Federal and state laws supercedes customary laws, and if the matter is taken to court, traditional law will be relegated to the background. Remember, an igbo lady went to court to claim part of her fathers inheritance her brothers denied her, against igbo traditional law.

If all you stated are correct, then you should take him to court and fight for your son's custody. That in their tradition when a woman with a child marries a man, the child takes up the man's last name has nothing to do with you having custody of your child. Those are two separate and distinct issues. As you said in your article, you have his birth certificate with your name as the father, receipts to show child support and pictures of him. Just keep paying the child support because the court would look at that as evidence that you had never abandoned him thus losing parental right. The law is on your side. Good luck!

Like i said before, if he has money and hopefully a good lawyer, he can win the case, but he needs to contend with the TALFORD ACT 1839 and THE CUSTODY OF INFANT ACT 1872, though All these pre-1900 statute recognized the right of either parents to the custody of legitimate child. No court in this world would grant custody of a 2 year old to the father, when the mother is not incapacitated or constitute a danger to the child. I am certain the OP meant he wants full rights and recognition as the father.
