Children of nowaday. They don't get gut. Imagin you have started something and you are in the middle of the crisis and you are panic. which kind of children we are given birth to nowaday? if i were you, i would not fight the landlady in her apartment. I would just bait them to attack me in my apartment. How? i would forcefully unlock the well. Took away the key. I know the aggresive son will come for attack. I will now have reasons to beat hell out of him. As per court, no wahala, after all we are here to learn lessons. I HAVE CONQUERED ALL MY FEARS. |

NCE1:Bro you should had walked away the moment you were ordered to leave. Landlords or landladies do always have the upper hand when it comes to scuttle with tenants. I am a landlord myself so I know that the system favors us. Just pay the 50k and tread with caution next time. |

@OP NCE1. What charges are being brought against you? The answer to this is what would determine if you should be shouting you want to go to court. Secondly, get a legal representative or someone elderly to go with you to the police station and have a talk with the IPO and if possible the DPO. Go with other tenants in the house who would attest to the police that the landlady and her children are a thorn in the flesh of you all paying tenants. Hold small thing sha for police and watch them ridicule the woman and her claim. Don't wait to be reactionary, do this today or tomorrow unfailingly. |

There are things i can't do even if you hold gun to my head, i can't punch an elderly man talk more of biting a mother. And you even had the efontry to open the well after the fight. You went to do the house to ask why they locked the well, what guts ? To even open the well, why didn't your father build a house for you in school. Pls don't fall into their trap. Try to negotiate to pay lesser, maybe 30k and if they didn't agree just pay the 50k. Nigerian court is useless for case like this. With or without your lawyer they will grant you bail in any amount between 50k to 200k. You'll be reminded until you pay that money. Also, you'll still have to pay that landlady's 50k before the case can be withdrawn against you. Then again, you'll live in fear in the compound afterward, since you have a pending court case with them, which can drag over a year. Pls rush to negotiate with them and pay. |

Tell your parents to look for the #50k and pay the woman. Admit defect and move on.... REASONS You will be charge to court by the police. You will be remind at correctional facility for the next hearing by the judge You will have to get a lawyer to stand for you and perfect your bail You will be ask to look for a guarantor in like sum within the court jurisdiction as your bail condition And pending the perfection of your bail, you will be put in correctional facility And at the end of the day, you will spend mimo than the 50k... There are laws in this country and everyone including the tenant has a right to be treated with dignity. Everyone in this case uses the well, it's a common area. She never expressly conveyed to them the well was exclusive, instead she locked it up and tried to STRIP AND KILL HIM after she and her son attacked him. When they moved into the apartment did she expressly make it known the well was exclusive to her? See OP, tell the woman you want to go to court as a matter of fact, you drag her to court, so.she becomes the defendant. This is a case of criminal intimidation, assault on your person and attempted murder which could lead to a breach of peace! If your father by mistake pays her anything, she'd come shït in front of your house next! Wars are fought for peace! |

Pls don't follow advise of anyone that ask you to go to court. Dey don't understand how the court work for criminal issues like this, you'll regret it. You time will be wasted. You'll pay bail (50k upward) before you can be granted bail and still pay the woman's 50k bofore the case can be withdrawn. |

NCE1:Sad case. When you go to someone's house uninvited you are a trespasser until the home owner consents to your presence by welcoming you. However as soon as you are told to get off the property and you refuse, you become an intruder and the law permits the home owner to use reasonable force to remove you depending on the level of apprehension of threat that you pose. So as soon as you didn't get out when her son told you, you became an intruder. Secondly they attempted to use reasonable force to remove you from their Property. You fought back. You took a bite of your landlady's body. Lol. That's assault. 2nd strike. So these actions of yours are indictable crimes and you may be criminally liable. Jail term if it goes to court if you don't have a good lawyer to argue your defences thoroughly. What you should have done: Immediately you asked for the keys to the well and you were told to get out,you should have gone out and broken the padlock. As a tenant you have a right to uninterrupted use of the facilities of the property you leased as long as you are not in arrears of rent or your tenancy is still running. Any attempt to prevent your peaceable use of the common facilities that is available to the legal occupants of the property,you are within your right to take measures to ensure that your right to water is guaranteed. Even if she goes to the police or court,your landlady has no cause of action. Advice your fellow tenants to go break the padlock. If she assualts anyone,go and file a complaint in the station for assault against her. My advice. Settle out of court. Negotiate and pay the money. You don't have a good case. If you want to go to court. You will spend time and money on this matter,you will get frustrated. Good luck |
