Then do whatever u want to do to him. If u give someone quit notice, won't u give him time to pack out? Even if the matter gets to court, they will tell u to give him 6 months for him to organize himself to pack out. Things are really hard. U may not know what he might be going tru.

Go to the court and sue him, liaise with the Bailiff to give you the paper to serve your tenant.

When the tenant goes out (when nobody is in the apartment) paste the court papers on his door holding the day's newspaper and snap it together with the court summon as evidence that he was served the court papers.

After snapping the court summon on his door post, remove it and keep in your house. The court process will go on without his knowledge and the Magistrates will be vexed that the tenant didn't show through the process and will definitely rule in your favour.

The Magistrate will send police to park him out, confiscate his properties, auction them and use the proceeds to pay you the rent he is owing you.


P.S Make sure nobody sees you while pasting and removing the court summon on his door post.

you should have give him notice earlier like 6 months to his expire rent, take for example his rent going to expire on july 30,you will give notice since January.,that how dey run it.

Get a lawyer to help you obtain quit notice from court. Explain everything to the lawyer so he can know how to legally make the tenant to pay the arrears.

We evicted two troublesome tenants within 1 year. Once they see the authentic quit notice from court, they knew their days are over.

According to the law, a yearly tenant is given 6 months quit notice. If it is 6 months tenant, it will be 3 months quit notice.

My brother, the law did not say anyone should live free in a property because of quit notice. The time frame of notice is PAID FOR. You did not state if he is a yearly or monthly tenant. This determines the duration of notice, which is supposed to be issued midterm his existing rent. In this case he is in arrears, Your lawyer should be demanding arrears as well as repossession. Even if a fresh notice is issued because maybe the initial one was defective, the duration would still be paid for. Don’t let anyone deceive you into thinking it is free. The only issue I see here is the guy packing out in the dead of the night and eloping with your money since he may not have much going for him. Lastly someone in arrears don’t get 6 months, I think it’s 1 month to pay and pack out, this played out in my estate.
