on to their heirs, and can inherit from their deceased parents, husbands, brothers, sisters, daughters and other relations. Under the personal law code of the Sharia, the share of inheritance a female receives is half as much as the male heirs. A widow, though, has the right to only one-quarter of the estate if her deceased husband has no descendants and one-eighth if there are heirs. If there is more than one widow, this one-eighth portion is shared between them. These are usually poor properties, with no provision for housing or land. The title to a land is perfected when you register your title or interest in a property with the Lagos State Government or the Governor of any state in Nigeria where the property you bought is situated. Governors Consent, Stamping, Registration are processes for perfection of title to land GOVERNOR’S CONSENT: Section 22 of the Land Use Act, 1978 requires that for every transfer of property in Nigeria, the Governor’s consent is required. The Act provides that all land in each state in the Federation is vested in the Governor of each State, whose prior consent is mandatory for the legal validity of any transfers or alienation of interest in a landed property. To this effect, the consent clause is an instrument itself. The following documents are required in obtaining the Governor’s consent: Forwarding/Covering Letter (with date, address, telephone numbers and Email address); Chartable Survey Plan (4 Copies) Completed Form 1C; Certified True Copy (CTC) of Grantor’s title document; Duly Executed Deeds (4 copies) Spiral bound with Assignee’s signature on all pages). Picture of site with date and time showing adjoining properties Location Sketch properly drawn Charting and Endorsement/Form 1C Fee Copy of Identification (clear copy) Evidence of Red Copy Lodgement Administrative Fee Sworn Affidavit Development Levy Current tax clearance certificates of the assignor and assignee; For limited liability companies, the internal revenue certificate of PAYE Directors; Four copies of the deed of which consent is sought should be attached; Copy of the survey plan, as approved by the Surveyor General Office and a picture of the building; Evidence of payment for charting fee, endorsement fee, Form 1C; Evidence of payment of land use charge; Where the property is covered by a state leasehold or Certificate of Occupancy, evidence of payment of Ground Rent, up to date; Where the property is covered by a state Leasehold or Certificate of Occupancy, evidence of payment of Ground Rent, up to date; A photograph of the property; A copy of the applicant and/or his agent/legal representative’s identification. STAMPING The Stamp Duties Act which governs this procedure has laid down requirements and procedures for stamping your instruments. And these are: Forward the title document to the Stamp Duties Commissioner within thirty days of execution otherwise, you will be liable to pay the penalty. Ensure that you deliver at least two (2) copies. The Commissioner will assess add Valorem (based on value). It is usually between (3.5%) of the consideration of the transaction. Payment should be made by bank draft and sometimes in the name of the state government. Upon making payments, the commissioner will impress on the instrument the words, “stamp duty paid”.
