AN FCT High Court on Tuesday sentenced two brothers and one other to three years in prison each for online fraud offences. Delivering judgment, Justice Muawiyah Baba- Idris, sentenced Onjaite and Ogbe Tosan and Saidu Abdulmumin after they pleaded guilty to forgery and obtaining under false pretence. Baba-Idris ordered that the proceeds from the crime and other things associated with it be forfeited to the Federal Government and the victims. The convicts were arraigned by the Economic and Financial Crime Commission on various online fraud. This was pursuant to a plea bargain agreement they made individually, with EFCC. Baba- Idris held that section 270 (11) of the Administration of Criminal Justice Act empowers the court to impose heavier punishment other than the one agreed by the parties. “I have read the plea bargain agreement and it is not inconsistent with the court to adopt the agreement in toto. “Courts have a duty to enforce the provisions of the Act under which an accused is charged.” “Cybercrimes are flourishing among the youth to the extent that even secondary school students engage in it” he held. THE Nigerian Police, on Monday, engaged the members of the Islamic Movement of Nigeria (IMN), also known as Shi’ite, at the Central Area, Federal Secretariat, Abuja, leaving many IMN members seriously injured. The attack comes exactly two week after Shiite and police clash at National Assembly in Abuja. Tribune Online reliably gathered that members of the IMN had assembled to commence their usual procession in protest to press for the release of their leader, Sheikh Ibrahim El-Zakyzaky, who had been incarcerated since December, 2015 by the Federal Government, before the security operatives demobilised them. Crises Looms In Osun Community Over Kingship Tussle, As Ooni Accused of Complicity UNLESS the Osun state Government intervenes in the lingering Chieftaincy tussle rocking the Ipetu community in Ife-North Local Government Area, with a view to proffer lasting solution, the agrarian community may soon be consumed by violence. THERE is a palpable tension presently in the town, as youths and other interest groups, including the royal families are threatening fire and brimstone should the kingmakers go ahead in their 'strange' selection of a successor to the vacant throne in the town, which they described as “unacceptable and a negation of age long tradition in the selection process" . Recalled that the late monarch, the Apetu of Ipetumodu, Oba James Adedokun Adegoke( Akunradoye 11), joined his ancestors on November 26th, 2017, after years of peaceful reign. It was reliably gathered that few days after the completion of burial rites of the late king, the next ruling house (Aribile lineage ) was contacted by the kingmakers through the Local Government to submit names of interested persons for the throne, in which 13 candidates expressed interests to contest for the vacant stool. Addressing a press conference on Saturday, in Osogbo, the Osun State capital, Prince Taiwo Ayoola, who is a National Leader of Aribile ruling house, in company of representatives of other ruling houses called on the state government to intervene and prevent the kingmakers from going ahead with the installation process to forestall full fledged violence. Ayoola said names of 13 interested candidates were later presented to the 4-man kingmakers for screening through Ifa Oracle divination and in line with the age long customs and traditions. According to him, rather than allowing age long tradition and norm of selecting a new monarch for the community to hold sway, the kingmakers opted for an unconventional method of selection. He accused the kingmakers of setting aside the tradition and age long process of selecting new king in the town and succumbed to monetary inducement by endorsing one Joseph Gbenga Oloyode on July 26, 2018, who is not from a royal patriarch as the candidate to ascend the throne. " This decision of picking a stranger to ascend the throne was completely rejected by the majority of the people from Aribile ruling house, which comprises five royal families of Ajiga, Arowoosun, Elewa, Kiaje, and Latimogun as a total negation to the custom and tradition of the ancient community". The chairman of Ife-North Local Government, Hon. Taiwo Orosanya and three out of the four kingmakers were also accused of conniving with the Ooni of Ife, Oba Adeyeye Enitan Ogunwusi to impose the candidature of Oloyede on them without recourse to the wish of the people of the community and tradition of the town. Orosanya was further accused of exploiting contestants by compelling them to buy plots of land which amounted to over a million of naira, before they could be qualified to vie for the stool, just as they alleged that each of the candidates was compelled to pay a sum of #800,000 as intention fee. The aggrieved princes expressed their discontentment over the role they said the Ooni of Ife played in the selection of the Oloyede, saying Ooni, despite the fact that he was fully aware of court injunction still went ahead and granted consent to Oloyede to ascend the throne as Apetu. According to the princes, "On 4th April , 2018, the head of Aribile , Chief MO Oyetade forwarded the names of the 13 successful candidates to Ife-North local Government Sectary for onward transmission to the kingmakers. The council Chairman for reason best known to him on receipt of the letter unilaterally removed the name of one candidate (Aseyeba Ayoola) and replaced it with one Rueben Olaolu Babalola, who never took part at the meeting held on 12th, April, 2018 and sent to the kingmakers to act upon. "There was a pending injunction of high court of justice Ile-Ife in Suit No JKF/19/2018 granted on 7th June, 2018 against Chief Sunday Afolabi Adedeji(Asalu of Ipetumodu and head of kingmakers) Chief Rufus Babalola (Molefon of Ipetumodu) Chief Titus Olanrewaju (Morigi of Ipetumodu) and Chief J A Akande (Olukotun of Ipetumodu) which was not vacate until 21st November , 2018 when it was struck out pursuant to letter of withdrawal written by 2nd plaintiff in that case. "The kingmakers started their illegality when they erroneously and fraudulently promoted Chief Olanrenwaju to Moriji from Olukotun and promoted Chief J.A Akande who was never part of kingmakers. This illegality was reversed upon petition written to the ministry of chieftaincy and local government affairs. "They also went ahead to make the least of the chiefs in Ipetumodu (Lofidi) Chief Kehinde Orosanya as warrant kingmaker, when his twin brother , Taiwo Orosanya is the Ife-North Local Government Chairman and has a vital role to play in the process of selection and installation of a news monarch . "The kingmakers jettisoned court injunction restraining them from going ahead with the illegality to pick Oloyede Joseph Gbenga, without recourse to the head of Aribile and other members of the family. They further explained: "When we got the hint of their wrongful and illegal selection , as law abiding citizens, we approached High Court Ile-Ife in suit number HIF/17/2019 to seek redress which is still pending. We enclosed letter written to his Imperial Majesty, Oba Adeyeye Enitan Ogunwusi and PS Ministry of Local government and Chieftaincy Affairs. "Despite the pending cases in court and series of letters to appropriate quarters, we were shocked that Arole Oduduwa, Oba Ogunwusi who is the 5th Defendant being a prescribed authority and who had been served with all the processes in the suit including Motion for Interlocutory injunction in an attempt to subvert justice and strangulate the rule of law connived with Chief Sunday Adedeji, the Asalu of Ipetumodu, chief Rufus Babalola, Poju Akintayo, Chief Aresa , Hon Taiwo Orosanya, Chief Kehinde Orosanya and granted consent to Mr Oloyede a defendant in the pending case for installation as the Apetumodu of Ipetumodu". THE Department of State Services (DSS) also known as 'SSS' has cryout on activities of “some unscrupulous elements” cloning official websites of some government agencies and using same to defraud unsuspecting Nigerians. The Agency through its Public Relations Officer, Peter Afunanya on Thursday raised the alarm in a statement in Abuja, NAN reports. He said there had been instances where the official identities/paraphernalia of certain Ministries, Departments and Agencies (MDAs) were deceptively deployed by these criminals to shortchange vulnerable persons. “Notably, the Nigeria Social Investment Trust Fund (NSITF) and the National Youth Service Corps (NYSC) have so far suffered the tricks of these fraudsters who use decoys to manipulate their victims. “This, in the case of NSITF, has resulted in loss of varying sums of money by those promised huge returns on Federal Government’s investments and other poverty alleviation initiatives which ended up as scam. “Some persons have also engaged in the illegal sale of NYSC kits and accouterments to prospective corps members. “They also advertise the issuance of medical clearance certificates as well as redeployment of corps members to preferred states for primary assignment on medical, security, marital grounds or other reasons,” he said. He said the DSS was already working with the agencies to identify and arrest suspects and enjoined the public and prospective corps members to be wary and conscious of the fraudulent developments. Afunanya, therefore, warned perpetrators to desist from the act or be ready to face the full consequences of their actions as the service would continue to track the criminals. CONSTANT Omari has replaced Amaju Pinnick, of which his tenure expired on Thursday the 1st Vice President of Confederation of African Football (CAF). According to information gathered by Happenings, Fouzi Lekja and Danny Jordaan became the new 2nd and 3rd Vice CAF Presidents respectively. This development came up during the CAF Executive Committee meeting, after a well-attended Congress in Cairo Egypt on Thursday. Pinnick, President of Nigeria Football Federation (NFF), was elevated to the position after the corruption case brought against former Ghana FA President and CAF 1st VP, Kwesi Nyantakyi. Super Eagles captain John Obi Mikel, has announced his retirement from international football at the age of 32 less than 24hours after Nigeria won Tunisia on Wednesday. The announcement comes after Nigeria won bronze at the 2019 African Cup of Nations (AFCON) in Egypt following Super Eagles 1-0 win over Carthage Eagles of Tunisia. This is far from the truth,” THE Muslim Rights Concern, MURIC, has cautioned Nigerians against politicizing the suspended Federal Government Rural Grazing Reserved Area, otherwise known as RUGA, for herdsmen. The Islamic human rights organization, which gave the warning through its Director, Professor Ishaq Akintola on Thursday, said; “Nigerians should stop listening to rogue politicians.” The group noted that there was nothing like Fulanis planning to install Emir of Oshogbo, Emir of Enugu or Emir of Asaba. It is all balderdash, adding that these are false alarms being raised by unscrupulous politicians and expired demagogues. The group observed, “For decades in this country, we have always had Seriki Hausawa in almost all the cities of the South just as we have always had In a Yoruba and Igwe of the Igbo in almost all the cities of Northern Nigeria. These were mere symbolic leaders of those tribal groups residing in states and cities other than their own. They were there for ease of administration and inter-tribal relations and they peacefully co-existed with their host communities. “But suddenly rogue politicians and merchants of hate speech began inciting Nigerians against Northerners, particularly Fulanis and herdsmen. All sorts of crimes were ascribed to them, especially kidnapping and armed robbery. We cannot afford to remain naive and blinded by ethnic jingoism. 10 per cent commission to the State coffers is not pittance especially as it runs into billions of naria. “As we fold our mats, we charge Southern governors to think more of the economic gains of RUGA and not the rumoured, unfounded and quixotic installation of emirs in Southern communities. It is a farce. We should be looking at the message, not the messenger. We call on Southerners to ignore disgruntled politicians and stop idolizing demons. Nigeria Happenings A Mild DRAMA ensured as an official of Ilesa prison was alleged to have slapped a lawyer, Kasiamobi Eze Ngwoke, in the premises of Osun state High Court, Osogbo, on Tuesday. According to an eye witness, the prison official has earlier slapped one of the inmates who was slow in entering the prison van after the court proceedings. It was gathered that the lawyer who was apparently not happy with the way the inmate was treated, approached the warden to educate them that the inmate has not been convicted and his personal liberty should be respected. Eye witness account revealed that the inmate is a client of Mr. Ngwoke. The prison warden who was said to be unhappy with the manner of approach of the lawyer slapped him and threatened to shoot him. The Magistrate, Mrs. Modupe Awodele, who was watching the drama from the court summoned the lawyer and the prison officials. The Magistrate was said to have cautioned the prison officials that they have no right to maltreat or assault an accused, let alone a lawyer. THE Nigeria Police Force has paraded 13 suspects linked to the kidnap of the district head of Daura, Alhaji Musa Umar, who was abducted at his residence in Katsina. Alhaji Umar was rescued on July 2 by operatives of the IGP Intelligence Response Team led by DCP Abba Kyari. Parading the suspects in Abuja on Monday, the Force spokesman, DCP Frank Mba, revealed that the kidnap was orchestrated by someone from Katsina. He gave the identities of the suspects as Aminu Saleh, Yusuf Dahiru, Abdullahi Mohammed, Bilal Yusuf, Sarfilu Abdu, Dahiru Musa, Tukur Bukar, Ibrahim Ibrahim, Mohammed Saidu, Abubakar Adamu, Mustapha Zakariyya, Ibrahim Mohammed and Bako Mustapha. He said out of the 13 suspects, four are from Daura, while eight are from different states in the northern part of the country. One other suspect is from the Niger Republic. According to him, two out of the suspects were said to have undergone training in Libya. The suspects said they were trained in Libya on musketry and how to disarm members of the Armed Forces and police, including other terrorism-related training. He said laptops with video clips of explosives’ production and manuals of how other dangerous weapons are made, was recovered from them. Mba said, “From our analysis, we discovered that the suspects are composed of persons from different states and backgrounds. They are all males with an average age of 30. The oldest is 46 while the youngest is 20. The youngest played the key role in the whole operation. “We discovered that there are external collaborators because one of them is from Niger Republic. The gang are also supported by local criminals and operators because the plan was orchestrated by someone from Katsina State.” He called for stringent legislation to tackle the menace of kidnapping and cattle rustling. He said, “We are using this opportunity to call for the strengthening of the legislation as it relates to the crime of kidnapping and cattle rustling. The CAC compliance officer informed the court that the late king’s signature and the defendant’s signature were appended in CAC forms in the years 2011 and 2012. THE Police Special Fraud Unit (SFU) has alleged at an Ikeja Special Offences Court that late Oba Afolabi James of Kweme, Badagry in Lagos, mysteriously signed some Corporate Affairs Commission (CAC) forms in 2011, nine years after his death. The king died on Jan. 30, 2002. The SFU claimed that while investigating Semasa James, a son to the late king, accused of defrauding his 26 siblings of their N500 million inheritance, they uncovered suspicious signatures purportedly signed by the dead king in documents of CAJ Industrial Enterprises, the deceased’s company. The News Agency of Nigeria (NAN) reports that on Friday during trial of Semasa and Afolabi Kazeem, his personal assistant over the alleged fraud, Mr Oluwafemi Olabisi, the Prosecutor for the SFU in order to prove that the king’s signature on the company’s document was forged, had subpoenaed the CAC as a witness. Representing the CAC was Mr Christopher Etim, a compliance officer, who testified as the 13the prosecution witness. While being led in evidence by Olabisi, Etim said that he had brought before the court, copies of some CAC documents namely; Form CAC 2.1 – particulars of company secretary- Form CAC 3 -change of registered address and Form CAC 7, particulars of directors. The CAC compliance officer informed the court that the late king’s signature and the defendant’s signature were appended in CAC forms in the years 2011 and 2012. Etim said: “In form CAC 7, James Afolabi Ogungbe, the late king is named as the first director; the second director is named James Kola Semasa, the first defendant. “On the column for remarks: it states appointed, and there are no directors aside the first and second directors. “The signature on the second page belongs to James Afolabi Ogungbe and the signature was signed on Nov. 28, 2011. “The resolution is signed by the first director James Afolabi Ogungbe. I arrived at that conclusion from Form CAC 7. “Form CAC 2.1, is particulars of persons who is the company secretary of the company or any person therein, it was signed by Mr James Kola Semasa and Mr James Afolabi Ogungbe on March 21, 2012. “Form CAC 3, is the notice of situation or change of registered address. “Mr James Kola Semasa signed as a director in this form and there is a resolution attached to same, signed by Mr James Kola Semasa and Mr James Afolabi Ogungbe on Nov. 24, 2016.” While being cross-examined by the defence counsel, Mr Martin Oyigbo, Etim reiterated that although he was not a signature or handwriting expert, as a legal practitioner and compliance officer, he was conversant with the documents he presented before the court. The witness also emphasised that the signatures in all the CAC forms he presented before the court were consistent and the same. “When documents are presented for verification, all these stamps are not on it. The SFU prosecutor also threw some light on Kazeem’s alleged role as an accomplice in defrauding the late king’s estate. “Sometime in 2017 in Lagos, Semasa and Kazeem fraudulently tricked and cheated the beneficiaries of the late king of N150 million which was part of the proceeds of sale of a property, located at Dideolu Estate, Victoria Island, Lagos,” Olabisi said. The prosecutor noted that Semasa had also forged a purchase receipt, dated Nov. 15, 2004 and an undated deed of assignment between himself, Bolarinwa James, Mrs Alakija – nee James, Hon. … Killed 20 farmers, 9 others BOKO HARAM insurgents on Wednesday evening launched attack on a military base in Goniri town, Gujba local government area of Yobe state, locals and security sources have confirmed. According to Daily Trust report, the attackers stormed the town around 6:00pm, in gun trucks and headed directly to the military location. “I cannot tell the number of gun trucks they drove in to carry out the attack but I saw many”, a resident who escaped the area said. He said the insurgents engaged the military in gun dual for over two hours before the gunfire subsided. “There is no sound of gunshot and the town is silent,” he said. Lagos State Police command on Sunday has arrested a fish farmer, Jeremiah Obifor, 61, for allegedly cutting off the hand of an 11-year-old boy, Goodluck Amechi. According to the police Public Relations Officet in the state, DSP Bala Elkana said, the man cut off the boy’s hand who he suspected had come to steal his fish. Elkana said that the suspect was arrested after the victim’s foster mother, Doris Isaac, reported the matter at the Okoko, Police Station. He said that on June 7 at about 12:20pm the boy’s foster mother who resided at No.6 Ajanaku Street, Okoko, reported the matter at the Okoko police station. The police spokesperson said that Obifor attacked the 11-year-old boy with a machete and cut off his right hand. “The victim was rushed to Igando General Hospital. “The suspect alleged that he saw the victim around his fish pond and thought that he came to steal his fish and that was why he attacked him. “Investigation is ongoing and the suspect will be charged to court.” he said. In a similar development, a two-man squad of motorcycle snatching syndicate was arrested on June 8 and arms recovered from them. Elkana said one Mohammed Faruk of No. 37 Teslim Street, Bariga, alleged at Sabo Police Station that Tobi Onileowo, 26; and Olakunle Ayo, 25 shot him with a gun while attempting to snatch his motorcycle. “A team of police officers led by the Divisional Police Officer, Sabo, CSP Chike Ibe. swung into action immediately. “The suspects engaged the team in a gun battle but were subdued. Tobi Onileowo was arrested while Olakunle Ayo was fatally injured. “One double barrel pistol with two expended cartridges and one live cartridge were recovered from the suspects. Sikiru Obarayese WHAT many have considered absolutely unusual happened in Osogbo last week Saturday, as a three year-old girl, Atinuke Sodiq saved a physically challenged old woman and another 100 year-old one from fire outbreak that engulfed their house in Osogbo, Odun state capital. The house, owned by a late popular local drummer, Adebisi Mukaila popularly known as Shittu Okanjua situated at 38, Olohuntobi Community, Honesty area, Oke-Baale, Osogbo. According to eyewitness account, no one could explain the exact cause of the fire incident which started around 4 PM Saturday, but the efforts of the girl in calling for help saved the old women. Properties worth millions of naira were reportedly lost to the inferno that lasted for almost 4 hours. It was gathered that the two aged women who could not walk were in the house unknowing that fire has gutten a part if the building. Atinuke, the three year-old girl saw the fire and ran inside the house and alert the physically challenged woman who is in her 60’s known as Iya Sodiq and subsequently called for help from the neighbourhood. Before the fire could engulf the main door of the building, it was gathered that some people at the neighbourhood rescued the two women from the fire. One of the victim’s family who narrated the incident to Nigeria Happenings at the scene, noted that they informed the men of Nigeria Fire Services but they did not respond on time, which resulted to flamed down of the house. “We called the fire service in Osun, but their water tanker got spoilt along the road, hence, they came very late. Maybe, they would have saved some properties”, a relative of Mrs. Mulikatu Adebisi narrated. She revealed that men of the fire service later called for another water tanker which came but after the fire had consumed the building. A victim, Mulikatu told this medium that she has lost everything to the incident, saying that everything she owned was burnt in the house. Sidi said this in Abuja on Wednesday during a surveillance activity of the department to some fuel stations. He said that the action was to ensure that all commercial transactions involving the use of weights and measures were accurate, fair and legal. “Every weighing equipment in all sectors of the economy, whether oil and gas or non- oil and gas must be up to the required standard, ” Sidi said. At Forte Oil Station, Maitama, opposite Transcorp Hilton, Abuja, the team found that customers lost 0.5 litres of fuel in every 20 litres they bought. The team sealed three of the dispensing pumps and collected their certificate of clarification. “This is because the officials of Weights and Measures discovered that for every 20 litres of fuel dispensed to customers of the filling station, not less than 0.5 litres was found to be a shortage to customers. “We have 33 litres in a truck and when for every 20 litres, it is short with 0.5 litres which means that in a truck they will be making a profit of N198,500 per truck,” Sidi said. The team also visited Forte Oil station at Ibrahim Babangida Boulevard, opposite National Universities Commission and found that customers were cheated by the same quantity of fuel. The team sealed three dispensing pumps for oil and one for diesel. At Dan Oil on Airport Road, the team found that customers lost 0.6 litres for every 20 litres bought and sealed three petrol pumps and one diesel pump. At the filling station, the attendants quickly adjusted some pumps immediately they sighted the officials. The managers at all the stations refused to comment. The team also visited Mabushi District cement depot and certified bags of cement found in the place as having the right quantity. The bags of cement checked were Bua, Dangote and Sokoto cement products. The Chairman of the depot Mr Maxwell Nnamani said that the depot always maintained standards and urged other dealers to do same. Nnamani said that although the issue of re-bagging had been a problem in the industry, it was being addressed. The team also visited the 7UP Company at Idu Industrial Area to measure different products. At ShopRite mall at the Jabi Lake, the team expressed satisfaction after measuring different products. “We are happy because there is a lot of improvement from the non-oil sectors compared to what we witnessed before,’ Sidi said. He appealed to members of the public report any suspected discrepancies by products’ dealers to the department to enable it to do its job better. Obas Adekunle, Osogbo JUSTICE A.O Ayoola of the of an Osogbo High court has ordered the Nigeria Police Force to pay a chieftain of Peoples Democratic Party (PDP) Alhaji Fatai Diekola, Segun Adekilekun and Sikiru Lawal N3 Million Naira damages each for infringing on their human rights. The court, in its ruling maintained that Police violated the right of Fatai and two others as they were illegally detained on September 24th, 2018 after they reported an allege assault on their person by All Progressives Congress (APC) thugs at Alekuwodo ahead of the Governorship rerun held on 27th of September, 2018. The court also ordered the Police to place public apology in major Nigerian newspapers. Responding to the judgement, the defendant Lawyer, Barrister Bukola Onifade commended the judiciary for standing firm to defend the right of the oppressed masses of the country.
