@Bolded If he hadn't withdrew his application, I would have said he stood a good chance. On the same day he withdrew his appeal to make a fresh application, he didn't have no section 3C leave. As of 2014, one had 28 days to make another application despite it's an out of time application.

Even though he won JR (quashing a decision), I don't know if section 3C will apply/be extended. This you will have to double check. You can also read it up
https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/953205/3C-3D-leave-v10.0ext.pdf

Voluntarily leaving the country within 2 weeks (max is 28 days) according to the immigration rules may help his case. Just make sure his attaches his IS.101 form, Voluntary departure letter, the appeal numbers etc.

Also, explain this in details with a cover letter in next application as some CWs don't look up ones immigration history.

All the best to your friend

I’d like to send you an email

Thank you @ Bourne007,

I am glad you said my friend have a realistic chance of success.

Yes the application he made when he has section 3c doesn’t help his case, that is why he withdrew the section 3c. Besides at that time a lot of rules where changed, where the courts were not allowed to look into my friend article 8 case if he hadn’t place this article 8 before the Home Office for consideration. That’s why he have to withdraw the 3c application and put a fresh human right claim.

All the same, during the process of Judicial Review after it was successful and a new decision was made by the Home Office, a removal direction was set against my friend, though not served on him, it was when he challenged the new decision, was when he realized that a removal direction was set against him BUT THE REMOVAL DIRECTION WAS DEFERRED BY THE HOME OFFICE themselves, when they realized he was challenging the new decision and it was never issued to him till he left the UK voluntarily. The deferred removal direction was sent to his legal representative, which forwarded it to him. He has the copy to present.

Thirdly, when he was going out of UK, he was never given a voluntarily departure letter. In fact at the airport they just check his passport by the immigration officer and allow him to go freely. No document was given to my friend and no stamp given on the passport but there a an electronic record with them in which the immigration officer used to allow my friend to go.

In addition, my friend have his return ticket to proof his case that he returned and a stamp on the Nigerian passport he used to return back to Nigeria, which was stamped by the Nigeria Immigration Services.

All the same thank you for this. Really grateful.

Kudos to everyone giving out one information or the other. I have been a silent follower. I would like to know if anyone is awaiting admission offer or already gotten cas for the Nursing pre registration yet for January 2022. I did an interview with university of bedfordshire exactly 2weeks ago and I still haven’t heard from them if the interview was successful or not and I am becoming to get really worried. Does it take such long time to get a feedback after an interview? Or does it mean mine wasn’t successful? Is anyone in same shoes? I will appreciate a response please.

Yes, I applied from outside Nigeria and used my Nigerian bank account (Wema bank) for POF, since one can not generate a stamped statement of account from their app (Alat), I had an insider who helped me with it, it was stamped and signed then scanned and sent to me. I used it to get my CAS and also for my visa application as I also did upload a copy of my proof of legal residency of the Country I was in......I got my visa, now in the UK.

Nah not at all my dear, my wife's flatmate had a similar issue and there was no hitch whatsoever. Wish you the best of luck!

You should have seen it through while you were working on a backup application. Like I said, I don't know if section 3C will apply or be extended after winning JR. This might easily come with a ban so don't get your hopes high. Maybe worth requesting his full immigration history ukvi holds about him.

https://www.gov.uk/government/publications/requests-for-personal-data-uk-visas-and-immigration/request-personal-information-held-by-uk-visas-and-immigration. Once he gets the details, he can then address them

Ideally he should have filled IS101 form so it's on record and they would have responded with a letter. Hopefully the return tickets will be enough proof.

You will not be allowed to drive in the UK with your Nigerian Driver's License at all. Hence the need for the International Driver's License. The International Driver's License allows you to drive in the UK for one year but at a higher Insurance rate(e.g if normal rate is 40 pounds, you will pay around 100 pounds).
You will need 2 passport photograph, your personal details, name of country where its to be used and 17k Naira. It may not cost that much in Lagos as I was given this information at the Licensing office of where I am domiciled and was informed that it will be sent to Lagos. And will be ready for collection in 1 week.

Thanks for this explanation
So from this, i deduce that its issued at the motor licensing office, and not by road safety.
For a country like usa that drives same Lhd as nigeria, do i still need intl drivers license?
