Lagos state government should come out clearly and take a position on this rubbish residents have turned many neighborhoods into. Where I live in Lekki 1 I woke up one day and saw them constructing/mounting gates all over the place sometime in 2020. Then one day came I was headed home and was stopped by some men in blue who asked me where I was going to and the access code. I got annoyed and told them I knew nothing about this rubbish of a thing as this is even a public road and it was wrong to mount a gate on it. The man asked me to call a number if I was truly a resident and I told them if they didnt open the gate I'll leave the car there and walk away. Cars began to queue up due to my insistence and they let me in after insulting me and calling me names. I called the so-called association and they told me I had to pay 15k monthly for a sticker and they'll be sending access code weekly via sms. I told them that will never happen as I was never informed or a party to this non-sense. I and other residents of the rock drive became known for causing chaos at the gate thus they have been reluctantly letting me in. Many may argue that the CP was overzealous but I feel its about time the government takes a position on this nonsense where a few residents mount gates on public roads and begin to harass innocent citizens. On the rock drive there is a hospital (olive hospital) and you need access code to get into the street to get to the hospital. I have never seen a society like this. 8 Likes 3 Shares |

Krismas: Why was it wrong to have prevented the CP from entering the estate? What law justifies the actions of the CP? How does the secrecy of the DSS exempt from the rights of the police? What are those rights? |

The whole case has been faulted by the CP for not informing the nearest DPO of his coming,who is going to alert the estate security guards and Accord him the necessary respects. |

Another Useless Policeman spotted otional and even hypocritical over this issue because a police officer is involved. 1. The Commissioner of Police Odumosu didn't need to give advance information of his coming to the Estate security men because it would be stupid to for him state his movement. Of course, giving such information would require the CP's security details to secure the Estate gate security until he arrives. 2. On arrival at the Estate gate and having PROPERLY identified himself as CP of Lagos State, he ought to have been allowed in immediately. Keeping him at the gate is unnecessarily exposing him to possible attack by criminals. Even a military formation would know better than keep a properly identified CP exposed to danger at its entry point. 3. CP Odumosu didn't need to tell the Estate security men the exact house he was going to before being allowed in. That's a classified information until his details secures the house for his safety. 4. Deliberately tagging the CP's visit as social to denigrate him is pure IGNORANCE because even a 'common' DPO is always listening to his radio equipment and giving directives anywhere he is. The fact is that when not on official leave, a CP is at work everywhere and every time. 5. I doubt if the police singled out that widow for arrest for nothing. She may have jumped into the matter and said unsavoury things. Being a resident in an Estate, I am familiar with some 'radical' busybody residents that would jump into issues without complete knowledge. 6. The truth is this incident was avoidable if only the Estate security was more professional and less power-conscious. Their unprofessional attitude activated power-tussle mode in the OFFICIAL state police force to show their constitutional superiority. The irony in this drama is that when armed criminals show up at the Estate, it is the official state police men that are called in to risk their lives. 7. By the way, is an estate which has individually-owned houses a private property or a community? If Magodo Brooks is NOT owned and rented out by one person as its private owner, is there any difference between this Estate and for example Ajegunle in the eyes of the law? 8. Yes, Nigeria police has many outright criminals as members but it is still the only one we have to enforce law and order and maintain security.[/quote] |

tshtsh: Apartheid has no better meaning than a group of Nigerians building walls and gates to segregate those of low social status by preventing them from passing through residential roads. Let's face it, that was the practice in pre-1995 South Africa where a native South African needed a special invitation or permission of a Dutch or English South African to access certain parts of their own communities. There are so many similarities between the Southern and Western African apartheid systems because those who segregate have uninterrupted power supply, constant water supply and other basics of life that are luxury for those they segregate. Excuses may be made for the defunct South African constitution which omitted details of free movement but enshrined in the Constitution of Nigeria 1999, the grundnorm of our democracy, is the fundamental right to freedom of movement anywhere in Nigeria. Distinction must be made between a private property and a public property. No matter the unanimous decision and decree of all real property owners living in a location to foster security of their lives and properties, a pathway for driving or pedestrian use is not a private property and is free for use by everyone by virtue of their citizenship or residency in Nigeria. That Nigerians, most of whom live below the global poverty line , genuinely belief that the order of residents of an estate to prevent free movement is normal and superior to the constitution and other legislations is thought-provoking. festacman: Thank you. Even if he wasn't a police commissioner nobody has the right to deny anyone access the use of a public road. It is wrong. Even in private estates where a developer buys the land and gates it certain essential service providers like the police, fire services responders , ambulance/medics , PHCN workers... have every right to access without being questioned. People just believe living in a gated community is a form of status symbol and are now inconveniencing the public to satisfy their motives. LASG should come out clearly and take a position on this issue. The main roads in lekki phase 1 have become a traffic spot because the inner roads have all been converted to gated communities where only residents of the street can access meanwhile they are public roads 2 Likes |

The DSS work in secrecy, meaning sometimes u cannot wait to get full legal backings b4 u move. It cud lead people to challenge ur legality. DSS sometime go around with d police. The cp is always on duty 24/7. Again, an estate is a public property and not a government property... the estate property is owned by a small section of the public..., therefore its a public property and not government. All roads, street light, street, either in an estate or not belongs to the government. The roads in the estate, street, street light all belongs to the government. Again, the cp is always on official duty even at owambe... He was with his official car, official escorts yet its you who want to decide if he is on official visit or not. If not, how can one keep a CP of the state with his entourage waiting for even a second because u want to ascertain where he was going to in an estate. You dey mad!! We are not talking of DCO, DPO, ACP or DCP. We are talking of the CP. If na me, they for hearam hotter. As soon as some of these private security men wear their iniform, they will begin to equate themselves and rub shoulder with the police. They even call themselves uniform personnel. Am sure that they must have known that every uniform get level. As for that woman, she go don dey run mouth for matter wey no concern her without knowing she was talking to the most powerful CP in Nigeria. She go don learn her lesson too. DelTel: Story. He did not come to investigate yahoo boys or kidnappers. He came to enjoy himself at a party, and then refused to disclose whose house he was going to, hence the slight delay. But you know how Nigerians with power behave. He couldn't stand being questioned by 'mere' security guards, and had to abuse his power. Simple! |

So, Police can FORCEFULLY enter any PRIVATE property, at anytime but need a search warrant only when they want to search the property! The above then raises a simple question (assuming what you said was right) : What will be the purpose of such forceful entry (without Warrant) into a private property? Perhaps to view the beauty inside? FORCEFUL ENTRY into a private property only presupposes two things: to Search or to make an Arrest ...... and both things Need a WARRANT. I dont know how to explain to you guys anymore, l guess it has to do with your mindset of "once it is the Police, they are above the law" and in that mentality, l cant help you. All those statement about C/O shows you have no idea of what it looks like. Go and get one and read it! Infact, when it comes to Land, it is a valid "Proof of Ownership". BTW, Land use Charge is a form of tax, it does not take away from the Rights of a Land Owner |
