Good day VO,

Currently had my immigrant visa interview and it was ok but the officer ask me to send in additional documents (police report and affidavit of support ) through DHL which I am ready to send out to the embassy.

My question now is, should I send the documents together with my passport or should I just send the documents alone ?

Thanks for your guidance, I did as you suggested and called the NVC 2 times and got 2 different answers.  The first person stated that I129F was available to my spouse and child to apply for a k3 and k4 while await for the I130 to be approve in then an apply for an adjustment of status. However is the child does not have an I130 he/she is not eligible for K4. I did not understand so I decided to call back to get clarification now I am more confused.

The second person stated that the I130 is not needed for child to receive the K4 visa. I asked if the could put an administrative  hold on I130 so that the I129F can be processed. She said there is not away because of the time frame. I applied for the I130 in March 2014 which gives it almost 6 months and the I129F in April which gives it wait time almost 5 months. When I check the status on the website I can only get information on The I129F. I now getting all the documents ready to apply for my stepson I130. My fear is that we will be waiting another 6 or so months after my spouses I130.

I am so disappointed in the NVC because as a USA citizen I thought I was being guided in the best way to handle my case and now I am more confused then ever. However VO I have watched your threads on this site for months and I am very thankful for your assistance and dedications you have shown to all of us. again thank you.

Thanks for your time and patients with all my question. I need some clarification.   As I getting documents ready for my husband I was told

"What the USCIS never tells anyone is that the K3 is obsolete and rarely granted.  How it works is: You file your I-130, when you get the NOA1 you file the I-129F.  The I-129F pulls the I-130 out of line and puts it with the I-130.   They go to the back of the line.  They're,  generally, adjudicated together.  This is USCIS policy.  If the I-129F happens to make it to the National Visa Center, before the I-130, the NVC will leave it open and send it on to the consulate or embassy as a K3.  A consulate or embassy may then close the I-129F if there is already an approved I-130 on hand  If the I-130 reaches the NVC before the I-129F the NVC administratively closes the I-129F (and any derivative status for children ends) and continues on the I-130 route which becomes an IR1/CR1 visa path".

Is this is correct? I have not filed an I130 for my stepson   So confused if this is possible I feel I was given the wrong information as we are in our 5 month of waiting. Please help any suggestions is welcome. Thanks.

I am married to a Nigerian man and I filed I-130 and then filed I-129f k3 which was advised by USCIS customer service center on.  April 28, 2014 my application was accepted. I was told the process was about 5 months. However, I was reading your post and you wrote “K3 Personally, I don't understand why people do that. The waiting period for spouses isn't very long, so you're spending money and losing the privileges of the CR-1 visa just to gain an insignificant amount of time.” The reason I am so confused 1) I filed the k3 and k4 because my stepson is traveling with my husband.  2) I did not file an I-130 for my stepson, will that stop my stepson from traveling at the same time as my husband if the I-130 is approved at the same time. 3) Can you tell me what the estimated wait time for my husband on an I-130 and I-129f K3. And is the wait time on track for 5 months…..or sooner would be great . I am an American and I thank you for taking the time to give nairalanders valuable information on the visa process. I am a USA Citizen my husband is from Nigeria, I filed for my husband using form I-130  and received receipt I-797 which I sent the form I-129 K3 for my husband and K4 for my stepson. My question is when I spoke to the USCI customer service center they guide me to filed this way. However as I read online the I-129f is no longer valid. Is this true? Or the  I-130 can process before the I-129f or  at the same time witch would eliminate the I-129f. So what would happen to my stepson if a I-130 have not been filed for him. Do I need to file this before the process or can I still file for him once he comes to the USA. If I file now will He have to wait until its process or can it catch up to the I-130 I filed for my husband I really need some guidance thanks
