Not true. Every body case is different. There are some that have been told to leave, overstay, banned for 10 years they still apply for visa and come out honest, apologize to ECO, make fresh application, the ECO still pardon and give visa. At first it might be refused but not impossible to get tourist visa again.

For the settlement visa u mentioned, he can only apply to settle in the UK if he gets married to either British citizen or a person that have indenfite leave to remain. (ILR). He will still have to come out honest again concerning his previous application. If he is in Nigeria making application for settlement visa just note that he can only apply for settlement visa 2ru spouse, fiancé and ancestry visa. More so there is age limit on one applying for some settlement visa from Nigeria (i.e if any of the parent are British and want to bring in a child, the child must not be more than 18years old) He can only make application in the UK if only he got married to British, ILR,have kids in UK, have stayed a long time in UK, that is where he can put application based on family life.

My advice to @Justblow is to admit some of the objections that the ECO raised. He should give himself one year before making another fresh application, travel to other countries and also make apologies for overstaying in the uk, I am sure by God's grace u will be granted visa& another opportunity to visit again.
There’s different between banned for 10years, overstayed and told to leave. Don’t mix it up

Banned is you submitted or used fake documents to gain entry into UK
Overstayed is you overstayed your visa
Told to leave is the person probably made application to stay in UK and refused or caught by immigration.

Told to leave might have something to do with deportation, people do make application to stay in UK and refused and told to leave, some will run away or get deported or the person will voluntarily leave UK

For such person to reapply for visit visa and be granted, his reason must be very strong genuine and relating to family.

@Justblow I wish you good luck in all, it’s a tough situation and never give up in everything you wish for, there’s always a solution.

Hello @justwise and to other gurus in the house
Am new here and I need your advise, I picked up my passport yesterday and i was refused based on the deposit of money received in my account May 2019 which was about #300,000 when my monthly Salary was 80k. Apart from the 300, 000 (200k and 100k received that month) My dad sent me #380k for travelling allowance which we backed up with a letter and I guess the ECO was convinced.
So the issue was #300,000 from an unknown source.
Kindly advise how I should re-apply and the necsasary info I need to address the refusal
I am planning on re -applying God willing
Thanks.
Attached is the letter I received

Re: General UK Visa Enquiries - Part 4 by giselle237: 10:34am On Aug 02, 2019
how much is your salary per month
... not a joint of all the incomes but your main salary is how much?
..... The monthly salary credits in your submitted bank statement is not in keeping with the 150k per month you declared (thats what the visa officer said).... I think lesser amount showed on your account...
infact the ECO SAID YOUR MONTHLY SALARY AND PAYSLIPS do not correspond
.... Secondly you said u spend 20k per month but from your application, I mean your documents submitted the visa officer says you spend MORE than this 20k that you wrote on your application form.... read that paragraph on your refusal letter slowly please

this was where confusion set in for your application ... and also pls ....... travel history/ban/visa refusal/deportation/overstaying gbo gbo ti gbo also play a role in UK visa decisions even though they will write we are judging this case on its merits bla bla bla.. thats just been political and diplomatic.
Justblow:

So my oga, from this, I am only entitled to a one year ban, I have evidence and I submitted all with my application. I will appreciate if anyone can give a possible suggestion to addressing the ECO blunder.

Thank you for your contribution, first I need to let you know that I was never removed from the UK, I left voluntarily which I know has its own ban duration. I will be making some attachments to this, so that you no that I did not just wake up and apply without first knowing the rules and moreover, the ECO judgment was based on the merit of this application as written clearly on the letter. If he had denied me based on my travel history, I can still contest it.
Re: General UK Visa Enquiries - Part 4 by giselle237: 10:49am On Aug 02, 2019
1. How much was your closing statement
2. How much did you write that you would be spending on this trip ?
3. What is the purpose of the trip and especially why the 18 days?

Thank you for your response.

The closing balance was #540,000
My Aunty is the one sponsoring me and she wrote 2,500 pounds. She sent me the invitation letter
The purpose of the trip is vacation and the 18 days was the number of days i was taking as leave at work.
Re: General UK Visa Enquiries - Part 4 by giselle237: 10:59am On Aug 02, 2019
Did your aunty give you her statement of account to show this 2500 pounds sitting comfortably with extra? What was the proof that this money is available for your immediate use at any time?
anyway your application was not well done.
You are an adult working and can not fund this holiday youself. The ECO is afraid you will become a nuisance and probably fall on the UK’s public funds.... they dont want that..
Even though you stated that your auntie will be sponsoring you, the visa officer would ALWAYS take into account your own financial circumstances in Nigeria here before allowing you to come to their country.
If ur closing balance is 540k and out of this was a lump sum of 300k my dear this is a problem.
also 18 days is alsoooo such a long duration for a vacation which you are not able to sponsor yourself without your auntie’s help...

Yes she did and we submitted her statement of account
So what do you advise when re applying and ways to address the lump sum of 300k. I was able to proof the lump sum my dad (380k) gave me and they has no issue with that.

I understand we failed to proof the source of fund for the 300k as that was an oversight.

I never mix up anything. Read my first paragraph well. There are pple with 10years ban, overstay their visa and still apply to get visiting visa. It is still very possible for any one that falls under that category to get visiting visa with a genuine reason. The person might be refused at first application but not impossible to get visiting visa. The only options is for person to distance making application for one or two years, come out clean and truth.

How could the ECO possibly tell he spent more than 20k in a month? Did the applicant contradict himself by stating somewhere in the application that he spent more than 20k in a month?

So annoying! Need to return to country of residence next week. Wasted so much money for using VI-VAC, premium lounge and "keep my passport". Couldn't apply where I live because the consulate there does not issue visas. Sigh!!

Going through this transcript now. I think the problem here isn't that the interviewer couldn't hear you but the responses given are inadequate.

Re: General UK Visa Enquiries - Part 4 by jennyhumphrey(f): 3:32pm On Aug 02, 2019
In the spirit of giving back let me announce my good news. I helped my mum apply for visit visa valid for 10 years. She paid more than 410,000 naira for the visa fee and paid extra 38,000 for premium lounge so i was really bothered because of the large sum involved. My mum is self-employed and has travelled to the UK more than 3 times and US too. The last UK visa expired in 2016 and the US expired in 2018 . I was really scared because she wasn't paying her self any salary at all because she is the sole signatory of the company accounts, also she doesn't have any tax clearance certificate.
I put a budget of 1.2 million for 3 weeks stay and stated she would travel with her husband who has a valid UK visa . the trip is to be partially sponsored by herself and husband).

Timeline (Standard): TLS Lagos Ikeja
22nd June: Submitted online application (document self-upload)
2nd July Biometrics
23rd July: Received email stating 'Application Concluded'
26th July: Passport ready for pickup
1st August Picked up passports with 10 years visa

These are the documents she submitted with the application:

1. Invitation Letter for her
2. included her past visas both UK and US
3. letter of sponsorship by husband, attached husband's valid UK visa and passport
4. CAC documents of her company,
5. her company 6 months bank statements, her personal 6months bank statement and her husband's bank statements.
6. documents of her landed property
7. some pictures of her children and grandchildren and
8. Cover letter

God bless you all for all the contributions. I am very thankful to God that our Money did not waste.

This is what i receiced today, can somebody please tell me what to do because i want to reapply

ECO did not complain about insufficient funds in my last application, i wonder why it was stated in this refusal letter

I also mention about receiving rent in my previous application and also submitted rent receipts and other documents as evidence.

I'm tired of these people.

seeyat I am so sorry about this your refusal especially how much you put into this application. It is obvious this ECO read your cover letter, saw your salary credits but is busy refusing you on grounds of how you were able to get your property.
I feel they just don’t want to give you at this time caus this refusal stems majorly from the last application. Leave them alone. Don’t reapply now. This is 2 strikes already. Give them a break say 1 year and then reapply.
For me don’t reapply to them now.

Keep the refusal notes close and give them a proper addressing especially of how you purchased your property in your next application.

U will bounce back better and stronger and in the next application. Just guve them time to show you are not desperate. If you go now while it’s still hot, u might not be successful.
You can get to vacation in other places whilst you are giving them time. This would help your narrative in the next application that you are truly a tourist seeking entry clearance.
Sorry once again
