I haven't called my mother kindreds from my my mother side, still observing.. while we Left the meeting, my dad was cold all through..I know he must have narrated to some of his educated friends..let's see if he will take this to court.

This doesn't have nothing to do with me again, but with my mothers kindreds.

What about the kindreds from your father's side??

So I reported my father to the most senior man in my mother's kindreds, from her father side. I went there on Saturday evening and narrated everything to him...the first thing he said was


YOUR FATHER NOR FIT (in our native language)

He was so angry that he had to call another man and told him everything on the phone, I went back to my house..... and got a call Sunday afternoon to come back around, to my surprise I saw my father there with lots of extended family members and they gave him a stern warning not to try anything funny with those lands.

That our trybe don't sell family lands, house.. inherited property.. that what even gave him the right to think about doing something like that in law for that matter... while my mom has a son...they even said I as the son can't even sell those lands talkless my father.

They ask him, if it was financial issue that gave him that thinking, at first he wanted to deny about selling before he admitted it...my father is not poor, a retired nnpc staff receiving his pension steadily.....he just likes having a lot of money to spend anyhow.... and seeing those lands available he thought he could sell them... but the family proved him wrong and there's nothing he can do about it.

Seriously it isn't right or moral for your Dad to sell the land especially since he isn't even having financial difficulty. Your mother's people just Threatened him but didn't settle the case. But the fact remains that since your mum doesn't have any will that property belongs more to your father than to you in the eyes of the law

f this boy is a stepson there will be a 50/50 by the court if not his father remains the sole responsibility of those properties.

There is no sentiments in court. you don't come to court to cry or play victims game.

That boy got no right over his father in that properties unless and only unless his mother named him in the will or gave him power of attorney before dying.

The only thing that can change it is if your mother legally willed the property to you before her death. Did your mother write a will concerning the property? If yes, who does the will mention as the owner of the property? If no will, your father owns the property. I am not typing anyhow. I am educating you. But I am not forcing the knowledge on you. You have the right to reject the knowledge if you detest the knowledge.

Is it the hatred you have for your dad that made you not read meaning to what your maternal uncles meant?
Any property wey dey your mama side the only benefit you will get is to sell it or develop it if not it has no value to you, in the future those properties will be claimed by your maternal uncles and their kids or grandchildren because one day you go die and the rest na history.

Our major argument was about who between you and your father has more right over the property. You claimed you have more rights over the property. Now, your kindred does not support that claim of yours. Your kindred only condemned the idea of selling the property. And I myself also condemned the idea of selling the property.

For real, if the family still have a say in the mother's property, then the guy have more right to the property than the father....

The mother's family side sees the guy as one of there own coz he carries there relatives blood....

To answer your question, the op owns it according to the deceased’s custom and tradition ( you might want to argue but I’m letting you know now that there’s something called Customary laws) and what is left to be done now is for OP to set up a legal structure to back up the properties to avoid stories like this in the future. We’ve said this here countless times that you have no claim over inheritances that your spouse had acquired before marrying you. There’s no such thing as “according to the constitution “ but if you would still like to maintain your stance, then maybe you should provide/quote that particular section of Nigerian law that states that what you spouse owns before marriage automatically becomes yours in marriage. who owns what belongs to ur dad? Is it not u? I don't know why father and son will be fighting over family property unless one of them is irresponsible.

I'm glad u corrected ur,dad because as an inlaw he doesn't have much rights to ur mothers property when she is no more unlike u who is the son of ur mom.

Same thing applies to when a man leaves inheritance it belongs more to the children than the wife cos Inlaws can always remarry unlike children who are blood.

The dad is only a caretaker till the kids are ready. He is not the owner.

Good Your mum’s family stopped your dad from selling off the land.
African parents must understand that a rich parent must leave something for his offsprings at death.No child/descendants born of rich parents deserve to be poor/have a date with poverty in his entire life.
Properties should pass from one generation to another,it must never be sold but rented out.
Your mum laid a good foundation for you.May God bless her memory.

The poster said his mother alone owned and enjoyed the property. He also said the mother's relatives tried but failed to collect the property because the mother's father, before his own death, gave the property to the mother. So, what is your logic here?

If for instance the inherited property had been documented and perfected in the later woman's name and she was legally married to the ops father, under the law, the father has first right of claim to the properties.
That does not seem to be the case.

Which law are you talking about? Inherited properties and properties acquired before marriage are not considered marital property to be shared during divorce or automatically inherited by the other spouse in case of death.

Wrong, your assertion applies to a case of divorce or separation. Once a spouse is deceased intestate, his/her properties pre owned or not follows a particular order in inheritance; surviving spouse, children, parents, siblings down and so on. This succession act superceeds customary traditions. As for the Op, he will live to regret the day he went and drag back his maternal family into the circus.

Pls read that statement over again but this time, slowly. What was that supposed to mean. They were surprised that their blood (OP) was not even the one trying to sell the said properties but a complete stranger ( yes stranger, in this sense)
OP, make peace with your father and don’t gang up with these said maternal relatives against him. They don’t have your best interest at heart like you think but that doesn’t rule out the fact that your father was being irresponsible for trying to sell off what could be of benefit to his children and grandchildren. Never give your maternal relatives any room against your father!
