After my study in Canada..if I apply for my 1yr pgwp and my wife applies for a study permit within Canada I’m I still eligible for a spousal open work permit after previously getting my pgwp?

most important step is you need to go on the canadian gov website and read the requirements. this is so you know the facts and are basing your decision on facts not he said/she said. Processing time for outland spousal sponsorship is 13 months currently i believe. Regarding which path, that is up to you/finances/circumstances. It will certainly be easier if you are together with your spouse in canada while things are processing. if you can get a visit visa and have your wife with you, that is great. Then you can apply for spousal sponsorship inside canada-processing time 10 months. You will have to extend the visit visa, as it is valid for only 6 months stay in 1 year. and your wife cannot work on visit visa.

the other option is outland process-this means you are in canada and wife remains in nigeria. processing time 13 months. There is currently a program to make it easier for your spouse abroad to get visit visa quickly once you have applied for spousal sponsorship and received AOR( acknowledgment that your application was received). This program was introduced may 2023. before that, it was difficult to get your spouse to visit. that has changed now. Then in this case, once she arrives, she can apply for open work permit (although this is now taking long too) or your spouse can at least be visiting you.

There is no set amount for spousal sponsorship. the timeline for inland or outland are not so different (exception: if you are a quebec applicant). But of course, everyone wishes to have their spouse with them, potentially 1 year of seperation is not easy. the main issue is in outland, you may be assigned to slow visa offices like accra office and their timeline can be unpredictable and slower than average processing times.

What is the program that was introduced in May 2023?

The wife in Canada must not renew her visit visa and she should apply for work permit alongside the sponsorship app. The main thing is to get the VV and on record time.

yes your spouse should be living with you in canada. You should try to apply for visit visa since it is easier now for spouses in the process of spousal sponsorship. then when your spouse arrives then you can apply for the work permit

In addition to this proof of living expenses, applicants are to provide proof of their first year of tuition and other travel costs.

Scenarios with estimatated one year tuition fees of 20,000 (depending on the school) & minimum travel cost per person of $2000 CAD based on the new cost of living:

Single applicant:

Tution Fees. - $20,000
Living Expenses - $20,636
Transportation. - $2,000
Minimum Funds Required = $42,536.

Family of 2:

Tution Fees. - $20,000
Living Expense. - $25,691
Transportatiońn. -$4,000
Minimum Funds Required=$49,691

Family of 4:

Tution Fees. - $20,000
Living Expense. - $38,346
Transportation. - $8,000
|Minimum Funds Required=$66,346

Note that the tuition fee can vary depending on the school and course but the rest funds are the minimum required.

What the above implies is that relocating to Canada through study route is no longer a joke but has to be taking with total seriousness and commitment whilst you provide more genuine documents to proof your financial capability to fund the study and strong home tie that you'll return to your home country on completing the study.

Let it be known that when you applied for admission, you did that for yourself alone, but when applying for visa, you can include your family (spouse and children) for your study visa

On that note, your visa application shall then largely be determined by three things:

* Purpose of study
* Proof of funds
* Home ties

These three things are the expectations for single applicants as well, but if applying as a family, you have a stronger justification to make. You will need to show adequate funds to cater for the family, justify the importance of having family members with you, and that you have other ties to your country.

Purpose of study:

In your study plan/letter of explanation, you will need to convincingly explain the reasons you chose to study in Canada and why your spouse & children should accompany you to Canada.

Your children can apply for a visitor/study permit (depending on age), and spouse, a visitor/work permit (depending on what they intend to do in Canada)

NB: If you are a student going to a school/program that is not eligible for a post-graduation work permit (PGWP), your spouse is not eligible for the spousal open work permit (SOWP).

This is one of the important reasons to ensure the program you apply for is eligible for PGWP. The study plan helps you to justify the purpose of your study & the importance of having your family with you so that your spouse can work and support the family while you're are studying.

Other reasons could be anything from the fact that your children are young, or your family has never been apart before. Family unification is important to Canada, so you can leverage on that.

Proof of funds (POF)

If you intend to apply with your family, you will have to pay extra application fees & also show more POF than a single applicant. You must also show that you have sufficient funds to support yourself & the family members accompanying you without working in Canada. You are expected to show enough to cover your tuition and living expenses as the student; and the additional funds for the living expenses of those accompanying you. And the total funds you need will depend on your own family number.

Proof of home ties, this is very crucial and an important aspect of the Canadian study visa application owing to the fact that many applicants have been denied based on insufficient proof of home ties, that simply means having sufficient fund is not enough to guarantee your visa approval. As an international student, you are a temporary resident & need to show that you have reasons to leave Canada after your study (if required to do so).

IRCC wants to see evidence of your home ties. Many applicants find it easier to use their family members as part of their home ties. But in the case you're applying with your family, it means you must be ready to show other ties.

It could be your business, investments, employment, financial assets and most importantly landed properties (which are mostly preferred cos they hardly depreciate in value but appreciate more over time).

I don't want to go into details so my partner doesn't trace this to me.

My partner came to UK before me, though still on student visa. I joined her with my 3 children one months ago.

I have noticed some red flags which never happened while we where in Nigeria and I was footing the bills alone.

Each red flag, I pretend nothing happened because I don't want to be thrown out like the man I read about on social media.

My visa is dependent on hers and we are still on student visa.

My question, in the event that we get papers to stay permanently in UK and one day she decides to send me packing or I decide move out, will I be asked to return to Nigeria because she is the main applicant?

Please I need urgent answers. I may not play the fool for long. We are very certain of getting papers next year.

1. Yes, you can apply for a sowp. Don't cancel the vv application, as it could even expedite the process.

2. Amongst others, you need documents showing strong home ties like your siblings, parents, parents-in-law, professional associations, investments & real property.

* If her study permit is open until June 2024, it means you can apply for SOWP. and she need to show evidence of available finance to support you whilst she studies.
* Depending on her course length year, if it's above 1 year then she ought to have more than a year study permit stamp. Whichever is the case scenario her study permit is her legal temporary stay in Canada and if expires and her study is finished, she will not be able to extend her visa and you won't be eligible to apply for SOWP.

If an adult forgot to mention a Previous denial what do you have to do going to the country in first place. You didn't forget, you try to use Nigeria mindset which they don't even take slightly with. Honesty beats out of imagination. 5 years ago, you may be lucky to evade 5 years extra join.

Good morning everyone, my husband applied for spousal work permit and study visa for my children and got denied yesterday. Attached is the refusal letter. What should I do now. We want to apply again as soon as possible. He was denied US visiting visa 5 years ago and got denied in September for Canada spousal work permit. But we forgot to mention he was denied while filling the form

Your hubby can apply for his visa from his home country. Even if you can apply from there, his application will be taken back to the visa office that are in charge of processing applications from his country of residence. So, its best he applies from his end.

You can apply together and on his behalf using your own mycic account he will need to sign the use of representative form..you as his representative..

Thanks for your response, I didn't include the SS application's AOR when I submitted the TRV application. I thought their system will automatically detect the dual intent. Moreover, I was of the opinion, its when you get to Canada and want to convert the TRV to an open work permit, that's when its mandatory to include the SS AOR. Is it too late to submit via the webform?

In the same process, There is no special way of applying for spousal TRV - normal TRV application. IRCC confirmed to me that I need to indicate that my spouse has an open PR application (SS) and include the AOR when submitting the TRV application. There was no clear explanation why some are processed within 30 days and others take longer. I never got a clear reason from them and always got referred to the general reason link for delays (security and background check).

With your confirmation of what is stated in the GCMS note, I cannot fathom the reason for the delays. Although, I know IRCC processing normally slows down toward the end of the year, but it still doesn't make sense.

Yes i did but still no update on it.
I haven’t seen anyone with an update as well. Just hoping this SS comes out soonest coz 6months is almost here.
