Dear Nairalanders,

With a sad and heavy heart, I'm writing to seek your advice and/or recommendations.

My mum is late. She died 2 years ago and since her demise, everything has turned left for us - her children. We were deserted and left to fend for ourselves by our uncles, aunties, and other relatives that we thought were with us when my mum was alive. My dad is still alive but he only pretends to care about us. I can't even remember the last time he has done something good for any of us. Our school fees, food, everything, were taken care of by my mum.

There is a 50-year-old man who we were later told is our distant relative. His house is a stone's throw away from our house. When I was at home, I used to run errands for him, like going to the market to buy things for him. So it was normal. He used this same method on my sister. He took advantage of my sister's naivety and impregnated her. She's barely 16 and I swear to God, she has not known any man until this bastard did this to her. He even ran away from home and plan to come back when tensions are low.

Note: we left her in the village with my dad and my brother. We, the elderly ones left the village to hustle in the city. We have not settled and we couldn't afford to take them with us.

Please I need your advice. What should be our next line of action? He's 50 and won't marry my sister. There is also a high tendency that he won't even take care of her and the baby.

Please what should we do? We are all we've got and nobody to turn to to help us fight this battle. What should we do?

Thank you.

How many months old?

If you have the time,. Do anything to get her an abortion.

Thank me later. That's the best you can do now.

No one should be made to have a child from a rape.

I'll recommend an abortion at this point but first things first, file statement at the police station so when ever the man comes back, he'd be arrested.

I think the hospital can grant a doctor's report on the pregnancy, age of the embryo and the abortion so it can also be put in file for the police.
I object to that word abortion. What about she die...at de pross that if she 16..not above her age

I'd support an abortion. She's too young for the stress and even if she were to keep it she might not be able to deliver normally and would have to undergo C's.

That's too much for a 15 year old.

Here's

While the Law didn’t expressly provide that the age of consent in Nigeria is 18, the gamut and purport of section 31 of the Child's Rights Act implies that "the age of eighteen years" is a benchmark that could determine the difference between an adult and a child.

Thus, if "the age of eighteen years" is mentioned, the age of 18 is a determinant of whether anyone can or cannot give their consent to have sex. Some might argue on the premise of the Law, over the lack of clear statement, but the same Child's Rights Act provides that the minimum age for marriage to be 18.

What I quoted for you is from a current valid court judgment:

Justice Jane Inyang sentenced Yunusa to five years in prison for count 2, seven years in prison for count 3,4 and 5 respectively, noting that the prison terms are to be served consecutively.

The charges against Yunusa read: “That you, Yunusa Dahiru, a male, resident in Opolo-Eipie area of Yenagoa in Bayelsa State, conspired with the duo of Dankano Mohammed and Mallam Alhassan, between August 2015 and February 2016, to commit an offence of abduction and thereby committed offence punishable under section 27(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count two: “That you, Yunusa Dahiru, abducted Ese Oruru by means of coercion, transported and harboured her in Kano State and thereby committed an offence punishable under section 13(2)(b) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count three: “That you, Yunusa Dahiru induced Ese Oruru by the use of deception and coercion to go [/b]with you from Yenagoa to Kano State with the intent that she be forced or seduced into illicit intercourse and thereby committed an offence punishable under section 15(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count four:
“That you, Yunusa Dahiru, procured Ese Oruru and subjected her to sexual exploitation in Kano State and thereby committed an offence punishable under section 16(1) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count five: “That you, Yinusa Dahiru, had unlawful carnal knowledge of Ese Oruru without her consent and thereby committed an offence contrary to section 357 of the criminal code Act and punishable under section 358 of the Criminal code ACT, Cap. C.38 laws of the Federation of Nigeria, 2004.”

No court in Nigeria relies on the child rights act!
Here

As of 2016, the Child Rights Act was codified into law in 24 of Nigeria's 36 states,[5] with Enugu being the most recent to enact the law in December 2016.

In order to enforce Act, The National Child Rights Implementation Committee was created. Committees were also established for some of the states which have ratified the act.[2] The committee listed five top priorities for addressing the needs of children: establishing safe water supply and sanitation, working on the HIV/AIDs epidemic, creating job opportunities for women so they are better able to take care of the children, providing universal basic education, and making the primary health care system better.[2] A 2010 report notes that the capacity for monitoring and sufficiently implementing the act is low.[2]

Another way in which the Child Rights Act proves difficult to enforce is because it contradicts other national laws. Even though the Child Rights Acts defines a child as anyone under eighteen years old, this conflicts with another Nigerian Law, the Young Person's Act, which designates a child as an individual below the age of fourteen. In contrast, The Young Person's Acts deems individuals ages fourteen to seventeen "young people".[6][7] The definitions created by these two separate laws are in tension with each other and pose issues in matters of interpretation. Although the provisions within the Child Rights Act should be seen as overruling any other law, the fact that the Child Rights Act is not ratified in all Nigerian States makes it difficult.[7]

So as long as the rape happened in a state that has signed on to the Act, and then it is considered rape.. undecided
Re: A 50-year-old Man Impregnated My 16-year-old Sister. by laiza(m): 3:06pm On Sep 11, 2021
First thing you need is a good lawyer. Next, report the case to the nearest police station.
Now you have to find out what actually happened because rape is very hard to prove. Secondly are you 100% sure there is no consent? He could take advantage of her naivety but it maybe a moral wrong and not necessarily a crime.

Thirdly what does your sister do? I mean is she schooling, working, apprenticeship etc. And does she have everything she needs at her age to live a "normal" life, not necessarily comfortable but normal.

It's a sad thing she is pregnant and he is awol...if he raped her he will still answer for his crimes, I'm not sure rape has a statutory period. But most importantly she's way too young and naive to understand the repercussions of abortion. Please don't let her abort the pregnancy but you also have a lot of work to do in the areas of support and be her pillar.

I'm sad. This is very bad.

Please report to the police and milk out anything you can from the man.
This is indisputably a full rape case. No 2 ways about it

The man must not go unpunished.
As for the girl, I think the best thing you can do for her right now is to terminate the pregnancy. No girl that young should be made to go through the process of having a baby. It's too much

But please, let the man pay for his crimes

Whatever you do, please don't kill that baby.

I know it's a rough patch in her life and yours too but it has happened and Nigeria is a funny place where if you tell the police, they may end up arresting you.

I'm not saying don't report the crime, by all means, do, but what I'm saying is don't put much hope in the outcome.

She can't marry the man. She shouldn't. What life would she have living with her abuser and rapist?

It's going to be tough before it gets better, but it WILL get better, I assure you.

I sure hope your hustles pay off and you'll be able to take care of your siblings.

Getting him arrested or fighting him won't solve anything rather you will spend the little you have on police. Focus on your sister's future and that of her baby. If the pregnancy is still young and you people can not afford to take care of the baby when it's born, then abort it now. I am pro life but in this case, even God will understand.
