The point is that the guy in question is an ingrate like my neighbor that will never appreciate any good thing one does for him if not so, he would have known that your family has tried for him and probably approach you people peacefully to explain what his problem is. In doing that, your family can at least collect like 6months out of the 10months he had lived already and then give him some more grace. My suggestion as it is now, is for you people to invite the police, a carpenter if the window is wooden and ensure he is there present. Then tell him you want to renovate the windows and the doors and let the renovation commence immediately. For those calling Igbo guys, "make una respect unaself" cos this life z about individual differences.

There is something I will give you, just make sure the man is indoor before you drop it at his entrance, Anybody that come out of that entrance even if is your mum just go and wait for her in river Niger and be fast because if there is no road to follow he might enter river Niger or Atlantic Ocean. But don't forget repentance won't stop you from going to hell. Lol

4.Buy a good padlock n lock them in/ out
5.pray cause the tenant might be using JAy Z on you

I remembered while looking for an apartment sometimes ago in lagos, most landlords always ask if I'm igbo. Guess what, they always don't want igbos in their houses. This could be one of the reasons.

The first thing to do is write a letter to NEPA and disconnect his light. Cut every wire leading into his flat since he is not paying for NEPA bill, if he is paying for NEPA bill, make him pay for all previous bills he has own, if he doesn't want to pay let NEPA to come cut the wire and threaten other tenants and neigbhours that who me ever gives him light will face the law. Also cut all waters leading into his apartment since he is not paying for light, since he is not paying for light, while should he be using water, where does he want the house have light for the house to pump water.
Then continue with the arbitration wahala and court wahala. In mine new house, I have stated it in mine agreement, if you don't pay for service charge, your light and water will be disconnected. Know free house for anybody, na money I use build house.Also Aguda na eras boys area now, give area boys money, them go use Cain beat am for you or the No one area boy go summon am, if him know come, the No one area boys go send him boys make them go bring am come, shey him dey craze when No 1 go dey talk to am and him go dey do rubbish. I bet you, in three months him to park. Whom want area boys wahala. Yesterday for mine area our No 1 order him boys make them go beat one NEPA guy when dey misbehave. The NEPA guy go bring police, them beat am in front on the police, slap am and pursue the police away. Such people you use a higher and mad force and see how this things will settle.

Dude, if your family want that tenant out now, take this advice. Start putting diabolical charms around the house, particularly in front of his apartment.
Do this consistently, and your tenant will teleport from your house.
This is the tactic I used to chase some idiots overstaying their notice on my property.

Na Igbo character be that which every landlord avoids them bro get the copy of the agreement they signed and get a lawyer and charge him and make sure the lawyer request for the total used rent with charging cost cos the agreement alone feet nail am.

The Mediation Centre sent him (the tenant) a letter giving him 7 days ultimatum to vacate the apartment. At the end of the 7 days, this man refused to leave. My family complained again to the Mediation Centre and they said they would look into it.

After another 3 months again by last November, 2019, this tenant refused to leave the apartment. My family went back again to the Lagos Mediation Centre and one of the officials there said "So, the man has not left the house since?". We responded yes. At the Mediation Centre there, they said something like they are incapacitated by the law to take any action.

This is December now going to an end. The tenant is still in the house. He has refused to vacate the apartment. It's about 10 months now living in our apartment without any payment. He has refused to leave.

The apartment is a 2 bedroom flat in Aguda Surulere, Lagos. The tenant's name is Mr Chigozie Okongwu James.

We don't want to take law into our hands as it seems there is no solution to the problem through the Lagos Mediation Centre. It's about 10 months now!

What can my family do to get the man ejected from the apartment? Your advice are welcomed.

The mediation center can't do anything to eject him than persuasion ,the best place is the rent tribunal they have the legal and constitutional power to eject him by force if he refuses to go after the expiration of the time given him

If the tenant attended the Mediation, then there ought to be a written agreement that he will vacate after the agreed date.

When he refused to vacate at the expiration of the date, all that is required is for the Mediation Centre to take the file to a High Court Judge who will make the agreement as Consent Judgement which therefore becomes enforceable.

It saves time when compared to a fresh suit in the Magistrate Court which will take more than a year in some cases.

May I advise against the advise of Most people telling you to resort to self help. You will regret it if you ever try to do such.

In all, speak to a Lawyer so that so you will be well guided

As you do all you do, like going to court or mediation or even initiating a renovation, remember to cry to God for justice and judgment every single day and night extra he stays in your house. Those prayers going up to God daily will never go unanswered. I speak from experience.

PLEASE DO NOT TAKE BOTH OF THIS ADVICE.

Like the Lagos Mediation Centre told you - under Nigerian Law, and particularly Lagos’s Tenancy - you cannot resort to Self-help. Even when you have served the statutory notices.

So it means YOU CANNOT FORCEFULLY EJECT HIM from your house or you risk being sued for unlawful ejection Yourself and having to pay for damages.

What yu can do is this.

INSTRUCT A LAWYER

If the value of the Rent is less than #10M, proceed to the Magistrate Court. You can institute an action for ejection and serve it on the Tenant.

If the Value of the Rent is above #10M, then you must proceed to the High Court immediately to the same as above.

Note: on both cases, you will normally take a Writ to enforce the judgment of the court on ejection. With that, the Sherrifs in the court will be the one to come eject him from your house themselves.

ANYWAY - that’s if you want to do it legally. Otumokpo, Ogun lakaaye or any traditional means may be a faster and cheaper means grin. Just kidding.

Your level of exposure in legal terms is quite amazing.

I celebrate your wisdom and intelligence.

This is the best legal advice so far. You've already served him with the 7 days notice, all that is required now is an order from the court for ejection. Get a lawyer to do the follow up. Copies of the agreement reached at the mediation center together with the 7days notice issued to him will be attached to the court process.

Landlords don't need money too, they're not also facing hardship abi? That there's hardship in the country is no reason for anybody to constitute nuisance in another person's property. Why can't the tenant cut his coat according to his size? If you can no longer afford a two bedroom flat in Surulere, then go and rent a self contain in Iyana ipaja. Why deliberately occupy an apartment without paying a kobo for almost a year? That's the height of wickedness imo.
