And your point is? Whats being defensive in stating what obtains? Please don't talk about what you don't know or just do a quick check to confirm is the info is correct. Periods of being away from the UK which are below the acceptable thresholds are termed absences (180 days or less) while periods above the acceptable absence allowance are called breaks in your leave / visa.

Lol. Even when I asked you not to take offense, your conclusion is this disrespectful comeback of "what I don't know"? Simply because? I reckon you're civil to people who truly do not know on this thread, and anyone with a semblance of correcting you is subject to a pointless defense or a rude retort such as this and the other one about shouting. You will NEVER say that to me in person under ANY circumstance. You don't know me (or what I know) and trust me, if you did, you'll be impressed.

That said, keep up your good work! Cheers!

Clarifying now means I've taken offence? That you said no offence meant didn't mean that you should make your comment in a condescending or patronising manner.

If you knew, you wouldn't have made the comment you made and stating that someone doesn't know something isn't abusive. If I don't know something, I wouldn't have issues saying that I don't know or accepting that I had made a mistake, no hard feelings.
You think that calling a comment clarifying a piece of information that came from me was unnecessary and funny was okay while saying that I was defensive but me stating the obvious about you not knowing was rude?

I don't need to know you before I respond to you as appropriate; wrapping up your words in honey doesn't negate the presence of vinegar in it.

Even Justwise whom I responded to knows that the comment wasn't rude in any form and eventually understood what I referred to in my initial post was not the permitted absences.

Lol, inphoenix, but it was you that first accused her of being defensive and went ahead to make a statement like this

“Doesn't in any way tamper with your reputation as a savior on this thread.”

What I saw from her write ups was her just attempting to explain better, what she meant. There was actually no form of defensiveness in what she typed.... from the first one where she was asked to speak more on leave to remain to where she was replying justwise.

You can’t finish saying something like that and now tell her not to take offense and actually expect her not to take offense just because you said so.

You saying she was being unnecessarily defensive and she should just accept what not, is actually the out of line thing in all this

You can still make it, get your school to offer you 2wks extension, move the money to your account today and do your TB test, you can make an application by 3rd week of oct.

And your point is? What's being defensive in stating what obtains?
I stated that a person gets ILR after spending the time required on their visa / leave without breaks in the leave; breaks in continuous residence only comes into play when an individual spends more than the permitted absence allowance. You can always do a quick check to confirm if the info is correct. Always read to understand please.

Periods of being away from the UK which are below the acceptable thresholds are termed absences (180 days or less) while periods above the acceptable absence allowance are called breaks in your leave / visa.

Even Justwise comments ( which I further clarified ) didn't negate my point, it was clarification for the person my comment was directed at not to assume that a holiday period or any period of being away from the UK on acceptable absence allowance will count as a break in leave.

Sis, you went to edit your comment and even posted a screenshot? Lol. It's not that serious ma'am. No one is dragging champion of the UK visa advise with you here please.

It's even unnecessary cos I'm not even trying to "negate" or argue the merits or otherwise of your argument. Calm down, stop being defensive.

At the point when justwise pointed out that breaks are NOT ALTOGETHER fatal to an application for Leave, all you needed to do was say "yeah, that's correct, as long as it isn't more than 180days", but check out your response instead grin You get defensive because...? What you said is not even materially wrong, just a little misleading for those who truly don't know such as the person you were trying to bring up to spead on all things "Leave". Then you took the pains to do a screenshot in your attempt to interpret the guidelines to me? grin Nah, I'm not the one sis. Nuff said!

You still don't get it. Breaks and permitted absences are different.
A break in continuous leave is when you've spent longer than 180 days outside the UK because this resets your clock towards qualifying for ILR except in extenuating circumstances.
Permitted absences are within the permitted absence allowance and they don't reset your ILR clock or continuous leave period so they are not breaks in your legal leave. See the attached screen for more clarification as to what qualifies as a break in legal residence in the UK.
The edits on my previous comment were made to include more details before your response came in so, chill. And if this is what you term defensive, I can only just leave you to believe what makes you feel good.

Any comment I put on here isn't borne out of a need to become champion, it's borne out of a need to help.

I wouldn't be responding to you anymore.

Thanks Dami for these responses.

My uncle is for all intents and purposes my father because my dad died when we were at an early age. He paid for my education from primary school right through to university. He opened an account I can have default power of attorney over in the long term - if he is indisposed. Is this good enough reason?

dami24:

1. You can do it either way tbh.

I will advise you go ahead and submit your visa application and then choose a date that falls after 8th of October for biometrics.... if anything is wrong with your Tb test, you just cancel your visa application and you will get your refund

For me, my Tb test was scheduled for 11th September, I submitted my visa application on 4th September and I chose 14th September for my biometrics.

Just ensure that if you are using self service, you do not mistakenly submit your documents when you don’t yet have your Tb certificate.

For sure, it is usually better to have all your documents ready before you submit your visa application, but in this case, there is really nothing to lose. If you are unable to get your certificate on 8th, you just cancel your application or you can even amend your biometrics date.

2. People usually have joint accounts with whoever for several reasons, so if the reason you have a joint account with your uncle has nothing to do with your application then just go ahead and tell them the reason you do if they ask.

I don’t think there is anyway to prove the percentage of the money that is yours, I’m not sure, however, just ensure that at-most half of the money in the account added to that in your personal account meets the required fund for your maintenance and tuition balance, if any.
Re: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by inphoenix: 12:00pm On Sep 25, 2020
xander21:
I understand its a burden that's why I am even asking. I would have transferred the money immediately to my personal account, but that would reset my 28 days validity down to zero. I figure giving a sound explanation should be easier. School has resumed already, I've just been attending classes online.

You've made a valid point here, starting over at this time would be nerve-wracking and counterproductive so you might just as well go ahead with your plans. My advice however, is for you to be prepared to convince the ECO of why you have a joint account with your uncle if you're asked in an interview. You might even be lucky not to get an interview at all.

All the best!

Lol. So you see that everyone's experience is different, while your cousin wasn't asked for the TB certificate, others were.

The financial evidence provided during your application is for funds which are meant to be available to you for your course, so, you might be asked at the point of entry, and if you're asked, you must produce. Finish grin

While I've said I'm not going into the merits of your argument from all these numerous unnecessary screenshots, bear in mind that "breaks", "absence", "gaps" are all the same.

This is what some people wanted to crucify @justwise for this morning

@sweetness24 So sorry about this outcome. It is important to always understand that the truth and consistency are very germaine in UK visa application process. Under what rules were you denied? It'll help to know if it is something you can address in subsequent applications or an outright ban which you might have to serve out

Sadly, as painful as this is, there's nothing you can do as this falls under refusal as a result of non-disclosure of material fact (deception and misrepresentation). I don't think that an administrative review will fix this except you can prove beyond reasonable doubt that you were not trying to game the system.

If you haven't already been served with a ban, you should cool off and try applying at a much later time while specifically addressing the issues raised.

If you've been served with a ban, you won't be able to apply for a UK visa till the ban period is served and any applications made after then will be subject to a higher level of scrutiny.

Yes, the processing times is known to have on many occasions extended beyond 15 working days. More so with this COVID-19 situation.
