[ 4TH RESPONDENT CROSS-EXAMINATION ]

Q. can you summarize the message of relevance in the drive that was played.

A. In summary, INEC and it's officials decided to use technology for the elections.

Q. Out of that deployment of technology will include use of bvas exclusively for accreditation of voters?

A. In my understanding.

Q. Before 2023 election, you had observed election, you knew how accreditation was done. Bvas not used in 2019.

A. Yes, in 2019. Bvas was not used.

Q. Bvas was an innovation in 2023 election?

A. I think so.

Q. Will I be right to say you're familiar with INEC regulations and guidelines ?

A. I'm not totally familiar.

Q. From the flash that you played, we heard the chairman of INEC indicating that for the purpose of carry public along, copies of completed Forms EC8As will be snapped and uploaded on the IREV protal is that correct?

A. Yes

Q. That was about 17th January, referring to paragraph 12 of your statement?

A. Yes

Q. Between 17 January and 25 February, your station and other media houses had regular interface with INEC?

A. I believe so, but my duty is not editorial but technical.

Q. Content on Arise TV, you also get to view them either live or afterwards in a recorded version?

A. Yes, as much as I can

Q. After 17 January, did you by an chance happen to know that a Federal High Court in Abuja..

Another fumbling.how will you analyze unit results without analysing ward and lga results to see if it adds up?

When you have 18,800+ blurred PU results, how can you analyze ward, LGA, State, Federal accurately. It is a bottom up approach and not top down

Ikwueto SAN:
the witness came for a specific purpose to produce video and they are asking him about what High Court did. He came to produce, tender and play in open court the recording of Mahmoud Conference in Chatham House by the Subpoena.

The Court:
Evidence act allows them not to remain on the basis of coming.

Ikwueto SAN:
My Lord, but it must be based on the facts.

The Court:
you'd have allowed him to land on the question, he had not finish asking the question, he only mentioned federal High Court Judgment.

The PU result is the key result that will feed other.

If you add all the PU result in the country it will tell you who won

If you group of by states you will know who won per state.

If you group it by LG by region etc you will also see the winner.

So the prof is focusing on the root which is PU result.

True.unfortunately he focused only on irev without cross checking with the other copies to get a true picture.
Secondly, after finishing from the units,he should have done it ward by ward to see what he will get.
Finally, the only significant change he saw was that 18,000 copies from irev was blurred.he admitted that the other copies might not be blurred.he also admitted that all other states results were consistent except rivers and benue which obi probably won

A sensible expert would have cross checked those 18000 irev copies with inec and lp own.at least collating upwards will give him something which shows obi winning maybe

Oga,he said collation system not collection.he has fumbled

Definitions of collation. assembling in proper numerical or logical sequence. type of: aggregation, assembling, collecting, collection. the act of gathering something together. careful examination and comparison to note points of disagreement.

The use of BVAS to gather PUs result across the federation is that one not collation according to above dictionary definition of collation

Lol. The respondents would've wished he was. One even mentioned (sampling error). For this exercise, no mathematical method required, just basic arithmetic knowledge the Lordships kids can do. Anyway, let's leave interpretation to the court.

Sorry sir,in court, every examination or investigation must be cartied out by experts.this is a settled law.it is not basic and not just anybody will be accepted.see evidence act 2011

In court but not yet demonstrated or shown so it is useless.secondly, tribunal doesn't send people to prison sir.you see that you know little about electoral issues, leave it for us that are pros

By saying irev is a collation system?
Of course IREV is a collation system, according to section 64 sub 4 of the 2022 electoral act, the result sheet form EC8A must be transmitted directly from the polling unit. When the presiding officer presents the result sheet at the collation centre, the ward collation officer must check the result on IREV and confirm that what is on IREV is the same with the physical copy that has been submitted by the presiding officer, it's clearly written in the electoral act. So if images are blurred or what is uploaded is different from what is on the physical form. Then there is a problem. So IREV is not used for collation, form EC8A is the primary source of election results, but the IREV is clearly part. of the collation system. In fact the law clearly states that where there is a discrepancy the ward collation officer will rely on what was uploaded. Read section 64 of the electoral act carefully.

Q. In your report, you analyzed Forms EC8As on the IREV, nowhere did you allude to what was on EC8Bs and EC8Cs
A. Once it's wrong at the polling unit level, it will be wrong up, so the most important form to analyze is Form EC8A

The prof delivered fatality to the 4th respondent.

Manhood no gree post result from the polling unit which was stated clearly on the 2022 electoral act.

Result of form EC8A aught to be posted in real time, rather he decided to select some and allocated figures to balablu

He agreed that 18000 blurred copies on irev doesn't mean others are blurred which is crucial.
They will likely discountenanced his facts

Statiscian is an aspect of maths. He is a prof mathematics.

They wanted him to say he is statician so that they will say he made assumptions in his analysis.

If you noticed, the court also asked him question around the word random and he was specific in his response. He picked the state to analyse randomly but used exact data.

Data used were real and exact data not sample data like a statistian could do.

This is the Tribune Newspaper of 23rd February 2023.
INEC RIGHTLY noted that RAW FIGURES won't be transmitted of election results
.

PLEASE DOES IT MEAN INEC SAID THEY WILL NOT TRANSMIT PICTURES OF ELECTION RESULTS DIRECTLY FROM POLLING UNIT?

UPDATED;!

HERE'S A LINK TO THE FULL TEXT ;

https://tribuneonlineng.com/we-wont-transmit-raw-figures-of-election-results-inec-chairman/#:~:text=Infact%2C%20the%20law%20does%20not,a%20long%20period%20of%20time

Going through the content of the news, you will get that it's written that the results won't be transmitted in RAW figures like [ APC 23 ,LP 45 ,PDP 53] from the polling unit, not the nonsense their legal team are trying to claim in court
INEC just succeeded in scoring an own goal.

In summary about the content of the news ;

INEC said they wouldn't transmit raw figures like Kenya did in 2015, but they would upload result images [form EC8A] to a portal.

"RAW FIGURES" here means just the number of votes.
For instance,in a polling unit,LP got total of 23 votes,APC got total of 34 votes ,PDP got total of 75 votes etc.
INEC claimed the results won't be transmitted by those "raw figures " like, transmitting only the number of votes each party got,but rather everything would be captured as an image [from form EC8A] and uploaded in real time.
