foxyvisa: Hi foxyvisa, My understanding is that you need to show evidence that you have been living in the UK for 5 years to apply for ILR, if you are on the 5 years route. In essence, if you arrived in the UK on 30/12/2017, then you should be eligible to apply for ILR from 30/12/2022. For me, I arrived here in February 2017 and I intend to apply for my ILR by February 2022, despite my BRP expiring in May. There are quite a number of benefits going on the ILR as compared to being on a temporary visa, so no need to delay. The earlier the better, especially as laws change all the time. All the best! |

Demoore: Thanks for the detailed response. I was Initially bothered as to why my BRP expiration was 7 months in excess to my 5 years stay. I also intend to apply 5 years from my date of entry and hope its accepted. Thanks once again. 1 Like |

foxyvisa: You can apply anytime after your 60 months. The extra months are for any circumstances that keep your abroad for less than 5 months. Spacing your text makes it easy for people to read. 1 Like |

foxyvisa: Loads of people don’t have the time to read a clump of information. I skipped your post at first until I read the shorter response to someone’s question and understood what you were asking, then went back to read carefully. If I hadn’t seen that shorter and more spaced form, I wouldn’t have answered your question. It was just an advice for better writing- nothing serious. |

Hi hi, Please does the nos of days you're out of the UK before you renew the spousal visa count when you eventually want to apply for ILR and then British citizenship? With all my travels, i have been out of the UK for like 60days.. will that become a problem eventually when i want to renew spousal visa next year Or during ILR in 3years ish time? I'm asking so i know when to cap my trip.. |

profemebee: My advice is that you factor in the number of days you've been out of the Country into your calculation for 5 years. In essence 365 days x 5 years = 1825 days. So if your 5 years was meant to be due by 1st Jan 2022, but you've been away for 60 days, add an extra 60 days to your wait time. It then becomes c.7th March 2022. That way you are sure that you have a total cumulative time of 5 years in the Country prior to your application. There's also a limit to the length of time you can be away from the country within your 2.5/5 years wait, I advise you to investigate so it doesn't jeopardize your application. All the best! |

Hello; I am a newbie on here. My husband initial spouse visa runs out on the 27th of September 2021. At the end of August, he would have been with me here in the UK for 2years and 8 months. We now have to apply for his next stage FLR. Has anyone submitted a week before the 28 days? Can this be around 28 days, i.e a little flexible or does it have to be within the 28 days, i.e. Can we submit on the 23rd of August, this is tomorrow or does it have to be on the 30th or 31st of August? The other thing is the submission the online application or is it after the biometric appointment? This is a little confusing. Can someone clarify please [Thanks] |

kwandjw2018: You are eligible to apply 28 days before expiry, do not submit before then. That will be 31st of August if my math is correct. When you submit your application, you will have to register with sopra steria, you will be given a link after you have paid the application fee. You cannot register with them before submission. There you will be able to upload your supporting documents and book an appointment for biometrics. You can submit the documents on the sopra steria site when you upload them up to two days before your appointment. Note, you can only submit once through the website then you will not be able to submit through the website again but you can still upload documents. Do not fret, at the appointment for the biometrics they will ask if you are happy with all the uploaded documents and will submit everything there for you. I hope i have been able to help. |

hi, does the number of days away on vacation or work affect the 2years 8months timeline? If one has been away for 100days for example, does that mean by 2years 8months, one will still have to stay an extra 100 days to cover for days away? deept: |

profemebee: You apply based on the date you have on your brp, for FLR 28 days before expiry or 28 days before your 5th anniversary. You cannot submit the application after the expiry date. For the number of days spent outside the UK, go to gov.uk website, there are guidelines and examples there. Read, apply and interprete to your case. |
