27. ACTIVITIES RESERVED FOR GHANAIANS AND GHANAIAN OWNED 
ENTERPRISES

(1) A person who is not a citizen or an enterprise which is not wholly owned by citizen shall not 
invest or participate in—
a. the sale of goods or provision of services in a market, petty trading or hawking or selling 
of goods in a stall at any place;
b. the operation of taxi or car hire service in an enterprise that has a fleet of less than 
twenty-five vehicles;
c. the operation of a beauty salon or a barber shop;
d. the printing of recharge scratch cards for the use of subscribers of telecommunication 
services;
e. the production of exercise books and other basic stationery;
f. the retail of finished pharmaceutical products;
g. the production, supply and retail of sachet water; and
h. all aspects of pool betting business and lotteries, except football pool

28. ENTERPRISES ELIGIBLE FOR FOREIGN PARTICIPATION AND MINIMUM FOREIGN CAPITAL REQUIREMENT

(1) A person who is not a citizen may participate in an enterprise other than an enterprise specified in section 27 if that person

a. in the case of a joint enterprise with a partner who is a citizen, invests a foreign capital of
not less than two hundred thousand United States dollars in cash or capital goods
relevant to the investment or a combination of both by way of equity participation and the partner who is a citizen does not have less than ten percent equity participation in the
joint enterprise; or
b. where the enterprise is wholly owned by that person, invests a foreign capital of not less
than five hundred thousand United States dollars in cash or capital goods relevant to the
investment or a combination of both by way of equity capital in the enterprise.
(2) A person who is not a citizen may engage in a trading enterprise if that person invests in the
enterprise, not less than one million United States dollars in cash or goods and services
relevant to the investments.
(3) For the purpose of this section, “trading” includes the purchasing and selling of imported
goods and services.
(4) An enterprise referred to in subsection (2) shall employ at least twenty skilled Ghanaians.
(5) The minimum foreign capital requirement of this section shall not apply to the foreign spouse
of a citizen of Ghana to the extent that
a. the foreign spouse is or has been married to a citizen of Ghana for a minimum period of
five years continuously or holds an indefinite resident permit prior to registration of an
enterprise;
b. the marriage has been duly verified as having been validly conducted; and
c. the foreign spouse is ordinarily resident in Ghana.
(6) A citizen of Ghana who loses the citizenship by reason of the assumption of the citizenship of another country shall not be required to comply with the minimum capital requirement of this
section.

Nigerians always love to ignore it find their way around laws, but when the law catches onto them they begin to cry wolf

I can't help but agree with the Op. I think Nigerians can generally have a high tendency to be very lawless in other countries if allowed. Maybe Ghanaians themselves encouraged the flouting of their own laws initially when they deemed it harmless. But apparently they are now feeling threatened that if something is not done their local retail markets could be overrun by Nigerians who may be coming in with funds being sourced from questionable sources that their local retailers can't compete with. In light of that I can't say I blame them for protecting their turf. If every country simply allows foreigners free reign to come in and compete in their markets without certain restrictions, many countries would be overrun by foreigners in no time. There is nothing like absolute free trade anywhere in the world.

Let's not be naive. Even the developed countries have protectionist policies that protect certain sectors of their local markets/economy, so let's be guided.

Don't kid yourself. No West African country is a slave to any ecowas protocol. Even Nigeria herself violated that so-called protocol when it shut its borders recently. When Nigeria deported millions of Ghanaians decades ago, it didn't need to ask for anybody's permission. Every democratic and sovereign nation is first of all subject to the wishes of its people before any sub-regional protocol. The issue can quickly degenerate into a political one for the Ghanaian government hence what you are seeing happening. The Ghanaian government is only yielding to the yearnings and requests of its people to prevent Nigerians from engaging in retail trading in their country, ecowas protocols are secondary in priority.

The problem is not the laws. The problem is that they only enforce them on Nigerians. Other traders from Mali, Ivory Coast, Togo, Benin etc are allowed to trade anyhow they want. Only Nigerians are targeted. There are also laws against illegal mining in Ghana, yet there are thousands of Chinese, Indians and Lebanese mining gold illegally there with impunity. So, Ghana has laws. Just that they only enforce them on Nigerians.

Lawlessness Nigerians are an embarrassment.
I see why Ghana cracks down on Nigerians when it comes to deportations. Certain people have to understand not every country will coddle criminals. This is especially true when they play victim after committing a crime. If you cant live by their rules just return to Nigeria it's not that hard.

What protocols are you referring to? This law doesn't stop anyone from exporting goods to Ghana if we're talking about the ECOWAS Trade Liberalization Scheme. Nigeria is free to sue if they believe it does.

Or are they still pained by the border closure by the Nigerian government which they see as being targeted at them? Because the above listed laws suddenly came into effect the moment Nigeria closed her borders against smugglers. All this is just bad belle.

Laws can be enforced anyhow those who established it chose to enforce it. If they turn blind eye to Chinese it is not Nigeria's problem, after all Nigeria allows rice from Chinese but you bar land border transactions with Ghana.

There is nothing draconian about that lawz, it is generally same word over other developed countries just chose not to enforce. I remember when police crack down on Nigeria owned beauty salon in Jo'burg n the owners are told to make a plan. Most Nigeria eatry in SA are still coded though most time the police just look away but they know they ain't allowed.
