1) Oyema's alleged crimes were committed on US soil while Kyari's alleged crimes were committed on Nigerian soil
1) Oyema is a private citizen while Kyari is a public servant.

Onyema is not under any public service rules....he is an investor and businessman. He owns his business...but Abba Kyari de tailor is a federal public service officer...and there is PSR Act.
