Politics › Kogi Election: Policemen Flee As Thugs Break Into Polling Unit by References(op): 3:12pm On Nov 16, 2019
Policemen deployed at polling unit 006, Asuta ward, Kabba/Bunu local government area of Kogi state, fled on Saturday after suspected thugs took over the unit.

At least five of the officers escaped through a nearby bush shortly after irate youth surrounded the voting area, destroying election materials.

The rate of violence has been high in Kabba/Bunu, where senatorial and governorship elections are holding.

TheCable had reported how officials of the Independent National Electoral Commission (INEC) abandoned polling unit 001, Asuta ward in Kabba/Bunu following beating from suspected thugs.

Voting ended before 11am but some persons in the community disrupted the exercise, forcing the electoral officials to leave their duty post.

When TheCable got there at 2pm, counting of votes had not commenced.

At polling unit 006, Asuta ward, still in Kabba/Bunu, voting has ended but INEC ad hoc staff complained about violence.

At units 001 and 006, Asuta ward, Kabba/Bunu, votes were being counted with the Peoples Democratic Party (PDP) leading when some youth started pouring water and drinks on the ballot papers.

Journalists and INEC ad hoc staff were threatened and chased away.

There were also reports of destruction of ballot papers across polling units in Ijumu local government areas in Kogi.

Politics › Edo APC Youths back Obaseki, lash Oshiomhole by References(op): 10:25pm On Nov 15, 2019
The Edo youths wing of All Progressives Congress (APC) have threw their weights behind governor Godwin Obaseki in his quest to get the party’s governorship ticket come 2020.

The group said they supported former Governor Adams Oshiomhole to have a peaceful eight years in office and as such they would not allow any group or persons to stop Governor Obaseki.

Speaking with journalists Friday in Benin, the state Youth Leader of the party, Valentine Asuen said Governor Obaseki has performed beyond expectations in all sectors of the state economy.

While dismissing the purported letter the National Working Committee of the APC relied upon to uphold the suspension of the State Chairman of the party, Anselm Ojezua, he urged the NWC to disregard the letter saying the signatories were fake as they were obtained under duress.

“Governor Obaseki has done well in the education sector, health sector, transportation, rule of law and most especially the revenue profile of the state. We are not going to abandon him,”

He said Edo is the only state now that the local government can pay salaries without waiting for money from the federation account, noting that those fighting Obaseki are those that have been feeding fat from the state revenue.

“We are with Obaseki and we will mobilise Edo APC Youths to ensure Obaseki gets the needed support. Edo can not afford to go back to the days of the locust. We will not allow them to succeed,” he said.

Politics › Appeal Court Dismisses Ogboru’s Appeal, Upholds Okowa’s Victory As Delta Gov by References(op): 2:14pm On Nov 15, 2019
The Court of Appeal in Abuja has dismissed the case filed by the candidate of the All Progressives Congress (APC), Great Ogboru on the March 2019 Governorship Elections in Delta state for lacking in merit.

A unanimous decision by a panel of five justices affirmed the decisions of the tribunal which upheld the victory of Ifeanyi Okowa as Governor of the state.

Mr. Ogboru had approached the appellate court in a bid to upturn the September judgement of the elections tribunal that dismissed its petition seeking the cancellation of the March 2019 elections in which Okowa was declared a winner for lacking in merit.

The APC candidate who appealed on 37 grounds stated that the tribunal erred on the point of law.

He contended that the total number of votes declared for the PDP candidate outnumbered the total number of accredited voters during the elections.

But the appeal court ruled in favour of the respondent, Ifeanyi Okowa on the ground that the appellant is unable to prove the case.

The panel also held that the appellant was unable to mention at least one accredited voters who did not vote in the election, nor was he able to call at least an agent of the political party who on the point of law is the most qualified person to testify in a case of over-voting.

The court, however, dismissed the entire appeal for lacking in merit.

It affirmed the decisions of the tribunal which upheld the victory of Ifeanyi Okowa in the March 2019 governorship election.

No cost was however awarded against the appellant.

At the Court of Appeal, the APC Deputy Governorship candidate was represented by D. D. Dodo SAN.

Degi- Eremienyo who was represented by D.D Dodo was granted the following reliefs:

Politics › 'NWC has been running party illegally' – PGF DG by References(op): 3:48pm On Nov 14, 2019
The Director-General of the Progressive Governors’ Forum (PGF), Salihu Moh Lukman, on Thursday, said the National Working Committee (NWC) of the ruling All Progressives Congress (APC) has been running the party illegally.

Speaking to journalists during a briefing in Abuja, Lukman, who had earlier called on the party’s National Chairman, Comrade Adams Oshiomhole, to resign if he would not convene the National Executive Council (NEC) meeting, also reaffirmed his earlier call, saying his call was a summation of most stakeholders of the party.

The PGF DG, who clarified that the call he made to Oshiomhole was not the party’s governor’s forum message, but his own as a loyal member of the party, also noted that the refusal of the NWC to allow the party to function as its constitution prescribed had been the reason the party had been bogged down by multiple crises.

Lukman, who also predicted a reincarnation of the Zamfara scenario in Bayelsa state if the NEC is not immediately convened to step in and get all aggrieved parties sorted out, Comrade Oshiomhole, considering the way he is running the party, creating distractions to President Muhammadu Buhari’s government, even after the president had indicated lack of interest in interfering in party matters.

“The issue here is that every day the NWC, under Comrade Adams Oshiomhole, continues to run the affairs of the party, without convening NEC meetings, it is working illegally. If you read the (Oshiomhole’s inaugural) speech, he made the commitment that he would run the affairs of the party based on the Constitution. Now, the last time we had a NEC meeting was in August 2018.

“By the Constitution, the NWC, which is today run by Oshiomhole, which is an administrative organ, derives its powers from the decisions of superior organs. It is supposed to be a meeting to map out strategies in terms of how to implement decisions of the NEC and National Convention would have taken and then met monthly to review progress and report progress in the next quarter in terms of implementation. That has not happened.

“I’m hoping that with respect to the judgment about the Bayelsa deputy governorship, appropriate steps will be taken to vacate the judgment. Has that happened? It has not. We are living with the danger of Zamfara being reenacted. We can win the election in Bayelsa and then court judgment will come later to say we didn’t have candidate.

“My point is that the Comrade Adams I know is a field worker, by now Comrade Adams would have been in Bayelsa, holding meetings with aggrieved parties to reconcile them. Since he became the National Chairman of the party I’m not sure he has visited any state with the purpose of sitting down to reconcile aggrieved parties.

“My final word is that, and it is an appeal to Comrade Adams again, he should be fair to President Buhari. President Buhari has shown that he’s not interested in interfering with party affairs and he has demonstrated full confidence in the ability of party leaders to manage the party. It will amount to creating distraction to be having problems that the party allows to linger.

“My final appeal will be that all our party leaders need to rise up and really insist that a National Executive Council meeting needs to be convened. A situation where affairs of the party are run almost like a contest of mob has to stop.”

Politics › Supreme Court to state reasons for Buhari-Atiku election judgment Friday by References(op): 9:14pm On Nov 13, 2019
The Supreme Court will on Friday, November 15, state reasons for its judgment dismissing the appeal filed by the People’s Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, against the declaration of President Muhammad Buhari as the winner of the Febraury 23 presidential election.

Already, notice has been issued by the apex court notifying all parties of the date.

The said notice issued by the Ibrahim Gold and dated November 13, 2019 reads: “The reasons for the judgment delivered on Wednesday the 30th day of October 2019 in appeal no SC1211/2019: Atiku Abubakar, INEC & 2 others will be listed before the Supreme Court of Nigeria on Friday the 15th day of November, 2019 at 9.00 am.

“And further take notice that in accordance with the Supreme Court Rules, this Notice is deemed sufficiently served on you if it is delivered on your telephone.”

The Supreme Court had in its summary judgment dismissed the appeal by the PDP and Atiku Abubakar, its candidate, against the re-election of President Muhammadu Buhari.

The seven-member panel led by Justice Tanko Mohammed held that having gone through all the documents and exhibits two weeks ago, the panel discovered that the appeal lacks merit.

“We have examined the submissions of parties in this matter and the exhibit adduced and we have come to a conclusion that this appeal lacks merit, appeal is hereby dismissed.

“A date for reason would be communicated to the parties,” Mr Mohammed ruled.

Mr Abubakar and his party, on September 23, filed 66 grounds of appeal before the Supreme Court after the presidential election petition tribunal at the Court of Appeal on September 11 dismissed their petition against Mr Buhari’s re-election.

Following the tribunal’s judgment affirming the re-election of President Buhari, the PDP filed its request before the apex court challenging the decision.

The PDP and Mr Abubakar said the Court of Appeal panel that heard their petition erred in law when it ruled that President Buhari did not need to submit an actual certificate to INEC as part of documents in his CF001.

The PDP also said the presidential tribunal erred when it ruled that the PDP did not provide sufficient evidence to back its claim that Mr Buhari did not attend a secondary school among other issues.

During the court hearing on Wednesday, before the seven-member panel read its about one-minute decision, lawyers in the matter had argued why the appeal should or should not be dismissed.

The lead lawyer representing the petitioners, Levy Uzoukwu, while trying to prove his point started with the issue of Mr Buhari’s qualification.

He said it is on record that the second respondent failed to give any explanation between the first name of the respondent which is ‘Muhammadu’ and the first name appearing on the picture which was tendered as exhibit R19/R21, which is ‘Mohamed’.

Mr Uzoukwu backing up his argument said the lower court speculated that the name belongs to the second respondent with “No reason, no evidence,” he added.

The senior counsel, presenting the issue of Mr Buhari’s certificate, also said no reason was given by Mr Buhari on record why it is impossible to bring forth any of the three certificates he claimed he possessed.

“Nobody, not even his witness could give evidence that they have seen the original, Certified True Copy (CTC) or photocopy.

“In the same vein, Mr Buhari claimed he had primary school certificate, there is no testimony from the primary and secondary schoool he claimed he attended. Not even a qualification from Cadet,” Mr Uzoukwu said.

On the issue of server, Mr Uzoukwu said the electoral umpire denied having a server but “I submit that if the first respondent appreciates, he should never have denied its existence because they failed to call witnesses, they failed to establish where they store card reader data and Permanent Voters Card (PVC) data.”

According to Mr Atiku’s lawyer, the Independent National Electoral Commission’s (INEC) counsel relied on section 52(2) of the Electoral Act to contend that electronic election is prohibited in the country.

Mr Uzoukwu said the provision INEC relied on was amended and deleted and replaced by another provision in 2015, that is that there is a new section 52(2), he explained.

“The lower court relied on the old provision and we did draw the attention of the lower court on this issue. The new provision has not been interpreted or applied by this or any other court. I urge the court to allow the appeal,” Mr Uzoukwu pleaded.

Responding, the lawyer to INEC, Yunus Usman, said the first respondent would adopt its brief of argument filed October 12 but submitted that “the appellants have woefully failed to prove that the first appellant scored the majority of lawful votes cast at the election.

“This is because out of over 191,000 polling units(PU), they called only five PU agents to prove that they scored the majority of the lawful votes cast, when the requirement of the law is that a PU agent must be called to testify in each of the PU across the country. I do not know why they are here. The failure to do so is fatal to their case,” Mr Usman added.

Replying to the PDP on the issue of server, Mr Usman said neither of the appellants has proved the particular server they created in March after the election titled www.factsdontlie.com.

”Until the Electoral Act is amended, INEC does not have the power to transmit electronically.

“We urge the court to dismiss the appeal with substantial cost.”

When asked about section 55(2) of the Electoral Act, Mr Usman said the section allows INEC to conduct voting in an election either electronically or manually, and that the first respondent chose manually.

On his part, Mr Buhari’s lawyers led by Wole Olanipekun said they would also adopt their brief of argument filed October 15 and urged the court to dismiss the appeal which, he further said, should not have been brought before the court after the painstaking decision of the Appeal Court.

Mr Olanipekun said Mr Uzoukwu tried “to make a mountain out of a molehill, without distinction. According to him, nobody gave an explanation to the difference between ‘Muhammadu’ and ‘Mohamed’.

“He who lives in a glass house does not throw stones. The same lower court ruled in favour of the second respondent, where it held that Levi is the same as Livinus.

“The Constitution has prescribed what a candidate should provide while vying for a position,” Mr Olanipekun added.

“On the issue of server they said no member of the appeal panel made findings that INEC had a server. The finding is that there is a website managed and controlled by the electoral umpire.

“Under the evidence act, if there was a server, it should have been tendered because it would be a public document, the court cannot speculate.”

Citing a case to buttress his point, the senior counsel submitted that there was nothing in the case, stressing that law is not about sentiment.

The All Progressive Congress (APC) lawyer, Lateef Fagbemi, on his part also relied on the process too and urged the court to dismiss the appeal and “as well as the court can carry it, throw it,” he added.

In addition, on the issue of name, he said the appellant did not mention it in their petition.

”The petition is innocent of this averment.”

“On the issue of qualification, I submit with respect that section 318 of the Constitution spells out what the person vying for the presidency must have.”

After all arguments by lawyers in the matter, the court stood down for about 20 minutes and returned to dismiss the appeal. The court said its reasons for the decision would be given on a later date to be communicated to the counsels.

Politics › Radio Bayelsa Staff Killed As Political Thugs Clash by References(op): 6:28pm On Nov 13, 2019
.......Journalists trapped in campaign venue

A driver of Outside Broadcasting Van (OB Van) attached to Radio Bayelsa, Simon Onu, has been reportedly killed in a clash between thugs of the Peoples Democratic Party (PDP) and the All Progressives Congress (APC) in Bayelsa State.

Onu was reportedly hit by one of the stray bullets that flew uncontrollably at the local government area following sustained gunshots by the thugs.

Many others were said to have sustained injuries while trying to escape from the violent scene.

Fidelis Soriwei, the Chief Press Secretary (CPS) to Governor Seriake Dickson, who confirmed the death of Onu blamed the incident on the activities of APC thugs.

But sources from the APC said some PDP leaders, who came for a rally at Nembe imported thugs that carried out the attacks to intimidate members of the APC in the area known to be the party’s stronghold.

The rally, which Dickson was expected to attend in Nembe Ogbolomabiri was said to have been disrupted by massive shootouts described by sources as a replica of a war movie.

It was learnt that there was pandemonium in Ogbolomabiri as people fled to different direction for safety.

A source, who spoke in confidence, said serious shooting by unidentified armed men rocked the King Koko Square, venue of the PDP governorship campaign while supporters were waiting for the arrival of dignitaries.

He said: “Some journalists covering the rally were also caught in the cross fire as many others have sustained different degree of injury. Governor Seriake Dickson was billed to attend the rally in company with the candidate of the party, Senator Douye Diri”.

Soriwei in a Facebook post said thugs led by some APC leaders fired at members of the PDP in a bid to prevent the gubernatorial rally of the party.

He said: “The attackers also opened fire at the Protocol bus of the Bayelsa State Government House at a junction between Bassambiri and Ogbolomabiri.

“One of the PDP members died of gunshot injuries while several others sustained serious injuries and have been rushed to the hospital.

“Meanwhile, Bayelsa State Governor, Henry Seriake Dickson, has insisted that the rally must go on. The Governor who condemned the violence urged the security agencies to take full control of the situation for the PDP rally to hold peacefully”.

But the Director-General, TimireSylva Support Organisation, Wilfred Ogbotobo, said that the PDP members were the aggressors adding that the party leaders invaded the community with thugs to chase away members of the APC.

Ogbotobo said some APC members were injured in the attack wondering the reason for the campaign in Nembe when the party rounded off their rallies with a grand finale held in Yenagoa.

He said: “The PDP leaders did not go to Nembe for any campaign. It was a premeditated plan to chase out APC members and supporters from the community, having realized their rejection and imminent failure at the poll.

“As soon as they arrived the community they started chanting war songs, destroying APC banners and billboards and taunted APC members in their support bases.

They came with weapon wielding mercenaries from other places in Police and other military uniforms who started harassing APC members without provocation.

“Their intentions were to precipitate crisis and render the whole Nembe unsafe for the election. The public should disregard their habitual lies and infantile propaganda. Nembe people have rejected Seriake Dickson and his restoration agenda.

“They are known trouble mongers. They are out to deceive their master to get quick cash. They know quite well that Nembe is too big a place that they can easily conquer for their failed Dickson”.

Also members of the APC accused a member of the Bayelsa State House of Assembly elected on the platform of PDP of leading a violent attack against them at Igbogene, the residential area of the APC Candidate, David Lyon in Yenagoa.

They said some of them sustained injuries from the attack and called on security agencies especially the police to arrest the lawmaker.

Efforts to reach the Police Public Relations Officer (PPRO), Asinim Butswat, proved abortive as he could not answer calls routed to his telephone.

Crime › Police Foil Robbery Attempt At CBN In Benin by References(op): 8:00pm On Nov 12, 2019
Police in Benin City on Tuesday evening, repelled an attempt by armed robbers to attack the Central Bank of Nigeria (CBN), Benin branch.

The ugly incident, which happened at King Square (the city center), saw the attempt by the robbery gang trying to break into the bank when a bullion van carrying cash to an unknown commercial bank was about leaving the CBN premises.

The hoodlums were, however, repelled by the armed police security team attached to the bank.

The exchange of gunfire between the bank security and the robbers that lasted few minutes forced the robbers to retreat and escape, while people and motorists around scampered for safety.

An eyewitness told DAILY POST that luck ran out of the robbers who may have been prepared for the worse.

“Bros, the robbers were ready for anything but the police also showed them that they were super ready for them.

“You can see how unusual the environment is for now, this whole place was locked down, traffic was heavy here due to the attack. How can robbers come to this place, the centre of our capital city, place like Ring Road. I think the state government has to do something about the security of this state, especially now that Xmas is around the corner, thank God that no casualty was recorded in gun duel.
