You got no much case with the buyer, na your brother you get case with. The only offence he buyers committed was buying stolen property without a receipt. Go look for that criminal and your ps3 brother! Na big case ooh!

MrOposter true true na person family na dey really dey do person.

You snap a picture of where you kept your key and showed your arm robber brother. He went and vandalise your solar system and sold it. Instead of you to look for your brother and arrest him, it's the innocent buyer you decided to arrest.

So you know that your brother is an arm robber and you still have him your house key to enter your house.

In essence, you people have been accommodating an arm robber who happened to be your brother without even feeling concerned that one day he will steal your properties.

I will tell you this, you deserved to be sued by the buyer.

Abeg go one side.

Let them produce the receipt else it's stolen. It's risky to buy electronics without a sale document.
And what if the brother forged a document and presented to them? A receipt doesn't always translate to ownership, come to Enugu old park and see big stores selling goods with fake receipt, they even allow third party to sell in their shop and share the gains.

Your brother did not burgle your home, you stated that you showed him where you kept the keys and he collected it. Remember you are heading to court and all your statements will be cross examined by professionals.

Even an irresponsible person, can't come near me. Once you are irresponsible, it means you can do anything and I can never trust such a person with my properties.

But heck no, it's brother, a high way robber. Why not give him your password to your bank account as the nice brother that he is to you.

From the comments, most Nigerians are coded criminals with awoof mentality. How do you buy solar components without requesting for receipt knowing fully well that they could be stolen items. Buyer should be arrested.

Oga, refund the money and sort your issues with your brother.
How are we not sure that you connived with your brother to harass and extort your neighbour’s family?

Your brother has access to your house and you trust him.
Go and refund the money.

It’s not like they bought it from a total stranger. They knew the house, the family and were probably there when it was installed. I think the brother deceived them into buying the panels. How wicked can someone be? What if he gave them fake receipts of the solar panels?

I think this family genuinely bought the solar panels believing whatever story the thieving rascal sold them cos if they knew his intentions, they wouldn’t listen to him knowing fully well that the rightful owner would discover the panels on their roof.

MrOposter

First things first, hiding your key outside of your home is totally wrong. Desist from such act.

Secondly, please release that woman from custody. The person who should be held in custody is your brother. That family is also a victim of your brother's heinous act. They deserve a full refund of what they paid and even an apology.

You should be able to retrieve all the items, but you should also be ready to refund all they expended in buying the stolen item. Be prepared to shoulder that cost since your brother is at large.

All the best!

You are absolutely wrong, sir. You think you are the only victim? Your brother sold it to them under the guise of being in dire need of cash. Such deals happen every day. The country is a mess. The only thing you can do that is sane and seems best is to refund them and retrieve your items. Deep down, you know your brother has gone AWOL and won't be found any time soon.

I'm not sure why people would rather he begged his way to recover his property which was sold without his consent.

He is using the law to recover his stolen goods. Those people should also use the law to recover their money. If I judged correctly, the OP isn't an emotional wimp but a logical fellow. He doesn't seem the sort interested in shielding anyone from blame.

since ur brother sold it to them, u should first hold ur brother responsible. Let us look at it this way, ur brother could have told them lies that u traveled out of the country and u were selling ur things or any other sweet lie that would have made them buy it and since he is related to u, it would have been hard for them not to believe the lie. Ur brother can't just steal from u and disappear and instead of finding the criminal u are more focused on retrieving ur panel at their own loss. When u find ur bro this case will be solved easily.
Let's say you bought a car, then it got stolen, and you luckily see someone using it. You confront the person, and in their defense, they claim they bought it from someone else. You still have all your papers intact. Will you have them arrested, or will you wait until they provide the person that sold it to them?

One thing I learned from this thread is that there are a lot of thieves on nairaland.

In this case it was not stolen it was collected and resold by a family member who had legal access to the property in question. If it were stolen do you think the sécond family will go ahead and mount it on their home knowing that the owner or a neighbour will see it. They would have sold it too and get another that will not be recognized.

This is my first of hearing of a stolen solar panel. Why? The coupling required to mount it on a roof is not something that can be disassembled with dragging attention of neighbours.

Mind you, you must prove it in court that the person that acquired the property is aware it was stolen and had intentions to deprive the original owner of using his property.

Please we should read well&ask questions and before carrying out justice on any case.
The Op never stated in his writeup that he gave the location of his key to his thieving brother, it was another of his brother he gave the location ,who later discovered that the house has been burgled and called the Op immediately.
Op was right to have confronted the buyers of the stolen item, but I would have settled amicably with them rather than involving the police, knowing fully well that my own relation sold the items (he could probably fake to be selling on my behalf).
But truth be told Op has every right to retrieve his properties so long he has the receipts of those items. It's win win for Op .
The other family will likely wait until the brother is caught to bear the consequences of his action by law and pay his debt.

the police will need to apprehend OP brother before OP will can exercise is right fully

If the buyer is a criminal, what makes you think OP and his lil are not criminals that conspired ... legal cases have multi angles

the buyer knows me as the owner and as a buyer I think you should also do your due diligence before accepting to pay for anything and moreover he hasn't finished paying for the Solar he paid 135,000 (PS3 console and 35k cash) and still have a balance of 115,000 to pay. He should have called me and made findings from me before accepting to pay that ridiculous amount
For a set up currently valued at 600k.

Better refund their money. That is what you should have done in the first place.

Not call police because you have money and lawyer.

Then when your brother is caught you deal with him.

For the whole family to be against you it means you did wrong. Infact very wrong.

I am sure when he was uninstalling it no one challenged him because they felt you are brothers. So he carried it and sold it for ps3.

Now you went and challenged the buyer knowing fully well, that your brother sold it.

What if he sold it to aboki people you will go to their dump to retrieve it. Dey play

Useless brother.

Why not bring your brother to testify but because you know your thief of a brother is a disgrace you shielded him

Na u supposed dey beg.
They will return it.
Using police force. We dey misuse police ooo

All this your epistle while holding a wrong position in the eyes of the law. Are you a buyer of stolen goods for you to be so driven by emotion on the matter?

Simple question:

1. Do those buyers of the Solar Panels, Batteries and Inverter have a receipt for the purchase? The answer is NO because they have not shown it. What they rely on his theclaim that his brother sold it to them but they have no evidence of proper sales and payment of even the amount they claim. It is their responsibility to look for the seller (that is the brother on the run) to backup their claim, not for the owner of the Panels to provide his brother.

2. Do they have sufficient reason to believe the brother who sold the Solar Panels to them has true Ownership of the property? Does he have a job to warrant earnings to buy the Solar Panels? Would a true owner of the Solar Panels worth over 400K exchange it for 35K and PS3? If they cannot show reason for Believe that he owns the Panels when they entered negotiations with him, then it means they are partners with him in the crime and guilty of theft. And that is likely the position because they are even unable to produce receipt of the sale.

The first thing Police will ask you for as proof of ownership of anything is the receipt. If you are unable to produce receipt or strong evidence of ownership, then forget about it.

Try to reason rather than supporting theft and stupidity. All the family of the purported buyer should be locked up!

You have lost your sanity bro. See what a lawless society has done to you. With reference to OP story, you sounded as if he gave his brother the consent to exchange 600k item for used PS4.

The owner of the PS4 saw awuf, ignoring that it could be a stolen item. So what do you expect the OP to do when the brother is at large. He doesn’t care about the brother in-fact he as well should face the law. He wants back his property! Please try have back your sanity cos this your reasoning go put you for problem for society wey things Dey work.

The best is to get your brother to Justice.

O.P u did well, that family that bought the solar panel deserved to be arrested
How can u buy something that you are sure it was stolen,or can they swear that the weren't aware that your brother stole the panel.
The price they bought that solar panel is it the price that it' is sold In the market?
Nigerians and their illegal shortcuts of doing business let them be at the police station till they bring your panel then any time they see your brother they can collect their money from him.
Just like buying a phone that was stolen cox it was sold cheap, when the owner tracks the phone to u,the phone must be returned then u will now demand for ur refund from the person that sold u the phone
