Politics › dasuki: Is The ECOWAS Court Judgment Binding On Nigeria? By Inibehe Effiong by sharpden(op): 7:58pm On Oct 05, 2016 |
ON Tuesday, October 4, 2016 The ECOWAS Community Court of Justice otherwise called the ECOWAS Court declared the arrest and continued detention of former National Security Adviser, Col. Sambo Dasuki as unlawful, unreasonable and arbitrary. As reported by Premium Times, "the court also held that the further arrest of Mr. Dasuki by government on November 4, after he was granted bail by a court of law, amounts to a mockery of democracy and the rule of law."
Upon examination of the facts of the case and relevant local and international laws, a three-member panel led by Justice Friday Nwoke declared that the Nigerian government was wrong in arresting Mr. Dasuki, searching his residence and confiscating his properties without a warrant. The court accordingly ordered the immediate release of Dasuki and awarded N15 million damages in his favour
. Before proceeding to discuss the bindingness and enforceability of the judgment, some preliminary points about the status of the Court are apposite and worth noting. I urge readers to be patient in digesting this long expository
. The Court was created pursuant to the provisions of Articles 6 and 15 of the Revised Treaty of the Economic Community of West African States (ECOWAS). By virtue of Article 10 of the Supplementary Protocol of the ECOWAS Court adopted in January 2005 by the Authority of Heads of States and Government, individuals, corporate bodies and non governmental organizations have direct access to the court for the enforcement of human rights
. Significantly, the Court has held in a number of cases brought before it that the principle of exhaustion of local remedies which is well entrenched in customary international law is not applicable to it. Commenting on the effect of the non application of the principle of exhaustion a legal scholar, Prof. M. T. Ladan submitted in an op-ed titled: "The Prospects Of Public Rights Litigation Before The ECOWAS Court Of Justice" thus: "The effect of this is far reaching because victims of human rights violations may choose to directly approach the ECOWAS Court of Justice without exhausting local remedies at the national courts..." In the case of Valentine Ayika v. Republic of Liberia ECW/CCJ/APP/07/11, cited with approval by the learned professor of law, the Court ruled the case admissible notwithstanding the fact that it was alleged to be pending before the Supreme Court of a Member State, Liberia
. The consequence of this on the Dasuki's case for example is that the Court's jurisdiction was not ousted due to the pendency of criminal cases in different Nigerian courts against Dasuki. It is immaterial that Dasuki was granted bail by various courts and that he has not exhausted legal remedies in Nigeria. The Court has both an advisory and a contentious jurisdiction. Under the former, the Court gives legal advisory opinion on any matter that requires interpretation of the Community text (laws). Under the latter, the Court examines cases of failure by Member States to honour their obligations under the Community law. It also has the competence to determine cases of violation of human rights that occur in any Member State and so on. Is the decision of the court binding on Nigeria? This is the crux of the matter. There is no simplistic answer to this question. I implore readers to carefully read this essay to the end before forming an opinion based on my submissions
. Article 15 (4) of the Revised Treaty of ECOWAS provides thus: "Judgements of the Court of Justice SHALL BE BINDING on the Member States, the institutions of the Community and on individuals and corporate bodies." (Capitalised for emphasis)
. As a signatory to the Revised Treaty of the Economic Community of West African States (ECOWAS), subsequently referred to as the Revised Treaty, Nigeria is legally bound by the judgment of the court. This is consistent with the elementary principle of international law 'Pacta Sunt Servanda' (agreements are binding)
. The Federal Government in recognition of the legal status of the Court and the binding nature of its judgments voluntarily entered appearance and vigorously defended itself in the case brought against it by the former National Security Adviser, Sambo Dasuki
. Having submitted itself freely to the jurisdiction of the Court, it will be disingenuous for the same government to resile from its obligations under the Revised Treaty and the relevant Protocol and Supplementary Protocol relating to the Court. However, that is not the end of the matter. On implementation of treaties, Section 12 (1) of the Constitution of the Federal Republic of Nigeria 1999 (as amended) states as follows: "No treaty between the Federation and any other country shall have the force of law except to the extent to which such Treaty has been enacted into law by the National Assembly"
. The National Assembly has not domesticated or enacted the Revised Treaty and the Protocols relating to the Court into law. Does the non domestication of the Treaty imply that Nigeria is not under a legal obligation to enforce the judgment given by the Court in the Dasuki's case? The answer is in the negative within the realm and context of international law
. Under international law, Member States are not allowed to cite the provisions of their municipal laws, including their Constitutions, as a basis to evade their treaty obligations
. In Moukhtar Ibrahim Aminu v. Government of Jigawa State & 3 Ors, the ECOWAS Court was confronted with the question whether its jurisdiction over human rights violation could be activated in that case in view of the non domestication of the Revised Treaty and the Protocols relating to the Court by Nigeria as required under Section 12 (1) of the Constitution supra. The Court held as follows: "“It is trite that the question of domestication is entirely a local duty of the State to comply with its domestic laws including its constitution. However, where the action of the State is indicative of the fact that it intends to abide by the contents of the Treaty and proceeded to enact into law the provision of the African Charter on Human and Peoples’ Rights contained in Article 4(g) of the Revised Treaty makes the objection of the 1st and 2nd Defendants a non issue and immaterial. As always, a State cannot approbate and reprobate in respect of domestication of Treaties, that it derives benefits from its application. It is common knowledge that the Revised Treaty was ratified by the Federal Republic of Nigeria, on 1st July, 1994. With such ratification, the Revised Treaty as far as the Community Law is concerned, become applicable in the institutions of the community – ECOWAS including this Court. The Protocols of the Court which are annexed to the Revised Treaty form an integral part thereof”
.
The foregoing pronouncement of the Court is a strong restatement of the principle of international law which forbids Member States from relying on municipal or national laws as a shield to evade their obligations under international law
. Notwithstanding the obligations of Nigeria under international law, within the realm of Nigerian jurisprudence and legal system, Article 15 (4) of the Revised Treaty which declares the judgment of the Court binding on Nigeria does not enjoy the blessings of the Nigerian Constitution having regard to the mandatory provisions of Section 12 (1) Constitution
. Putting it more succinctly, the judgment given by the Court in favour of Dasuki is only binding on honour and does not have force of law in Nigeria since the National Assembly is yet to domesticate the Revised Treaty and Protocols relating to the Court
. There is an apparent conflict between the provisions of the Article 15 (4) of the Revised Treaty and Section 12 (1) of the Nigerian Constitution
. In the celebrated case of General Sani Abacha & Ors v. Fawehinmi (2000) 6 N.W.L.R. (pt. 660) p. 247 the Supreme Court was invited to determine when a treaty becomes law and binding on Nigeria and whether a treaty (The African Charter on Human and Peoples Rights) was superior to the Nigerian Constitution. The Apex Court held thus:
"...an international treaty entered into by the government of Nigeria does not become binding until enacted into law by the National Assembly. See section 12(I) of the 1979 Constitution which provides: "12(1) No treaty between the Federation and any other country shall have the force of law except to the extent to which any such treaty has been enacted into law by the National Assembly (AFRC):' (See now the re-enactment in section 12(1) of the 1999 Constitution). See the recent decision of the Privy Council in Higgs & Anor. v. Minister of National Security & Ors. The Times of December 23, 1999 where it was held that - "In the law of England and The Bahamas, the right to enter into treaties was one of the surviving prerogative powers of the Crown. Treaties formed no part of domestic law unless enacted by the legislature. Domestic courts had no jurisdiction to construe or apply a treaty. Nor could unincorporated treaties change the law of the land. They had no effect upon citizens' rights and duties in common or statute law. They might have an indirect effect upon the construction of statutes or might give rise to a legitimate expectation by citizens that the government, in its acts affecting them would observe the terms of the treaty."
.
In my respectful view, I think the above passage represents the correct position of the law, not only in England but in Nigeria as well. Where however the treaty is enacted into law by the National Assembly as was the case with the African Charter which is incorporated into our municipal (i.e. domestic) law by the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act Cap. 10 Laws of the Federation of Nigeria 1990 (herein after is referred to simply as Cap. 10) it becomes binding and our courts must give effect to it like all other laws falling within the judicial powers of the courts." Per OGUNDARE, J.SC. (Pp. 30-31, Paras. C-F
. The Supreme Court further held that though the treaty in question has been enacted into law by the National Assembly, it is submissive to the Nigerian Constitution which is the supreme law of the land and the grundnorm
. In the Dasuki's case, though the African Charter on Human and Peoples' Rights was among the laws relied upon by the Court and has been domesticated vide African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act Chapter 10, Laws of the Federation of Nigeria, 1990 (now Chapter A9 Laws of the Federation of Nigeria, 2004), the judgment of the Court does not have the force of law in Nigeria. The reason is that it the Revised Treaty and Protocols relating to the Court that established the Court and clothed it with jurisdiction over cases of human rights violations in Member States and not the African Charter. The Charter can only have force of law from decisions of Nigerian courts until the National Assembly enacts the Revised Treaty into law
. Under Article 24 (4) of the Supplementary Protocol, each Member State is expected to determine a competent national authority that will be responsible for the enforcement of the court’s decisions, in accordance with her own rules of civil procedure. Interestingly, Nigeria is among the three Member States (others are Guinea and Togo) that have put in place appropriate mechanisms for the enforcement of judgments by the Court
. By virtue of Article 76 (2) of the Revised Treaty, the decision of the Court is final (not subject to appeal). Furthermore, Article 77 (1) of the Revised ECOWAS Treaty provides for the imposition of sanctions by the ECOWAS Authority against a Member State that fails to fulfill its obligations to the Community
. In conclusion, Nigeria can either follow the path of honour and responsibility not only as a member but as the 'super power' of ECOWAS by releasing Dasuki as ordered by the Court in consonance with her treaty obligations, or take refuge in the non domestication of the Revised Treaty and continue to detain him
. No matter how repugnant and grievous the alleged infractions of Dasuki are; irrespective of how majority of Nigerians feel about Dasuki and his unpatriotic mismanagement of defence funds, the judicial and legal process must run its full course unimpeded
. The Executive cannot and should never be the accuser, prosecutor and the judge. President Buhari should come to terms with the tenets of democracy
. In the final analysis, the path taken by the President Muhammadu Buhari-led government will have far reaching implications on the image of Nigeria and the perception of not only Nigerians but the international community and investors on the inclination of the government on issues of human rights, rule of law and democracy
. President Buhari, the choice is yours
. Thank you
.

Romance › 5 Reasons To Never Be ‘blinded’ By Online Relationships by sharpden(op): 5:57pm On Sep 30, 2016 |
Love is blind is an over-flogged phrase. But is it really blind? What is indisputable is that technology has significantly changed the concept of love and dating. Today, you can meet anyone, anywhere especially online. There is now social media and dating websites where you can chat up your preferred relationship choice and take it from there.
Since technology has simplified dating, some have engaged online with reckless abandon. That they get easily carried away and ‘blinded’ by the thrills of online dating. In other words, Jumia travel is stressing caution when starting the relationship. There is nothing wrong with dating someone you meet online. Here are reasons why you should never be blinded by the thrills of online relationships.
There are so many fake people online
It is very easy for anyone to fake their online identity. You can use a fake picture, post pictures posing in front of a car that is not yours and much more. In addition, you cannot verify the identity of the person you are chatting with. Hence, you should be very careful of these online playboys.
It barely lasts
Online relationships barely last because both parties may be in it for the fun. It is perhaps lust rather than love. And lust doesn’t last. In fact, itis difficult to build trust, romance, and compassion.
He may be an online player
There is very high possibility that you are not the only online beau that he is after. He has a bevy of online women whom he is dating. You wouldn’t want to join that number.
It is all about sexual innuendos
Your conversation always has a whiff of sexual innuendos. In other words, your chats with him or her are always driving towards sex. This is what many online relationships result in. So, if you don’t want to engage in the sexual innuendos. The relationship usually ends there! It is better you opt out if your tete-a-tete is always about sex.
It may not go offline
The best way to guarantee that you are dating someone you meet online is for both of you to take it offline. This means that both of you have to go on a date. But many people are scared because they don’t want something unsavoury to happen to them. Perhaps, it is better to abandon online relationships in its entirety. We have become aware that senior members of the All Progressives’ Congress (APC), in collusion with certain staff of the Independent National Electoral Commission (INEC) have started writing fake & fictitious results as part of their plan to manipulate the Edo State Gubernatorial Election which is taking place today.
2. We are aware that these APC members are working in collusion with Amina Zakari, an INEC national official; Imoudu Sule, Edo State INEC PRO, the Delta State REC, and the National Deputy Director of Operations.
3. We are also aware that these officials have distributed millions of Naira to the Local Government Electoral Officers to get them to write false & fictitious results in favour of APC even before votes are cast.
4. It is necessary to warn the Nigerian public that our Party will resist any attempts by the Ruling Party to subvert the will of the people by any engagement in the substitution of electoral materials.

THE trial of the Senate president Bukola Saraki, his deputy Ike Ekweremadu and three others was today, September 28 stalled due to federal government’s unpreparedness.
The judge over the matter, Yusuf Halilu after listening to arguments and submissions from counsels from all parties adjourned the matter to Friday, October 7.
At the hearing, after counsel to FG Aliyu Umar said he not prepared for the matter, Ikechukwu Ezechukwu, counsel to the chief clerk of the National Assembly Salisu Maikasuwa, objected the call for an adjournment by the prosecution.
Ezechukwu said there was no need for an adjournment because the matter has been already scheduled for hearing today.
Also, Mahmud Magaji, counsel to the former deputy chief clerk Benedict Efeturi also objected to the adjournment.
“The act of prosecution is serious business, especially a criminal charge. The office of the attorney-general which is the chief prosecuting counsel was served months ago. They had all the opportunities to respond to our applications,” Magaji said.
“I urge your lordship not to allow us to descent to the internal working of the prosecution. In view of this, I’m objecting to the application for adjournment.”
Also, Paul Erokoro, counsel to Saraki, said that the application had no merit.
“On behalf of the third defendant I submit that the application has no merit. If the attorney-general has not deemed it fit to pass the entire case file to the counsel, then we should be allowed to move our motion. We are ready to proceed,” Enokoro said.
He said the defense team is ready for trial. http://www.socialtimesng.com/2016/09/saraki-ekweremadus-trial-adjourned/

Politics › Ekiti APC Claims Credit For State’s Improved Neco performance by sharpden(op): 3:54pm On Sep 17, 2016 |
THE All Progressives Congress in Ekiti State has expressed pleasure over the latest National Examinations Council results placing the state on top of other states in performance.
The APC attributed the feat to sound the education policy of the former Governor Kayode Fayemi, which provided incentives for good learning environment and provision of educational items that enhanced learning among the students.
It said the explanation became imperative as Governor Ayo Fayose was wont to claiming unmerited credits for Fayemi’s achievements.
The APC cited the 2014 budget by Fayemi that was adjudged the most effective and transparent in Nigeria by an organisation, but which Fayose celebrated as his achievement.
The National Examination Council on Friday released the results of the Senior School Certificate Examination it conducted in and outside the country between June and July this year, with Ekiti State having the best performance with 96.48 per cent, followed by Edo State, which came second with 96.31 per cent.
Reacting to the state’s performance, the APC Publicity Secretary, Taiwo Olatunbosun, said in a statement that the feat was attributable to the education policy instituted by Fayemi that put life into educational administration and management in the state.
He explained that Fayemi called an education summit to develop a roadmap for quality education, which the former governor implemented to the letter.
He said the foundation laid by the administration created the environment for learning as never before, resulting in the latest incredible performance by the students.
He also noted that the current success did not happen overnight but the result of long planning by Fayemi between 2011 and 2014.
Listing the incentives instituted by the former governor that had brought about the latest performance, Olatunbosun explained.
The statement added: “Fayemi gave a laptop per child that exposed them to study online and eradicated miracle centres while providing incentive to teachers, including renovation of schools to enhance good learning environment, and also approved special allowances for core subjects and rural postings for teachers.
“Fayemi’s giant strides in education made Ekiti one of the three states in the federation that benefitted from the World Bank’s $50 million State Education Programme Investment Project.
“He renovated 183 secondary schools and 836 primary schools and provided other incentives, including establishment of remedial colleges to cater for out-of-school students in the 16 local governments, which made the state to record 52 per cent credit pass in English and Maths in 2013 while the state also won many firsts in various quiz competitions in the same year, topping it with a student from Ikere High School who won the best male student in WAEC.”
Olatunbosun regretted that while Fayemi introduced and sustained compulsory free education at primary and secondary education levels, Fayose had cancelled the policy, making pupils to pay taxes per term and teachers remained unpaid for seven months.
Olatunbosun said this also led to teachers’ strike that kept the students out of school for months, adding that this could not have resulted in this successful outing.
He said: “Fayemi administration of four years when the successful students were in Junior secondary school, impacted well on them such that they had a solid educational background which translated into the latest success.
“Between 2011 and 2014, Fayemi was consistently rewarding best hardworking teacher with a brand new car and paid WAEC fees of students ranging from N86m to N140m, which Fayose has also stopped.
“Fayemi’s administration was continuously organising training programmes for the teachers, while 400 motorcycles were distributed to teachers serving in rural areas, even as he distributed 20,000 sets of lockers and chairs to public schools across the state.
“He delivered books worth N6m to the State Library Board to encourage reading culture among teachers and students and promoted no fewer than 4,000 primary school teachers between 2010 and 2014, including Head Teachers and Deputy Head Teachers, some of whom were demoted by Fayose upon assumption of office.”
The APC spokesman added that teachers benefited from the relativity pay for all categories of workers in the public service and also benefited from the 27.5 per cent Teachers Pecuniary Allowance, while Ekiti was the first in the South West to implement the relativity pay, bringing the minimum wage from N7,500 to N19,300 without owing teachers salaries.
Noting that Fayemi also organised continuous capacity building programmes for teachers and established intensive statewide coaching programme for SSCE/NECO and JAMB candidates, Olatunbosun regretted that all the schemes had been cancelled by Fayose, who was also owing teachers six months salary arrears. http://www.socialtimesng.com/2016/09/ekiti-apc-claims-credit-for-states-improved-neco-performance/

Politics › Presidency Denies Sacking Director Who Plagiarised Obama’s Speech by sharpden(op): 7:16am On Sep 17, 2016 |
THE Presidency has denied media reports that it had sacked a Director in its employ for plagiarising a portion of a speech read by President Muhammadu Buhari at the launch of the “Change Begins With Me” campaign.
The portion of the speech has been discovered to have been lifted from a speech by President Barack Obama of the United States of America.
But shortly after the Presidency issued a statement that a query had been issued to the Director, news emerged that he or she had been sacked.
But the Senior Special Assistant to President Buhari on Media and Publicity, Mallam Garba Shehu told our correspondent that the Director had not been sacked.
Shehu said there are procedures in he clvil service for disciplinary measures.
He said despite the acceptance of guilt by the Director, he must still be given room to reply the query already issued to him.
He said: “The minimum time given for response to a query in the civil service is at least 24 hours.
“In some cases, 72 hours cab be given. “There are cases where you can even give one week.”
“So inasmuch as the Director has accepted responsibility, we must give him the room to respond to the query.” http://www.socialtimesng.com/2016/09/presidency-denies-sacking-director-who-plagiarised-obamas-speech/Lalasticlala, mynd44
