I am currently dating an American for 2 months now, she will be visiting me from the US twice this year and she will be visiting me in Nigeria next year as well. we plan on applying for the K1 visa in April or May 2023 from Nigeria. My questions are as follows ;

1) will my previous marriage(which I am currently in the process of divorce stop them from approving my K1 visa) considering the divorce will be official in November 2022 and I started talking to my girl in August ?
2) are they going to find it fishy that I was still legally married when I started dating my American girlfriend?
3) is 8 months of dating my girl and 3 times of meeting each other(2 in Sweden and 1 in Nigeria)good enough to file for a k1 visa ?
4) What is the current processing time to get an approval for a k1 visa as of 2022 ?

1. If you’re not properly divorced before filing K1 it will have negative effect on your application and can cause outright denial but if you’re officially divorced and submit your divorce papers alongside your application then your previous marriage will never have any effect on your chances of getting approved.

2. There’s nothing fishy in having a relationship with someone else after parting ways with your spouse and when you’re still struggling with completing a divorce process, sometimes to get your ex spouse to sign off his/her own part of the divorce papers could take years while you live apart. So I think you should be prepared to answer questions on that at the interview stage, if at all you will be asked.

3. How long you’ve been together is not a primary requirement but you must have met in person within the last two years so the 8 months is good and those planned visits will really make sense.

4. The last time I saw current processing time for approval it was 13.5 months I don’t know as of today as USCIS updates their processing time every month.

1. when u have the divorce certificate at hand u can start the k1 process ( reason being if u r sending ur I-129f u have to write a letter you both (intend to marry)stating r u free to marry within 90 days of ur arrival so as it’s nw u r still married

My question is if she will have to go back to Nigeria for her Interview or she can have her interview done at the consulate in Toronto. ? Just want to make sure its possible before going ahead as her Student status is still active till end of 2023.

As long as she has a legal residency in canada, she can have her interview there. You can also try and visit her before her interview. Good luck

Patience Patience Patience is the keyword for USA immigration process. We are all in it so i understand the frustration you feel. Mine is CR1 so i will allow airboy and others who have done fiancee viss tell you want you need to do.

u may likely hear 4rm NVC this week or next have u try to call NVC

If she will be out of status end 2023 let her put Nigeria if ur case move faster to NVC u r can change ur interview center to Canada

You have to be extremely patient, sometimes it takes months for this interview dates thing to be available.
At this stage you need not to worry yourself about dates because it will come, just keep checking from time to time. No one has information on when embassy releases dates but I guess sometimes this year.

None that I know of but people share updates when dates are available. You could also be the first to see dates so endeavor to share here coz ppl are waiting.

Best times are mornings or afternoons and sometime nights. It will open either weekdays & weekends.

OK guys, i have been following up this thread for some time before I went for my interview yesterday being 13th Sept.

Actually my K1 visa was refused, but no slip was given to me, i don't know what it means, it is only my passport that was given back to me, the CO said he will write to uscic or fiancee and blah blah , that was all.

INTERVIEW WENT THIS WAY ;

After swearing an oath, CO asked...

Who is petitioned for me?

How did we meet?

Who is the mutual friend to her?

Who is the mutual friend to me?

When was the first time i met with my fiancee?

When did we start communicating?

Issue rose up when i told him how we started dating and communicating, he felt maybe my story was mumbo jumbo but it was real, upon I told him she has visilted Naija and blah blah, he told me my story wasn't making sense to him, he also asked if she was divorced, I told him 2 times , he requested for the certificate which I told him I have only 1 with me here but the other 1 divorce certificate was sent by my fiancee via USCIS, i gave him the one i had with me, the he returned it to me...He also asked the first time she came to US and how did she immigrate which I told him, as the interview was going on he was typing something on the system for long....Eventually, he told me that he isn't convinced if I have a bonafide relationship with my fiancee, that he will be refusing me K1 visa but he will write to either my fiancee or USCiS people, i can't remember which one again. He returned my passport, though he didn't check my proofs (call logs, chats and photographs) and he didn't give me any blue or white paper.

I am confused guys, does it mean my K1 visa was outrightly denied though he said "refused"....

Does it mean my case might go under Administrative processing or should i wait on what message they will send to my petitioner so that we can know our fate.

What is paining me right now, everything about me and my fiancee is genuine and legitimate..no fraud or fake thing, and we have waited for so long, invested a lot of energy, money , time and other resources, we were just waiting to hear the good news from CO but dude was kinda brutal, he denied almost half of K1 applicants that came for interview that day..we were 12 though but 4 people were denied before i left there, though some people were given or approved.

PS: Before you go for your K1 interview, make sure you know every detail about your relationship and your fiance/fiancee.
Be bold and confident, be consistent with what you are telling the CO...prepare your story well, don't allow any loophole or any form of discrepancy.

Pls guys, with your experience or anybody working with US embassy or CO, do i have hope in this matter? If eventually it doesn't work out, what's the time duration for CR1 category? How long does it take? Is there any way I can fastrack it. I am tired of staying along in Naija, I can't wait to join my woman, this is not issue of leaving naija for greener pasture, God has been faithful to me in naija too but there is nothing like staying close with the love of your life, this can be so frustrating.

I hope one or two Nairlanders will learn from my experience. I wish all the guys going for their K1 interview or preparing for it all the best of luck.
