your rent expires in same time frame. it depends on you though, you can start now and start looking for house but if you want to buy more time get a lawyer to write him too notifying/reminding him that your present rent expires in 6 month so therefore. the 6 months will start from August.

The bolded notion is not right. You can be served notice to expire at the anniversary of your tenancy. He is simply telling her that he doesn't intend to renew once her tenancy expires. You can not force someone to renew contract with you, do you?

Do not be misled by some tenants of doom on this platform.

On a norms, if your tenancy payment is based on 6months interval, u are entitled to a 3 month notice before the expiration of ur tenancy agreement and if your tenancy payment is on a yearly due, you are entitled to a 6months notice.

Mind you, this notice is not to evict you immediately but a prior info of warning to let you know that you are no longer wanted in that house due to one or two reasons known by the landlord.

There is no point in fighting ur landlord because you want to prove to him that you are smarter.
Pls he own his house.

Maintain ur level, look for house elsewhere or you go to meet him amicably to know the reason why he no longer wants you in his house provided you have been a good tenant in that aspect.

If u can't sort it out, then be prepared to do the needful when your tenancy agreement expires.

Some follow come agents of doom giving u advice here will not be there to bear the brunts that u will incur.

Hi OP, please do not listen to those confidently misadvising you. A preliminary point to note is that it is actually during the lifetime of a tenancy that a landlord should issue a Notice to Quit so that the notice expires at the same time as the tenancy and you do not stay beyond the end of the tenancy. Landlord must not wait until tenancy ends to issue quit notice

Your first port of call should be your lease agreement, that is what governs the length of notice required. Where the Lease Agreement is silent on the issue, then you can fall back and have recourse to the provisions of the law on length of notice. The rule is if you are a yearly tenant (i.e you pay your rent on a yearly basis and not weekly or monthly for example), then you are entitled to six months notice which is to expire on the eve of the end of the tenancy) for example, if you pay your rent yearly on January 1 of every year, your 6 months notice must be such that the 6 month period ends on December 31 of that year.

In your own case currently, if there is nothing different in your lease agreement on length of notice, I will say that your landlord has not issued you with the proper 6 months notice as required by law. What he has actually issued is 5 months notice and same does not even expire on the eve of the anniversary of the tenancy as stipulated by law. As your tenancy expires August 31, he should have given a Notice that will lapse on August 30 and must be 6 months in length, in other words, he should have issued it no later than February 28, anything after that is not up to 6 months notice.

This being said, my humble advice is for you to start looking for alternative accommodation as even if you are able to successfully challenge this notice and stay beyond the date given, once your tenancy expires, you will still be liable to pay the landlord on a pro rated basis, for however long you stayed extra in the property. So to avoid issues you may start looking. However, the choice is entirely yours, seek advice from a good lawyer and do you, all the best.

The gist I am getting from a lot of replies from people who I suspect are never do well tenants is that the law gives tenants 6 months free to live in any house of their choice.

If that really is the law, we are all mad Nigeria!

The first thing you need to do is refer to your tenancy agreement. Most people do not go through it at all and these landlords do put a loophole there. The loophole is for them to be able to issue you a quit notice six months before the expiration of your rent.

Read below an extract from the tenancy law:

Length of Notice

(1) Where there is no stipulation as to the notice to be given by either party to determine the tenancy, the following shall apply

(a) a week’s notice for a tenant at will;

(b) one (1) month’s notice for a monthly tenant;

(c) three (3) month’s notice for a quarterly tenant;

(d) three (3) month’s notice for a half-yearly tenant; and

(e) six (6) months notice for a yearly tenant.

At the bolded, landlords do insert the notice period. But tenants do not take their time to read it.
If someone who have been looking for house for a month sees a newly built one which is exactly what you've been searching for, and it becomes clear you're not the only person coming for the flat, you don't have time to read and disagree with the landlord, because before you open chapter one, another person don pay come deh pck in sef.

I only advise ppl to just be a good Tennant, if you pay your rent when do and live by the rules nobody will disturb you, you might not even need to open your agreement till you willingly want to leave the property.

OP no tell us wetin him do, he fit no deh pay all this minor bills like phcn or security levy, or gateman/cleaners levy.

As a Lawyer, I can tell you that a valid notice to quit over a yearly tenancy (in the absence of any other period of notice specified in a written tenancy agreement) is a minimum of 6 months advance notice which must expire on the eve of the anniversary of the current tenancy.

It means the notice in your case ought to expire on the 31st day of August instead of the stated 18th August. So this notice is invalid.

However, bear in mind that upon the expiration of your current tenancy and in view of the fact that your landlord appears unwilling to grant you a renewal, you will become a tenant at will and only entitled to a 7 day notice to quit.

Op, no free meal anywhere, even in Freetown.
You are to get 6months notice at any point your landlord isn't interested in the contract again or 6months pay so far you are not a debt owing tenant.
If your landlord wants you out immediately without having the patience to wait for the 6months, he pays you in lieu, if he can wait, he gives you 6months, then 7days afterwards (either cash refund or notice) an intent to recover possession of property is issued.
If you use anything outside your agreement, 1day, 6months, 1yr, etc, you are to pay for such.
The reason why you see such not been paid for is because landlords at that stage just want you out and don't want the stress of chasing you to pay such debt. Any landlord that with time and resources will sue you for debt recovery. We now have BVN to flag all accounts attached to an individual unlike the days of you moving completely out of reach of an individual you have dispute with.

I had my naming last week, my landlord sent his wife and one of my neighbours despite the fact that it was a very busy day(Monday).
We have spoken more than 5times since I moved out middle of January, same relationship is what I have with every other landlords that I've lived with.

Before paying for an apartment, always request the tenancy agreement and read through the lines properly.

Let me type 2 clauses in a tenancy agreement given to my brother after paying and moving into an apartment.

(Landlord's covenant)
1. The landlord may in his discretion upon the request of the tenant not exceeding a month to the expiration of the present term grant another term of one year certain upon the same terms and conditions as contained in the present agreement except in respect of the reserved rent and service charges, which are reviewable, and the covenant of option to renew.

(Tenant's covenant)
2. Within the last 1 month of the tenancy to permit the landlord, or any person authorized by the landlord or the landlord's agent at reasonable hours of the day to enter and view the apartment with prospective tenants or purchasers.

From the above, it means you must inform the landlord about your willingness to renew your rent, 1 month to the expiration of your current rent. The landlord also has the right to refuse renewal.

I am sure you can infer from the above clauses that the notice period is 1 month.

I recommend to tenants insist on the tenancy agreement before making payment. A landlord will deliberately hold it back because of his mischief

I keep reading how can he give you quit notice when your rent is still on.? O many ignorant people saying trash because the Nigerian justice system moves at snail speed and most tenancy disputes don't end up in the court of law, where the law will be interpreted appropriately.
You can go and make your enquiries from a lawyer. A Notice of Quit can be duely served even when the tenancy is still running. I decide to serve a tenant whose rent expires by June 2021 a Notice of Quit by 2020 December and I will still be well within my right.
A notice of quit is not a termination of the tenancy, rather it's to notify the tenant that I do not wish to renew the contract of his tenancy when his present rent expires.
It's just a pity that the judiciary doesn't expedite cases of this nature when it's taken to the court.

u were just lucky to spend extra free months in his apartment because of a weak and failed judicial system in dat state. Had it been u were in a state where the judicial system is effective. You would have been evicted by d court bailliffs and they will also seize ur property and take them to court for sale

You are a liar and a bad tenant. It is tenants like you that give others a bad name. A landlord is within his/her right to give you a quit notice at any time during your tenancy. It could be done even whilst you still have a long existing valid rent. If you’re given a quit notice before the expiration of your rent, the landlord MUST pay you the outstanding balance.

Ifttt is not your house so how on earth do you think you can be the one to dictate if and when you get given a notice. Landlords must mark your alias and be careful of people like you.

By the way, the corrupt police that interpreted the law to and for you should be sued in court. When did the police become the judiciary to interpret laws. You probably bribed them and both they and you are lucky you did it to someone who could not be bothered to sue your damned arse.

I see a lot of comments saying the landlord was right. That's a big lie. I see they don't know about tenement laws, particularly in Lagos. The law empowers tenants a lot. Your landlord cannot give you quit notice unless your rent expires and it must be a 6 months notice so that in that six months, you can get another accommodation. So bro, your landlord and the barrister who signed that are so wrong.

No pls. A valid notice to quit begins to run during the tenure of the tenancy and expires/elapses on the very last day of the current tenancy. A tenant who stays beyond that day will have to pay mesne (pronounced mean) profit which is a calculation of the rent for the extra period he held over possession, except of course the landlord waives his right to insist on the additional payment.
