Good evening sir I had an interview for a fiancee visa few days ago and was denied based on the fact that we have carried out the traditional rites they said I should rather apply for a spouse visa please sir, my question is, can I qualify for the spouse visa with just the traditional marriage? we are yet to do the registry hence, we do not have any marriage certificate. we have the pictures and video for the traditional marriage. Is that enough evidence to show? and how long will the whole process take? thank you so much |

Hello vo, I was asked to go for DNA test in us embassy to prove me and my father relationship which I did but the DNA was negative. It has caused lot of trauma for me and my parent but he later said he will adopt me and he will apply for another one and told the embassy that he has adopt me. I was told that he is lying to me cause us embassy won't give me any visa type am now permanently ineligible. Pls I want to know is it true that am permanent ineligible for visa? |

Dear VO, am sure of what am saying, my wife's I-130 was revoked and the package sent back to NVC in USA here and ever since then I've been calling them and they kept telling me is under administrative processing. They never told me any reason why my wife's VISA was revoked and I've been married for over a year now, have not seen my wife, please kindly help advise on what to do, I want to know if I file for visitation just for her to come and visit me for a month if it can be granted. |

solacearinze: We are bound by Nigerian law as to what constitutes a marriage for an immigrant, as such, you are already married. This will qualify for a spouse visa. If USCIS determines that you need additional paperwork to support this you can always obtain an affadavit from the customary court. |

Marymary20: This is a complicated situation - you need to have a qualifying relationship in order to apply for a visa class. As an IR-2, you were applying as a biological child. Adopted children can immigrate, but it would have to be a legally binding adoption, with a home study conducted, and a variety of other requirements. You would also have to be under the age of 18. Unless you were told that you have a permanent ineligibility, then you are not permanently ineligible, but in any event you don't currently qualify for the IR-2 visa class because you do not have a biological relationship. |

Arnold4all: Once an intent to revoke has been submitted by the VOs, the file is returned to USCIS. They will review the case and contact you, but it is out of the hands of the Consulate at this point. |

Greetings of the day, I would be accompanying my wife as a derivative applicant for a visa filed under f4 category. I had previously applied for a student visa but was put on holdthen and never pursued the application since five years. There has been a difference in my age compared to my previous passport on file because of a mistake at the time of applying the previous passport which I did not get it corrected. But my present passport reflects my date of birth as per my birth certificate. How likely it will be that the variation will come up during the interview. Please guide with the possible scenarios and the remedies to follow. |

Do the VOs still allow a visa applicant the ability to prove hardship in the absence of a police certificate for another country. Nigerian citizen but would have to go back to China to get a police certificate. Tried using a proxy but was unsuccessful in obtaining the Chinese police certificate. Have evidence of trying to get the police certificate via the school of enrollment and using another student there but was very unsuccessful. |

nazn: They will look at the fact that you have applied previously with a different date of birth and they will ask you about it. You will explain. Additional evidence may be required because you failed to correct this error in a timely manner. |

LagosNIV: Less than one year, greater than six months. We have been very unsuccessful trying. Even with reciprocity, the applicant has to have it? If that is the case, then there is no point attending the interview. If it isn't available at the time of the interview, would the applicant be placed on AP to continue to try to get it? |

My fiance had an interview at The US Embassy in Islamabad on February 18 2016 and she forgot to bring our chat from Facebook and phone records and they said they needed a copy of my passport, a copy of my passport was already sent before the interview. Her us visa has not been approved yet and I sent them phone records and Facebook messages last week and my passport a few days ago and the status update is February 23 and is still undergoing necessary processing. I gave them everything they asked. Why is it taking this long to still process everything. Everything is true and nothing is false on any documents. Thank you James |

Pinej: Administrative process is required under U.S. law. I don't know what her circumstances are or how the Embassy in Islamabad is run. In order to comply with US laws though, they cannot issue the visa until administrative processing is complete. That being said, we generally advise that you wait at least 60 days before contacting the embassy about administrative processing. 1 Like |

Hi Visa Officer i have a pending immigrant f1 petition and have refused to get married in order not to change category i recently got my fiancee pregnant and like her to have her baby in the USA, is it possible to secure her visa without her being married. i will be responsible for her bills. thanks and please advice on the best route. |

Hello VO, I submitted my passport alongside the tax documents required to process my case on the same day I had my DNA sample collected. I didn't know at that time, that I was meant to wait for a response from the consulate before I drop my passport. But the officer at the drop off center looked at the automatically checked box for international passport on the document collection paper and told me to drop my passport as well, so I did. So here is where my worries became heightened. I checked on CAEC and my status which was updated 23 February says "Issued (your visa has been printed... )". But when I tried to track my passport on ustraveldocs, it says "there is no status update available for the passport no you submitted". In addition, I haven't heard a word from the consulate ever since I was scheduled for DNA sample collection, no email, phone call, nothing. I know I should mail them to get a status update, but I've been told it further delays the process and I dont want that. So please, any bit of information I can kindly get from you to alleviate my worries will be immensely appreciated. Thank you. |

Ellanaire: Sending an e-mail to the Consulate doesn't further delay your processing - in fact this is probably the best option in your case. I'm not able to provide specific information on your case but they will, just make sure you include all of your relevant information so that they can track down the case and provide a response. What does cause a delay is individuals who e-mail every day to ask about the status of their case when they have failed to provide documentation that the Consulate has asked for repeatedly. |
