Go to court na dem go tired.. first two seating do not go to court tell the court that you have class.
Third seating dont go tell the court you have serious malaria.
You will go for the fourth seating, next one you will tell the court you have test or exam.

Children of nowaday. They don't get gut. Imagin you have started something and you are in the middle of the crisis and you are panic.
which kind of children we are given birth to nowaday?
if i were you, i would not fight the landlady in her apartment. I would just bait them to attack me in my apartment. How?
i would forcefully unlock the well. Took away the key. I know the aggresive son will come for attack. I will now have reasons to beat hell out of him. As per court, no wahala, after all we are here to learn lessons.

I'm currently having issues in the place I stay, I am a student that rented an apartment close to school, and ever since this landlady and her children have been a thorn in my flesh and even other neighbors.

Let me narrate what happened.
I'm not a perfect grammar person and please read to the end.

In the place I stay, there's a well we fetch water from, so last week Sunday the well was locked up, which was very unusual... It was locked up from morning till night, nobody in the compound could access water.. I couldn't cook nor bath, so in the evening I decided to go ask the landlady why the well was locked and ask for the key so I can get water.

On getting to the landlady's place, I greeted her and asked calmly why the well was locked up, before I knew what was happening her son came out and told me to get out of there... I was very shocked and surprised, that I came to ask for the key to the well and he just tells me to walk out like that.

I told him I'm here to ask why the well was locked and collect the key, and that I cannot just walk out like that.

Before I knew what was happening, the boy started getting aggressive and he was threatening that he would kill me and was making all sort of threats, before I knew it... He attacked me, both the mom and the son with their last daughter.

They pushed me to the wall, which I sustained an injury at the back of my hand, the landlady was trying to get me naked by pulling the short I was wearing... I wore this short because I wanted to collect the key, fetch water and take my bathe.

So as she was trying to pull down my shorts and get me naked, I had to bite her a little so she could release her hand from my shorts.

The neighbors gathered because of the noise and saw the three of them against me.
Then I left there and went and open the well which they padlocked, then they came down and insisted that nobody would use the well.

It was then that someone told me the reason why they locked the well was because the son of the landlady had an issue with someone early in the morning while the both of them were fetching water and he locked up the well to deal with the person... Thus causing inconveniences for the remaining tenants.

The next day they(landlady and her son) went to the police to report the matter.

And they lied to the police that they locked up the well because the tenants were polluting the well.
Then they reported that I came to their house to attack them and I bite her.

Then the police came and took me and the neighbor that had disagreement with the son that resulted in them locking up the well.

We left the police station that same day and we went back in two days time for interview..
At the interview the police asked us to settle the matter amicably, but they proposed that they want to go to court and if we don't want to go to the court, that we'll have to pay the sum of 50k.

The 50k is for the money she used to treat herself, which is a lie. One of the neighbor in the compound overheard her making arrangements with a pharmacist to manipulate the bill of drugs she got.

And aside that, up till now they have refused to open the well for the whole compound to use, but they themselves are still using it, despite claiming that it was polluted.

Now my Daddy had to call her and beg and he told her to calm down that he would pay her 15k but she refused, that it's the 50k or we go to court.

Now my question is.

Was I wrong in the first place for going to ask of the key to the well that was locked up without proper information of why it was locked, and this well is the well we've been using since we packed in?

The second question is, if we go to the court now, what are the penalties I would have to face if I was wrong?

And finally, is it right for a Landlady to lock up the well that everyone uses because of an issue with one of the tenants?

Bro you should had walked away the moment you were ordered to leave. Landlords or landladies do always have the upper hand when it comes to scuttle with tenants. I am a landlord myself so I know that the system favors us. Just pay the 50k and tread with caution next time.

What charges are being brought against you? The answer to this is what would determine if you should be shouting you want to go to court.

Secondly, get a legal representative or someone elderly to go with you to the police station and have a talk with the IPO and if possible the DPO. Go with other tenants in the house who would attest to the police that the landlady and her children are a thorn in the flesh of you all paying tenants.

Hold small thing sha for police and watch them ridicule the woman and her claim.

Don't wait to be reactionary, do this today or tomorrow unfailingly.

My friend gather evidence and go to court. Video them while they are fetching from the wall. Get evidence from the pharmacist by engaging in talks to be secretly recorded.

where in Enugu? I’m in Enugu town and I can help in anyway I can with the legal side of things. She has no case against you. More so I assume they marketed the house to you that the have water (considering Enugu has water issues). Revert ASAP

There are things i can't do even if you hold gun to my head, i can't punch an elderly man talk more of biting a mother. And you even had the efontry to open the well after the fight.

Pls don't fall into their trap. Try to negotiate to pay lesser, maybe 30k and if they didn't agree just pay the 50k. Nigerian court is useless for case like this. With or without your lawyer they will grant you bail in any amount between 50k to 200k. You'll be reminded until you pay that money. Also, you'll still have to pay that landlady's 50k before the case can be withdrawn against you. Then again, you'll live in fear in the compound afterward, since you have a pending court case with them, which can drag over a year. Pls rush to negotiate with them and pay.

You were too dull son. You were supposed to go to the police station immediately it happened. In Nigeria ern, na who first reach station naim get case o. Especially when the person is older than you. They will get there and slander your name. Next time, make sure you go to the police station immediately a physical altercation occurs between you and someone else. Pele.

Tell your parents to look for the #50k and pay the woman.

Admit defect and move on....

REASONS

You will be charge to court by the police.

You will be remind at correctional facility for the next hearing by the judge

You will have to get a lawyer to stand for you and perfect your bail

You will be ask to look for a guarantor in like sum within the court jurisdiction as your bail condition

And pending the perfection of your bail, you will be put in correctional facility

And at the end of the day, you will spend mimo than the 50k...

So kindly sort for the money and pay her at once.

Listen, that you're a landlord doesn't make you all powerful. There are laws in this country and everyone including the tenant has a right to be treated with dignity.

Everyone in this case uses the well, it's a common area. She never expressly conveyed to them the well was exclusive, instead she locked it up and tried to STRIP AND KILL HIM after she and her son attacked him. When they moved into the apartment did she expressly make it known the well was exclusive to her?

See OP, tell the woman you want to go to court as a matter of fact, you drag her to court, so.she becomes the defendant. This is a case of criminal intimidation, assault on your person and attempted murder which could lead to a breach of peace!

If your father by mistake pays her anything, she'd come shït in front of your house next! Wars are fought for peace!

Before I knew what was happening, the boy started getting aggressive and he was threatening that he would kill me and was making all sort of threats, before I knew it... He attacked me, both the mom and the son with their last daughter.

They pushed me to the wall, which I sustained an injury at the back of my hand, the landlady was trying to get me naked by pulling the short I was wearing... I wore this short because I wanted to collect the key, fetch water and take my bathe.

So as she was trying to pull down my shorts and get me naked, I had to bite her a little so she could release her hand from my shorts.

The neighbors gathered because of the noise and saw the three of them against me.
Then I left there and went and open the well which they padlocked, then they came down and insisted that nobody would use the well.

It was then that someone told me the reason why they locked the well was because the son of the landlady had an issue with someone early in the morning while the both of them were fetching water and he locked up the well to deal with the person... You even opened the well after the fight. You had the gut to bite a mother in her own compound that your father has failed to own.

Everything about your narrative up there is completely wrong. You went to the house to ask y dey locked the well ? Are u d only tenants ?

Y didn't you ask d other tenants... So, dey just attacked you, you didn't say anything or even insulted the mother ?

Your dad can't even afford 50k but you can afford to bite someone's hand. Nobody will help you, better pay that money or risk going to court to pay fine or community service.

Pls don't follow advise of anyone that ask you to go to court. Dey don't understand how the court work for criminal issues like this, you'll regret it. You time will be wasted. You'll pay bail (50k upward) before you can be granted bail and still pay the woman's 50k bofore the case can be withdrawn.

Sad case.

When you go to someone's house uninvited you are a trespasser until the home owner consents to your presence by welcoming you. However as soon as you are told to get off the property and you refuse, you become an intruder and the law permits the home owner to use reasonable force to remove you depending on the level of apprehension of threat that you pose.
So as soon as you didn't get out when her son told you, you became an intruder.
Secondly they attempted to use reasonable force to remove you from their Property. You fought back. You took a bite of your landlady's body. Lol. That's assault. 2nd strike.
So these actions of yours are indictable crimes and you may be criminally liable. Jail term if it goes to court if you don't have a good lawyer to argue your defences thoroughly.

What you should have done:
Immediately you asked for the keys to the well and you were told to get out,you should have gone out and broken the padlock.
As a tenant you have a right to uninterrupted use of the facilities of the property you leased as long as you are not in arrears of rent or your tenancy is still running.

Any attempt to prevent your peaceable use of the common facilities that is available to the legal occupants of the property,you are within your right to take measures to ensure that your right to water is guaranteed. Even if she goes to the police or court,your landlady has no cause of action. Advice your fellow tenants to go break the padlock. If she assualts anyone,go and file a complaint in the station for assault against her.

My advice.
Settle out of court. Negotiate and pay the money. You don't have a good case.
If you want to go to court. You will spend time and money on this matter,you will get frustrated.
