“There is no such power given to NASS by the Constitution to summon everybody,” he stated.
The thing is, Nigerian news presenters don't research topics of discussion, they don't ask follow up questions, they don't even call out their guests when the lie or make contradictory statements, they jus let them lie and keep lying.
Falana backs IGP, says Senate has no right to summon him
Human rights lawyer, Femi Falana, SAN, on Thursday faulted the Senate for ordering the President to appear before it, saying it has no power to summon him as well as state governors.
He made this known when he appeared as a guest on Channels Television’s breakfast programme, Sunrise Daily, on Thursday.
Quoting Sections of the Constitution, he explained that “the President or the governor of a state cannot be summoned by the National Assembly (NASS).
“The only other occasion where a public officer can be summoned by the National Assembly is when proceedings are ongoing to expose corruption (Section 88) and when a law is being debated either with a view to amending it or to have a new law entirely.”
According to Falana back in 2018, section 88 was the reason why NASS cannot summon the President.
By the combined effect of sections 88 and 89 of the Constitution the National Assembly is empowered to summon any public officer including the President
According to the same Falana now in 2020, the same section 88 is the reason why NASS can summon the President.
In 2018 - Section 88 = NASS can not summon the president.
In 2020 - Section 88 = Nass can summon the president.
This is why Nigerian lawyers and the entire Judiciary system are pure disaster. They lack credibility, the lie easily, t's like lying is part of their DNA.
Reacting, Falana said the president should not allow himself to be embarrassed by turning down the invitation, adding that the national assembly has the power to summon him.
By the combined effect of sections 88 and 89 of the Constitution the National Assembly is empowered to summon any public officer including the President in the course of conducting investigation into any matter with respect to which it has power to make laws and the conduct of affairs of any person, authority, ministry or government department charged, or intended to be charged, with the duty of or responsibility for executing or administering laws enacted by the national assembly.
A Senior Advocate of Nigeria (SAN), Mr Femi Falana, has faulted the Senate for ordering the President to appear before it, saying it has no power to summon him as well as state governors.
He made this known when he appeared as a guest on Channels Television’s breakfast programme, Sunrise Daily, on Thursday.
Quoting Sections of the Constitution, he explained that “the President or the governor of a state cannot be summoned by the National Assembly (NASS).
“There is no such power given to NASS by the Constitution to summon everybody,” he stated.
“It has given the President the discretion to address the National Assembly either jointly or separately on any matter of national importance.”
The senior lawyer also said: “the Senate didn’t get it right this time around. By virtue of Section 67 of the Constitution, the National Assembly or either chamber can summon a Minister when the affairs of his or her ministries are under consideration.
“The only other occasion where a public officer can be summoned by the National Assembly is when proceedings are ongoing to expose corruption (Section 88) and when a law is being debated either with a view to amending it or to have a new law entirely.”
Speaking further, Mr Falana stated that the lawmakers can, however, fix areas of the Constitution perceived as weak, rather than going beyond its limits as such actions can subject the institution to ridicule.
“What can be done, a constitutional review is ongoing, you can deal with the identified gaps but don’t go outside the limit of your powers. When you do that, you ridicule the institution and that is what is going on.”
According to Vincent Uba, National Co-ordinator, “the lawmakers behaved as if they were kindergartens, exhibiting political rascality and gangsterism capable of smearing the image, reputation and credibility of Nigeria that have continued to rise in the international community since the current administration assumed office. “In as much as democracy bestows freedom of expression on the citizenry, that freedom is not absolute to the level of embarrassing the Nigerian nation in an attempt to get at the sitting President, because of his seemingly endearing popularity before the electorate in the run-up to the presidential election in a few weeks
BastardWike: Stop talking bulsiit! What are you even talking about you this BMC? Or you mean they should have bowed down to worship him instead of singing?
Buhari simply avoided them because he already knows he has no answer for the questions they were going to throw at him, so instead of going there and ending up being humiliated, he simply took the coward route by shying away.
The last time he was there, they attacked him and behaved like thugs and animals, they definitely don't deserve his presence or any chance to repeat their disgusting behavior.
Thanks you for enlightening those fools. I still remember when the bridge was inaugurated by GEJ, 30 billion naira (SURE P) counterpart funding was paid the government to yhe concessionaire. Julius Berger began erecting beams and land clearing. No doubt, Buhari was fortunate that part of Abacha loot was returned during his administration to be able to continue the project under the strict vigilance of the US and Swiss that returned the funds. They're making sure that money is being put to use to complete three projects, Lagos-Ibadan expressway, Second Niger Bridge and one road in the north like that. They don't trust the Buhari, left to him, he'll take the money and share it among his fellow almajiri in North, like he did when the first tranche was returned. US and other agency directly credited the account of the NSIA, the agency that's overseeing those projects and believe me when you this, they are being briefed in real time about the progress of the projects
We’ve spent N10bn on 2nd Niger Bridge so far — Jonathan
President Goodluck Jonathan said the Federal Government has spent N10 billion on construction of the 2nd Niger Bridge out of the N130 billion total cost of the project.
He said: “The second bridge is being realised under the PPP model. The special purpose vehicle will be jointly owned by Julius Berger-Nigeria Sovereign Investment Authority Consortium and Federal Government. And as obtainable under the PPP model, the concessionaire will have the right to charge tolls for the use of the second Niger Bridge as well as have full commercial rights on the Projects Right of Way.”
Speaking at the ceremony, the Chairman of the South-East Governors’ Forum and Abia State Governor, Theodore Orji, described the flag-off of the construction of the 2nd Niger Bridge as the flag off of the process of retaining President Goodluck Jonathan in office in 2015
Jonathan kicks off N117 billion Second Niger Bridge project
This is how they behaved when PMB graced their presence back in 2018, this is their so called democratic and constitutional behavior.
Just imagine these are adults and representatives off the people embarrassing themselves and the legislative body they represent.
Going by this shameful and disgusting display by members of the national assembly, the president made the right decision because these useless and embarrassing lawmakers should not be in the same room with the commander in chief.
This is what they are trying to repeat and the president shouldn't give them the satisfaction or enable these touts and jesters.
My dear. Because we have never had the right leadership in Nigeria. Leadership is the key to socio-economic advancement in any society.
If leaders set out strict laws and ensure perpetrators are punished decisively, people will change.
In Dubai there is no single police check point on the road. But road offenders are taxed with heavy fines and with cameras and other state of the art equipments traffic offenders are heavily fined.
So the average driver in Dubai is cautious and they try everything possible to avoid fines.
Policies can transform a society.
Who knew a war torn country like Rwanda would be a model for African governance? They had the right leadership that has made Rwanda a jewel in Africa.
Which country or any society on earth ever considers to emulate Lagos governance? Except from Nigeria? Imagine a King maker living fat on the resources of Lagos.? And people like that Agbero are hailing him...
[/s]
These ignorant people don move from comparing Lagos with Kigali to comparing Lagos with Duba.
Dubai Budget = $15 billion
Lagos Budget = $2 billion
Dubai Population = 3 Million
Lagos Population = 20 Million
Must you ignorant ipob villagers make dumb, baseless, illogical and ignorant comparisons?
You need to stick to shitposting because apart from shit posting, you are pretty much worthless.
