Good day house. Its being quiet in house for weeks. Please I need clarity on my 5 years indefinite leave to remain (ilr) calculation.
I am on the 5 years route. My BRP first issue was 11th December 2017 (11/12/2017). Arrived UK 30/12/2017. I have been given extension and it expires 21/7/2023. With this calculation, (date of first issue to expiry) its 5 years 7 months.
In order to qualify for 5years ilr application, should I wait till my BRP expires 21/7/2023 (which will be 5 years 7 months)? Or can I calculate exactly 5 years from date of issue 11/12/2017, which will be 11/12/2022 and apply?
To summarise my date of first issue to expiry is 5years 7months but I want to apply exactly 5years from first issue (due to school admissions timing). Please I need the house opinions, must I wait till brp expires (28 day rule considered) or simply calculate 5 years from first brp issue. Thanks.

My understanding is that you need to show evidence that you have been living in the UK for 5 years to apply for ILR, if you are on the 5 years route. In essence, if you arrived in the UK on 30/12/2017, then you should be eligible to apply for ILR from 30/12/2022.

For me, I arrived here in February 2017 and I intend to apply for my ILR by February 2022, despite my BRP expiring in May. There are quite a number of benefits going on the ILR as compared to being on a temporary visa, so no need to delay. The earlier the better, especially as laws change all the time.

Thanks for the detailed response. I was Initially bothered as to why my BRP expiration was 7 months in excess to my 5 years stay. I also intend to apply 5 years from my date of entry and hope its accepted. Thanks once again.

You can apply anytime after your 60 months. The extra months are for any circumstances that keep your abroad for less than 5 months.

Loads of people don’t have the time to read a clump of information. I skipped your post at first until I read the shorter response to someone’s question and understood what you were asking, then went back to read carefully. If I hadn’t seen that shorter and more spaced form, I wouldn’t have answered your question.

It was just an advice for better writing- nothing serious.

If I understand you better, you would have preferred each paragraph to have double spacing? Or increased the line spacing? Because that post had 4 separate paragraphs.

Who has recently applied for indefinite leave in the last six months or who is due to apply soon?. Please update us on details. Documents you submitted and your timelines. Did u do it yourself or with the help of solicitor ?.

I thought after all those with Successful UK spouse visas, it will be nice to have a page for the next stage, FLR for the extensions after 2.5years being in the UK with your significant other kiss

So I will be gathering as much information as I can as time passes to help with upcoming applications.

The main thing to remember, once your spouse has been granted their spouse visas, and arrive in the UK is to make sure you start gathering evidence of cohabitation since this is what you supply instead of the Communication evidence smiley

So here goes for the next stage smiley

28 Days FLR M Calculation


I want to apply for FLR M Visa on 23rd of July for a spouse visa which expires on 19th of August 2021.

My question is should I apply on 22nd or 23rd of July? Thanks

Yes dear. ILR is 5 years. No need to wait till yours is about to expire as far as you’ve paid taxes here for 60 months (ignore Covid).

Please does the nos of days you're out of the UK before you renew the spousal visa count when you eventually want to apply for ILR and then British citizenship?

With all my travels, i have been out of the UK for like 60days.. will that become a problem eventually when i want to renew spousal visa next year Or during ILR in 3years ish time?

I'm asking so i know when to cap my trip..

My advice is that you factor in the number of days you've been out of the Country into your calculation for 5 years. In essence 365 days x 5 years = 1825 days. So if your 5 years was meant to be due by 1st Jan 2022, but you've been away for 60 days, add an extra 60 days to your wait time. It then becomes c.7th March 2022. That way you are sure that you have a total cumulative time of 5 years in the Country prior to your application.

There's also a limit to the length of time you can be away from the country within your 2.5/5 years wait, I advise you to investigate so it doesn't jeopardize your application.

The timeline for a standard application seems to be 2months.. your biometric date was almost a month from application date..

That's correct. Standard applications tend to receive an outcome within 8 weeks of submitting an application

You are eligible to apply 28 days before expiry, do not submit before then. That will be 31st of August if my math is correct.

When you submit your application, you will have to register with sopra steria, you will be given a link after you have paid the application fee. You cannot register with them before submission. There you will be able to upload your supporting documents and book an appointment for biometrics. You can submit the documents on the sopra steria site when you upload them up to two days before your appointment. Note, you can only submit once through the website then you will not be able to submit through the website again but you can still upload documents. Do not fret, at the appointment for the biometrics they will ask if you are happy with all the uploaded documents and will submit everything there for you.

You apply based on the date you have on your brp, for FLR 28 days before expiry or 28 days before your 5th anniversary. You cannot submit the application after the expiry date.

For the number of days spent outside the UK, go to gov.uk website, there are guidelines and examples there. Read, apply and interprete to your case.
