General observation: There is a concern of recent rising number of inappropriately adjudicated visa application cases resulting in refusals for a number of potentially genuine visitors to UK. This is evident from error laden refusal letters issued out. Suggestion Those that believe they have been unfairly refused based on incorrect assertions provided in their refusal letters should in addition to the standard complaint pathway, advice those who invited them/sponsor (especially if they be citizens or permanent residents) to write to either their MPs or one of the MPs on the home affairs committee detailing their concern. I will also be writing this concern to the chair of the Home affairs committee as well as my MP. ***PS: Above suggestion is my personal opinion and doesn't make it right or wrong. |

I foresee a lot of trouble here… Whilst your child is a US citizen and can travel to the US. The subject around a minor travelling with a relative from a secondary location WILL raise a big flag. Q. If you provide a letter / document for the relative to travel with your child, what address will you put there as yours ( As a visitor in Canada you are a temporary guest and you can’ t claim a residential status which will bring the document/ document into question) #secondary location. — There is a slight chance for the US border agency to trigger safeguarding measure- authorising US govt protection of a (minor) citizen. Having dependant visa for PBS student is now more tedious. My guess is UK is also more expensive for your study but i recognise it's an MSc degree which is better off than a Bachelors degree. Hi, Apologies as i just took note that your stated annual income is £9k. You need to show how your parents send this money to you. Saying you don't have another income is technically right. (We regard income as money received in exchange of labour or services). With the statement written in bold above said, if you want to support a financial sponsors account, you still have to show how they make that income ( invoices/receipts/payment orders etc) in their bank account. Thank you so much for the pointers however, in my application I stated that I’m a student and I have other income (allowance from parents). If I submit my statement of account, how do I prove the credits are from my parents since there isn’t a direct transfer from their naira account to my Turkish lira account or should I have stated that I have no other income? Hi, I did enjoy reading your positions, i think the counter opinion also bears quite a lot of weight. Your pointer of being in a regulated position may have given you away as a UK GP hoping for more earning poser in Canada. If it were 9 months ago, i will fully agree with you. However, it's good you have sufficient information before any move. Whilst your mind may be made up and honestly it will be good for you to come to Canada and try yourself, know that things are rapidly changing on ground here. For context, i am also a British-US- Nigerian-Canadian ( Canadian means I'm PR not citizen). There has been a lot of influx of people coming in including UK GPs. The trouble the changes seen in Canada are as a result of unmeasured checks of immigration control and with elections almost coming up the pressure is on to for a tangible, palpable and drastic immigrant net control. Property market is pricer in Canada but for business minded persons, it also better to have your property in Canada than in UK except you have enough to buy one as soon as you land keeping in mind that the rental market here depending on the province is more expensive than the UK (Like me you may not be keen on renting). In addition, the taxes are about similar with the UK. Not all gloom though, the welfare system is better, good place for family, child care is ridiculously cheaper than UK, friendlier environment, better working environment ( esp comparing the primary care and NHS brouhaha) and a real well deserved respect from the community and entities. jedisco: |

Hi, while i acknowledge and empathise with you on how painful a refusal can be, I think your application and your proposed re-application strategy is completely and utterly flawed. Always juxtapose the position of a caseworker to yours. 1. First key point/fault which i think you should answer before any re-application is this. Your monthly expenses is 1.5million that is 18million a year but all the income is receive from your work ( <6million) + the additional 5million totalling <11million is still a far cry from the 18million you spend annually on expenses ruling out any iota of savings. In your re-application proposed strategy, even if the other amount to be pain in by your employee is added, the total sum is still far less than your annual expenses. What does the above imply: A. You are financially struggling in Nigeria ( indirectly there will be no incentive for you to leave UK and to Nigeria if granted an entry permit). This is the big issue you have to solve. Please don't apply without solving it as it would be only divine for the application not to meet the same fate as the previous B. I don't know the ages of your kids, but except for holiday period 21days out of school is a long time. I hope you also included an approved leave letter from your work place. C. In addition to showing evidence how the deficit of your income vs expenses is met, you also can to provide verifiable evidence of your husband's capacity to pay not only for the your trip with the kids and that he will be financially okay to meet his own demands of living expenses as a student in the UK ( recall that the primary defence of the case worker is that your husband is a student). Questions to answer in addition for Observation c are below: 1. Is your husband's accommodation suitable for a 4 person family, if yes good but if no, would he need an external accommodation for the visit. If yes ( itemised bills- accommodation/feeding +/- transport to be included in trip expenses ). 2. What is the level of covered of his scholarship, would it accommodate a family of four even with his stipends. 3. With the current personal financial posture you have shared, a caseworker would wonder if it isn't financially tactical for 1 person (your husband) to visit you in Nigeria than for the three of you visiting the UK without any strong ties to Nigeria. In summary, critically appraise the information i have provided you and while they might seem daunting, they are doable and achievable. It might be a better option for your husband to visit you and the kids instead of the reverse due to your financial posture. I hope the information helps to shed some light. I'm really sorry about your refusal, i think there were a few key details you missed and which made the entire application look incomplete. 1. To Start with, i think 3 weeks for you to reapply and get a response might be very tight so if you would wanna consider deferring your OSCE to a later date. 2. In your submission, you claim you earn money but provided no proof, no employment letter, no statement of account ( you can still submit your turkish statement of account, remember you're in Cyprus and believe me they can read your statements or get it translated). 3. It is not enough to provide a sponsors document (statement) without proof of the source of income. Reverse the role and see if you were the case handler you would give it any weigh. A sponsor has to provide a letter to support your application, verifiable proof of their source of income including but not limited to their employment letter and how much they are gonna be sponsoring you with. 4. In the absence of the above, any case worker would start to doubt if there are any strong ties you have in Cyprus. In conclusion, get the documents above, and carefully resubmit your application and i believe your application would be considered positively. Also, you can include the receipts of your fees for your education in Cyprus when resubmitting. All the best and wish you luck. Just a little correction to the information in bold below. London and Belfast consulates are the only ones providing non immigrant services. There is no consulate in Manchester while consulate in Edinburgh is for US citizen services only. giselle237: |
Just a general advice. For all those intending visitors to UK that are not self-sponsored or sponsored by immediate family members (not distant uncles/aunt/friends etc), please note that you are going to be perceived as an economic migrant especially given the economic situation in Nigeria. The onus rests on you to prove from your application that you are a genuine short term visitor to UK. Before submitting your application, ask yourself the question "Does this application look like the applicant will return after their visit? (?ties to home)." Once you have an answer/doubt in your head on this question, then you can easily tell the probable direction your application will go. You can then seek further assistance here with your pertinent questions that the fantastic contributors here will be willing to answer. I think you just have to state the denial and the reason. Then explain reasons why the large deposits were made. If you have a document to also evidence this large deposit ( e.g Performance letter from your work place stating the bonus), you can attach it as well. Veefid: |
That would be a great shame if its the case as their cases will trigger investigations by the HO resulting in cancellation and curtailment whether now or in future when they are renewing their papers. The home office has access beyond what they normally think of including requesting medical record info from their doctors, employers, schools etc. I am recently aware of a case that of a revocation of ILR following secondary to a marriage of convenience for immigration purposes after 6years. Hi, whilst i'm not an immigration lawyer who will offer you a better advice, there are just some key points worth noting here. Firstly, according to a comment you made, that they have been separated since January but only recently legally divorced ( not sure what month). The subject matter remains; 1. Was the HO informed of the separation as stipulated on PBS dependant entry permit policy? If not, your colleague must be able to address when the time comes. 2. Is there evidence of travels to Nigeria (not just for the wedding) to establish "genuine relationship" which culminated into a marriage in 6months or thereabout and/or a month after a legal divorce. 3. If the answer to question 1 is NO, HO wasn't informed then it might be adjudicated as a breech of her dependant permit resulting in cancellation and curtailment. Alternatively, there was a substantial investigation by the Police, then there might be grounds for consideration on leniency which will be individually determined but not guaranteed. So, the question about whether 6 months is enough, is very subjective and i can't provide a direct answer. What i can tell you is there shouldn't be too much worry if all the marriages and divorce were genuine but most assuredly is there will be an unannounced HO investigation. For a start i do no think the advice given by @giselle meant he was talking down on anyone, it was just a caution. Now to answer your question, Your colleague should be very careful of his/her actions as the time line of events might lead the HO case worker to believe the divorced marriage was a sham marriage on the balance of probability which translates into falsehood for an entry permit. As a result, your colleague's problem will not just be a question of whether or not he/she can bring in the new spouse but instead a likelihood of cancellation and curtailment of entry permit under S.24 of Immigration and Asylum act of 1999 for the 2 parties involved in the divorce. Note that marriages of convenience, are for the purposes of immigration, synonymous with sham marriages. (NB- I'm not making any accusation or implying the previous or current marriage is one) If however, there is substance and establish-able facts to the events of divorce and re-marriage then there shouldn't be a problem although there will still be a HO investigation whether now or at your colleague's subsequent renewal as the threshold would have been triggered. @Debral, I came across your post and thought i explain a highly plausible reason for the denial. To be very direct, the moment you/they submitted their NIV application, the USCIS system would have already adjudicated a NIV refusal due to the system also picking up a pending IV application. Basis for this - you cannot argue a non immigrant intent when you already filed for an immigrant status/visa. As such, the physical interview was just procedural and i imagine would have been very short. So it is not about your parent's response and i will advice not to re-submit another NIV application but rather wait for their GC process which takes about 16-18months on the average ( from USCIS to NVC stage for IV interview scheduling). Bishop1monte:Bangor is a nice area and the university is quite good. The sch's accommodation is tiny though (bear in mind). There aren't so many jobs in Bangor itself but you are sure to find one with determination in neighbouring communities which are easily accessible by train. |
Hi, so sorry to hear about your sister's visa refusal. Almost as a general rule of thumb, offering to sponsor the entire trip proffers significant advantage for the applicant as it reduces the burden to demonstrate affordability for the trip. Secondly, your financial documents and position is more trackable, believable and trustworthy for the caseworker. That said, the applicant would not need to show bogus sums in his/her account or give so much explanation whilst not ignoring demonstrating home ties. Just like you have done for your brother successfully, i have had same successful results for over the last 8 years even for both unrelated folks/ old friends e.t.c. just by stating in the invitation letter that "i would be covering all travel expenses for the trip and any other expenses that may be incurred whilst in UK and until his/her departure from the UK". You will need to contact individual schools for their admission process and deadlines. You can find this information on their websites as well. JaySterling:Not sure if you meant scheduling in London rather than rescheduling as you haven't already scheduled an appointment in Belfast if i have understood your statement correctly. It's okay to schedule in London even though you filled Belfast in your DS-160. All you need to do is fill up another DS-160 (not mandatory) before you attend your interview in London otherwise there might be slight delay during your interview as the visa officer would need to first transfer your application electronically from Belfast to London before your actual interview commences (time consuming- takes couple of minutes.) Lovebuddy:Firstly, you need to decide if its General nursing you are thinking about or mental health nursing. Since you have a first degree, mental health nursing might be an easier choice as you do not have a prior knowledge in sciences. I will advice Masters in mental health nursing although i'm aware it is becoming very competitive due the number of applicants. Hope this information helps. You can go ahead and apply for 2 years. You have a better chance at it. I'm not sure anyone can give you an absolute guarantee but rather on the balance of probability. NB: You still have to demonstrate your personal circumstance is admissible (ie. finances and home-times) irrespective of the other pre-existing visas (even though they give you an advantage).
