My brother, there's nothing u can do about it. The law is what it is and not what u think it should b. The notice(6 months notice) is legal,however emotional u may feel, it doesn't change d position of d law. He should b thankful that d landlord is yet to served him d requisite notices-7 days notice, which I believe it's in d offing. That's d position of d law so it's legal.

Some of you guys are funny sha. Quoting law and dragging case.

If it were me i would confirm that he doesnt want me in his house any more at the expiration of my rent. If he confirms it. I would ask why? And no matter the reason given, august 31st i am out.

Who has time to be dragging another mans property with him. House of the same cost full area.

This is usually done by illiterate and greedy landlords, he gave me quit notice in July when my rent expiration was December last year this is March and I'm still there his only prayer now is for me to move out soon as he can't do anything.

If I should advise your landlord and tell him what to do the right way, I promise you that you won't last 3 months in that house. The police officers overstepped their bounds, this is not a police case.

The 6 months should start after the expiration of rent outside that dont agree for another arrangement. You can go to any citizen mediation office around your area. it's a government office meant to take care of cases like this and report the matter they will invite your landlord and settle it for you guys.

It's because of tenants like this that I made it compulsory to serve 6 month quit notice along with renewal notice so that at expiration of rent, the tenants already had 6 months to start looking for alternative living arrangements. After lease expires those who refuses to pay will receive their 7 days notice and on expiration of those 7 days, the court will grant the needed order to repossess the property. No time for radarada, I already budgeted the court costs into each yearly rent, I won't build house of over 60 million come dey follow tenant drag over 700k....ko le work!

You have been given QUIT NOTICE.
And you are very lucky having six months ahead to prepare yourself and avoid more embarrassment.
Two things involve : (a) After expiration of six months, grace of additional three months may be given you. Earlier the better.
(b) Even after the above condition might have been exhausted, additional one month may also be added to you but avoid reaching the last stage or doom awaiting.

what goes around will come around. You continue with this mentality and you fall into a big law case will swallow you. The New landlord did absolutely wrong by not consulting with current tenant however, to lie and claim you loss millions is a mispresentation of facts. You're lucky you stay in an environment where there is no CCTV camera cuz you will have criminal record against you and your business.
I also feel like your comments are full of lies in itself. Just as you snap pictures and claim burglary so can your landlord claim you made it up and that you already moved out of the apartment when your quit notice elapsed.
Imagine they revisited this case in the future based on new evidences or if your salesgirl's testify against you in the future to confirm you mis represented the fact.
Again keep on with this sort of mentality till you get bleeped up.

Hi, I'm not sure I understand your question fully. On what grounds would the tenant /3rd party even be able to sue if there was "due notice" as you say?

If it's about the forceful eviction then the landlord really should not forcefully evict a tenant whose rent has expired and has been given the correct notice, he should use the machinery of the courts to evict the tenant and not take laws into his own hands. That would be self help and in such a case, the tenant should be able to sue for the appropriate reliefs regardless of any "no contest" agreement you may have signed. This is because you have a constitutional right to seek redress for wrongs done to you which overrides any other law, you are also entitled to approach the courts for the protection of your fundamental human rights.

And where in the law is it stated that it Must be a 6 months notice? Shey you know if the rent has expired he is only entitled to 7 days?

Now the OP has been given 6 months notice that his tenancy will not be renewed in order to find another accommodation before the 6 months end. Even if the notice is issued after his rent expired, he has to Pay for the time spent according to that same law you are misquoting.



Is it not the same LAGOS tenancy law we know.

Am telling you brother. While should i spend 60M building, only for to be messing my house up or not wanting to pay rent as at when due. Tenants don't know what it cost to build a decent house. When I was building last two years DEC a ton of 12mm was 175k it later rose to 195k in that DEC, now I heard its 270k, look at the difference. In one year, I spent close to 200k repairing the house. I have continuously spend money in maintaining the house to look decent because I don't want the house to look like barrack. The funny thing is a tenent would owe you rent, yet all him children go dey go school, you would never find out that his children was chased away from school because of not paying school fees, but you want to owe landlord, if the Govt wants things to be better, landlord should be able to kick tenants out after one week default payment of rent. Most tenants prefer to drink beer, repair there cars, change there cars, paint inside there apartment to paying rent. Some tenants is owing me 3 years rent in my house in ikorodu, this same people dey Bleep there wife for my house, all of them done born like two children each, yet them know pay rent. Tenants had kept 850k NEPA bill for me, I had to go buy prepaid meter, they are owing me ohh, yet I gave some tenants prepaid meter so that they would not use dept to kill me, some dont have light now for the past 5 months because i refuse to give them prepaid meter, them know park ohh, them dey enjoy free house. All tenants on Nairaland if you know what it cost to build a house, you would not come here and say bad things about landlords. Some of you would club, buy expensive cars, yet you don't want to pay rent, I drive a Camry 2.2 before I buy am self, people beg me, i was interested in securing the future of my family, now while will I be happy if my tenant refuse to pay my rent.

Neither is he terminating your lease for failure to pay rent.

He merely seems to be notifying you that he does not intend to renew/extend your tenancy upon the EXPIRATION of the current lease term. Personally, I think 6 months is more than reasonable enough notice (unless your lease agreement provides otherwise). If I were you, I would use the 6 months to start searching for a new place. Good luck.

It is a very proper notice and I'm sure the notice is issued by a competent lawyer.the end of the 6months notice should coincide with the last day of your rent.thats the position at common law but no more necessary .quit notice need not coincide with the end of the tenancy again.what more do u want after 6 months .just go find another house.the landlord doesn't want you as a tenant.use ur money and pack out.

Now, if this tenant starts looking for house now & finds a suitable house this month & decides to pack, will the landlord refund his balance 5 month's rent?

By right Ideally, the 6-month quit notice is supposed to start from the day his present rent expires, but the problem is that most tenants abscond with the rent arrears.

I advise the tenant to start looking for house now & if he finds a suitable house b4 the end of his current rent, the Landlord should refund the balance rent.

For a six months tenancy, a three months notice is the adequate amount while a one year tenancy requires six months notice. He gave you more than the required amount of time ahead.

In the notice, the lawyer gave you till August 31st even though the notice elapsed weeks ahead of the 31st. There should be no complaint there.

If the landlord had given you three months instead, he would have had to refund you three months along the line but since he only wanted you out at the end of your tenancy, he gave you as much as till the end of your tenancy. For one reason or the other, he just doesn't want you to renew afterwards. For starters, he has already involved the services of a lawyer he paid money to.

You may go to the local magistrate court close to you during the afternoon after cases have ended and ask for informal advice from one of the court clerks and they will tell you exactly what I just wrote. Any friend of yours in the law line can advice you as well. You were early informed, no need creating bad relations.

If on the other hand you wish to create issues with someone whose only sin was to accommodate you and wishes to use his investment for something else, this is how it will play out. You will be given another seven days notice and if after that you still play funny, you will be charged to court. If they can prove you were being stubborn and what other accusations against you, the judge will rule that you move out by a stipulated date, and pay any extra periods at the existing rate till the date you're asked to moved out. A strict judge would ask you to pay all the legal and service fees your landlord incurred over what should not have been a case at all.

In western countries, your name would then be placed on a list of troublesome tenants and future attempts to rent a place would be extra hard and extra expensive. Locally, things like this might block opportunities if the landlord knows where to send a copy of your court judgment to. smiley

Is it worth the wahala?

Rent is not free, you have a date your tenancy ends, you are being asked to move by that date. Where is the problem? Choose wisely.

thanks a great deal. the tenant constitutional rights supercede any personal agreement I might sign with the tenant. so thanks. I was thinking our personal agreement comes before the state's constitution.
