@justwanjapa, did you present a divorce certificate for the previous guy? In the eye of the US consulate, you were married to your boyfriend without divorcing him.

So if I present a divorce certificate from the former guy, it will be resolved?
How long do you think it will take to have it resolved?

Divorce cert of a marriage that never happened? She may need a waiver or enjoy her marriage in Nigeria.

There’s no waiver for things like this, she must get a divorce certificate, appeal the case, then resolve the denial because she applied as married in her previous application.

Go to the right thread, people that have similar problems will advice you on what to do and how they resolved it you are not the first to make such mistake just go through the process.

You can't get a divorce cert for a wedding that never happened! Maybe in Nigeria you can.

This thread has been very helpful. Kudos to all the great minds here offering advice and helpful responses. Guys like InvestorTeeMan, Airboy333, aestake and all the others, you guys are the absolute best.

My fiancee and I are just about to embark on this K1 journey. We just filled the I-129 form and currently gathering the other required items for filing. But we're wondering if it's okay if I send a scanned signed copy of the letter of intent to marry, or if I have to dhl an original signed copy?

Secondly, there's no reference to beneficiary's passport in the form, my fiancee is wondering whether we also need to send a copy of my passport's data page.

(letter of intent)scan and send it ur passport is not a requirement ‘’but’’ if u like u can also scan and send it and save ur money … good luck on ur journey

Hello everyone, Its my first time here. My case is a bit complicated and I will appreciate your suggestions.
I had a child out of wed luck in 2016.
In 2019 I applied for a students visa. Scared that I will be denied for being single, I chose "Common Law Marriage" and added my boyfriend's name as a spouse (I know, Big Mistake). The visa got denied, we broke up, I forgot all about it. The child was not added on this application.

Fast forward 2020, I got married to an American Citizen here in Nigeria and he filed an I-130 for me. We went through the NVC process for myself as the wife of a USC and my child as the stepchild of a USC. Everything was approved and we were scheduled for an interview this month. When we got there, the officer was nice and friendly and I gave all my documents. She looked at it and then all of a sudden, sent me to another officer.

The new person I was sent to started asking me questions about my former spouse and that was when I remembered. (I know, so stupid) I said we were engaged to be married but it didn't work out. So he went inside and came out with the white paper stating that my application has been refused under 221g. The agent then told me to tell my husband to call Immigration in the US to get this resolved. My husband has called immigration but they said they haven't received any communication from Lagos regarding our case.

My question now is.

Is it possible to get this resolved?
How long is this process of resolving this going to take?
Should I just forget about this and relocate to another country and try to get to the US from there?

I'm just so confused, sad and depressed.

You really made a big mistake. It is called misrepresentation in US law. Did they tell you that they denied your visa or revoked it? What they will do is to send your application back to uscis. It usually take 6 to 12 months for them to send it back. Your husband will get mail in regards to it. Sorry about the whole issue. It is a long wait. Of course you guys can appeal but i will advice you guys to get immigration lawyer to help you resolve it.

Don't complicate your issue. Getting a divorce paper that you never married in the first place is an issue itself. Once your husband get a response from uscis your lawyer will tell you what to do. They know now that you never married in the first place.

Be careful of these lawyers some of them don’t know how to get to the root cause and offer the best remedy they will just take your money for things you can do yourself if you use the right tools and do a lot of research. The free immigration advice people give here and some other platforms are even better than getting a lawyer sometimes, we’ve seen cases where lawyers complicate a very easy case and cases where it was handled appropriately, not all lawyers know about immigration issues like this and not all immigration lawyers know how to deal with embassies and uscis So be careful!!
I’m still very sure if you do your research, go to the right platforms, post your case there don’t be ashamed and don’t cover up, people that have had similar issues and experience will advice you exactly what to do and you wouldn’t have to pay a lawyer but if you have some money to spend you can go ahead, all I know is your case has a solution.

Firdt of all i'm not the person involved in the case. I only suggest what she or she can do. Secondly i agree with your point that there are some attorney who can complicate issues for someone but there are still some who are expert in cases like this. Thry deal with immigration fraud matters and there are many on youtube. Better still the person involved can post the matter on visa journey. They have experts there who can advice ger3on what to do but from similar cases i have read there, thry always advice you get an immigration attorney who can careful look into thr case and suggest a way out.

And then still display READY-Your case is ready for interview at the embassy?

2. If no AP or Errors and everything goes well from the interview day, it may take two weeks or 10 working days to issue the visa or less.

Second I don’t have an original copy of my birth certificate due to some incident in the past but I have a copy of it I had been using and it somehow looks like the original one but I have to to NPC to get an attestation of birth but the thing is I was born in 1992. Will that be accepted along with the copy of my birth certificate on the interview day?

Since you didn’t t appear for the interview and do the finger print thing, it is not a red flag even though the informations does not tally with your K1, just tell the VO the same story if you are asked which I doubt, but above all you will be good. You can do the attestation of birth and still include a copy of your birth certificate since the attestation is for ppl before and certificate is for ppl after. I don’t think you need the attestation though.

Last year, my fiancé and I applied for a fiancé visa due to the unfortunate events in Ukraine, where I am currently in my final year of medical school, studying online. To make a long story short, we received approval from the USCIS in June, and just last week, we were informed that the NVC has forwarded my petition to the Consular in Lagos, Nigeria.

However, there's a significant challenge I am facing. Traveling to Nigeria is not a straightforward option for me because my current permit from the German government does not allow me to re-enter Germany. Additionally, our legal counsel has advised us that it might take an indefinite amount of time to retransfer the application to Germany. Frankly, I'm quite apprehensive about traveling to Nigeria at this moment, as I left the country years ago on a study visa to Ukraine, only to be faced with the turmoil caused by the war.

So, I am reaching out to you all with the following questions:

1. Would you recommend that I wait for the retransfer of the documents to Germany, even though it might take several months?

2. Alternatively, should I take the risk and go to Nigeria, putting my trust in God for the best outcome? I've heard various opinions and concerns regarding the Consular in Lagos.
