In doing that, your family can at least collect like 6months out of the 10months he had lived already and then give him some more grace. My suggestion as it is now, is for you people to invite the police, a carpenter if the window is wooden and ensure he is there present. First of all, did an Arbitrator mediate over the proceedings at the mediation centre? Secondly, was there an Arbitral Award? If there was an Arbitral Award then get a lawyer to institute proceedings in court to enforce the Arbitral Award.

If there is no Arbitral Award then get a lawyer to serve him the necessary notices (in this case a Seven Days' Notice of Owner's Intention to Recover Possession) and thereafter evict him from the premises through the Magistrate Court.

Please do not under any circumstance try to evict him forcefully from the premises. The Lagos State Landlord and Tenant Law provides for damages to be awarded to the Tenant in a situation where the Landlord evicts him forcefully. It used to be N250,000 in the 2011 Law, I'm not sure how much it is now.

Tell them you want to repair the house in 24hrs in a formal notice referencing the previous quit notices and rulings.

In the 24th hr, remove ALL the roofs and main doors at once.

Then take out the meter card if it is prepaid or disconnect the meter if paid.

This would also send a subtle warning to the next tenants.

OP like someone suggested to you file a case against the tenant in magistrate court immediately with the evidence of the center of abitration settlement of given him 6months to leave and other reminders.

The extra months he stayed after the agreed 6months by both parties before the centre of abitration he'll be forced to pay by the court.

The court will confiscate his properties through the court bailiff and auction them to pay you.

You guys wasted almost a full year chasing shadows by going to centre of abitration that can not act instead of going to magistrate court to evict the stuborn tenants within that 6months.

They should not have waited till the rent expired to serve him the notice.

If the tenant attended the Mediation, then there ought to be a written agreement that he will vacate after the agreed date.

When he refused to vacate at the expiration of the date, all that is required is for the Mediation Centre to take the file to a High Court Judge who will make the agreement as Consent Judgement which therefore becomes enforceable.

It saves time when compared to a fresh suit in the Magistrate Court which will take more than a year in some cases.

May I advise against the advise of Most people telling you to resort to self help. You will regret it if you ever try to do such.

I had a similar case about 2 years ago. I got a lawyer who sat down with his lawyer to draft an agreement which was the basis of the consent judgment given by the Magistrate.
The terms are:
1.Forgo owed rents
2. Give 3 months for him to get another apartment.
At the expiration, the guy went to the court to get another 1 month extension behind our back. He left before the final date.

The 6 months we gave him elapsed at the end of August, 2019. When the 6 months elapsed, he refused to vacate the apartment. So, my family went back to the Lagos Mediation Centre to complain. The Mediation Centre sent him (the tenant) a letter giving him 7 days ultimatum to vacate the apartment. At the end of the 7 days, this man refused to leave. My family complained again to the Mediation Centre and they said they would look into it.

After another 3 months again by last November, 2019, this tenant refused to leave the apartment. My family went back again to the Lagos Mediation Centre and one of the officials there said "So, the man has not left the house since?". We responded yes. At the Mediation Centre there, they said something like they are incapacitated by the law to take any action.

This is December now going to an end. The tenant is still in the house. He has refused to vacate the apartment. It's about 10 months now living in our apartment without any payment. He has refused to leave.

The apartment is a 2 bedroom flat in Aguda Surulere, Lagos. The tenant's name is Mr Chigozie Okongwu James.

The reason the man is still in that house is because you made it comfortable for him, you are being nice to your debtor.

1. Knock his door every 1am in the midnight demanding for your money...let's see how many nights he will survive waking up in the middle of the night from your noise.

2. Look for dog shit or defecate in a bowl and carefully place it in front of his door (do this when he is not at home, so that anytime he return home he is to be greeted by pill of shit)

3. Always show up anytime he has a visitor and shout at the top of your voice that he should vacate the house or evil will befall him his family and friends.

4. Try number 1 as the final option if number 2 and 3 fails.

If after exhausting all options and the mad man refuses to leave, then you and your family should pack out and let him have the house to himself.

Don't mind does at at the center. Demand they should forward your case to multidoor court. If they refuse something is wrong.
You don't need a lawyer.
Don't insult them ask politely.
If they refuse take your aggrement and 7 days notice to their ikeja head office and explain to them everything.

You have done well by giving him the statutory 6 months notice. You are the cause of your problems sef. Why the delay? Rush to the magistrate court with a lawyer and the signed agreement you had with the tenant in the mediation center. The magistrate will then enforce it.
If you use soldier, when the case starts, nothing consigns the soldier o, police, etc na on top your family head. You should had involved a lawyer from the on set. The next step is the magistrate court abeg.

Please don't listen to those saying you should remove his roof. You will be sued heavily. Just get a lawyer and go to court. Remember to add all the money he's owing plus the debt that will accumulate throughout the trial and also the legal fees that will be charged by your lawyer.

Don't remove his roof or lock him out,if you act rashly you may end up in prison. Many landlords are languishing there.
Involve the police not a lawyer. Let police invite him to their station where they appeal to him and likely give him another 6 months. The shame of writing an undertaking to that effect may let him leave.
If you involve a lawyer and end up in court I see him still residing in that apartment much longer than 18-24 months from the day of his first appearance in court.
It is much easier to eject tenants through court process in Ogun state than Lagos state and still get to seize tenants valuables after ejection until the debt is paid.

Property tenancy is a legal matter but the so called landlord are only after money hence this kind of issue and to be honest with you shelter issue is beyond any other transactions so if the tenant earned the quit then do the normal thing prescribed by the law via the law not just the other way.

Just carry SARS to forcefully eject him. What he is doing is same as robbery. He has studied your psyche and discovered you are weaklings. So he is benefiting from it.
