see how this man dey create percentage from thin air. 80% based on what metrics?
if only i have a dime for each time family members call their gun wielding gang member son a good boy
Even families of serial killers have no clue who they really are. stop believing everything you see online
I'm not saying this person is guilty or not, I'm saying no one here knows for a fact who he was or how he got caught up in this.

we manufacture certain horror stories.
I'd think any Nigerian with 40 million naira to pay a dirty cop who harassed him should be able to sue the entire Org. that money would be traceable etc. oh well. I'm looking at it from the lense of an outsider of course, just can't believe he did all these and nothing has happened, with being held liable etc.

EricBraven:

one question i have been asking myself, i haven't seen or heard of a case where he is being sued in court with the police force (in case there is any please let me know)
Foreign Affairs / Re: Battle Field Discussion (picture/video) Of African Military . by sizzorchan: 4:30pm On Aug 02, 2021
so many horror stories about that man. how did he get away with all of it. and how many people witness these alleged atrocities. again, in Nigeria rumor spread like wild fire, that made me doubt lots of these tales I've been hearing

I think one huge factor is protecting him, the position he hold or held. but even if na ordinary citizen, they still have their right to challenge an extradition in court. ( if they have the resources)
just because the guy may or may not be a bad cop doesn't mean he just get handed over to a foreign country. due process should take place and we see what heppens.
Remember, prosecutors always make charges seem like a slam dunk, until defense lawyers pick them apart. So forget about all you've heard about such case, most might not even stand in court. so let's see what happens.
I also think Nigeria should have a law that penalize citizens who commit crimes abroad or transnational crimes. Just for soiling the name of the country should earn them an additional 10yrs grin

No waste your time chief.
Some here thinks we are protecting a criminal, when no one did such.
I wonder how many Chinese and Russians are also wanted(granted their might be no extradition treaty in place), you see Moscow or Beijing handing them over? but a black man hear FBI, they thought the gods have arrived.
No matter his crime, Nigeria must carry out her own investigation and if found guilty of certain misdeeds, appropriate punishment should follow.
Some saying US have jurisdiction, lol, where? even if these accusations are true, Nigeira could put him on trial and tell the DOJ they can have him once he's done serving his time.
Me, i want him punished if guilty, but don't throw your citizen to a foreign country on a whim. he will also exercise his right to challenge this in court, then those FBI agents will come here with their prosecutors and argue their case.
A Nigerian judge will determine this, no one esle.

EricBraven:
i think they should just extradite allen oyenma and abba kyari together, since some of us has decided to put on bias lens when having conversation concerning the state of our nation.
Some have pronounce him(kyari) guilty even before the court proceeding begins, some here are saying another person will be worst than the current president because the person refuse to fit into your own perceived truth.
How about we start extraditing everyone the FBI ask for and make ourselves puppet, them ask we carry give them like say you no get value.
mtcheew.
A lot of young people need to be taught what patriotism is, you don't just wake up to a news concerning your own people and decide to fly with it without probing what it content is. HABA.
Some want him thrown to the dogs because he is a police officer, once head the SARS division and what not but truth be told will other countries do the same to their citizens when they are requested for extradition ? feed on it

what are you talking about? you think I'm happy that lives are lost in Nigeria? or what are you trying to say?
And my point remain thesame. ppl come here to scream FIRE all the time and give the appearance of a country where people can't even go outside, I'm saying that's not the case. and i never once said there weren't dangers in the country. show me which country is free of same.
So you totally misunderstood me. but I'm not spending another day going forth and back on this.

I'm glad he didn't. a potential dirty cop lying to get away from being held accountable is the last thing we need grin. Don't coach him i beg grin.
besides then he have to show the paperwork for that sting operation and which superior signed off on it. Then he will have to produce the money he was given, which at this point should be in evidence lol. but I'm sure most , if not all of that money is gone

This is the kind of analysis I like. It is made from some depth of legal knowledge not some beer parlor exposition of layman's opinion.

The US was 'hurt' by Kyari's crime but how does that make it a criminal offence if it was not done in the US? .
Also, what if Kyari claims he was on a sting operation to trap Hushpuppi's gang which was what the idiot should have done in the first place?.
Can the US interfere in a Nigerian Police operation?

Well said chief. good write up. guess we wait and see how it goes

GeneralFarouq:

1.Nigeria has jurisdiction. Through subjective test...A citizen alleged to commit official corruption while acting in official capacity

2. US also have jurisdiction using objective test since using dollars for fruad has economic or political damage on their country...
US has a better jurisdiction following international law.... Because Objective test always supercedes the subjective test.

3. The place where the crime was committed also has jurisdiction(also subjective jurisdiction) At the end of the day it a matter of balancing where agreement btw the countries, the place where fixed evidence are located amongst other things.
and then looking at the disadvantage the defendant will face if transported to an entirely foreign justification, the cost of procuring lawyers. Etc...
It may even be a defence if the alleged defendant says he does not intend the crime he may have committed to have effect in the U.S. because...
A. The transaction took place in Dubai
B. They are both Nigerian citizens and where contemplating to be tried if in any event they were arrested by a Nigerian court S4(2) Criminal Code....

Plus it even a good thing he was on holiday... Otherwise US could hold Nigeria accountable by saying Abba acted as an agent of Nigeria... And sanctions follows....
Amongst all three, US has the best Jurisdiction...

At the end of the day, this request will be determined as acceptable or not by a Nigerian judge. it's all about merits.
Regardless who has jurisdiction. besides Nigeria hasn't started any criminal proceedings against the accused, but they need to look into it. too many dirty cops out there

Foreign Affairs / Re: Battle Field Discussion (picture/video) Of African Military . by sizzorchan: 6:30pm On Jul 30, 2021
They have jurisdiction, says who? so you are telling me now that if the accused is in Nigeria and being charged with murder, committed within Nigeria, then US will tell Nigeria it has jurisdiction because the guy have a pending case to answer in the US?
there are tons of Chinese national wanted by the US justice dept, why didn't they go and get them in china because they have jurisdiction.
or go after those russian hackers. this nonsense of a powerful country claiming jurisdiction in foreign countries only apply to weak nations.
American law does not supercede another country's laws.
and yes I'm aware Nigeria have extradition treaty with the US, but if the accused have case to answer in Nigeria, he will.
That's why i said Nigeria need to see the evidence etc, then take it to court. A nigerian judge does not give a damn about American law or jurisdiction. And that judge get to decide if their extradition request is granted, not even the Nigerian govt
American law isn't international law.
This is my opinion on that.

Lurker4Long:

I don't know the particulars of this case. What I do know is that if the commission of a crime involves US dollars, or you transfer the proceeds of crime from say, Dubai to Nigeria, and your bank's clearinghouse is in the US, the Yanks have jurisdiction.

Moral of the story: don't use US dollars when committing transnational crime.

That's what I'm saying. if there is direct evidence that he's aware fraud was being committed etc, then that's a different story. but like i said before, if his actions take place within Nigeira, the arrest of the other guy etc, then he has also committed a crime within Nigeira.
Guess a judge will decide if that extradition would happen, which i think gives breathing space to Nigeria govt against US pressure

Coolliot:

The case against Kari, isn't just mere bribe, he acted as an enforcer for hushpupi, my removing a competition so that the deal would go on smoothly, he is as culpable as if, he actually played a more direct role.
This is why police officers should be held to a higher standard, when you keep committing a crime to enforce laws, you start creating your own laws and enforcing your own laws instead of the constitution, and it's rampant in all our paramilitary.....only the military , is trying it's best to control this aspect of things in their organizations.
Foreign Affairs / Re: Battle Field Discussion (picture/video) Of African Military . by sizzorchan: 5:10pm On Jul 30, 2021
Been wondering that myself. so if the case they have is that a cop in naija was given money by a Nigerian suspect, then they have to proof the cop knew the money was from fraud and actively partake in scamming people. right now it seems like bribery btw 2 Nigerians, in which case it should be prosecuted in Nigeira. if his participation is deeper and they can proof he got money stolen from American citizens, then that's a different story.
Remember also, its the court that will decide if this extradition should happen, I'm guessing on this though, but i think I'm right. so wait and see, and to those who already convict, hold your horse and let's see where this leads. I'm in no means saying he's innocent.
I actually initially thought the accused cop was the IGP grin. we no sabi these namessmiley

because no be oyinbo ppl conducting the arrest, therefore not valid.
we do, they complain, we don't, they rant

RiceProducers:

NA did not Massacre. They went to arrest the guy and his followers resisted.
This notion that NA and Nigerian Police just goes and shoots anybody is erroneous.
Why do we think we can shield criminals from arrest from NA, DSS and Police and there won't be consequences?

You actually expect the company leader of the detachment sent to pick up the guy to return to base with excuses and stories.

Funny enough the Nigerian Anti-Terrorism Act 2013 that was made under Jonathan actually automatically absolved the Army detachment.

If you are going to do social activism and/or protest in Nigeria, get a lawyer and get educated on the legal framework.

People dey die for nothing
Foreign Affairs / Re: Battle Field Discussion (picture/video) Of African Military . by sizzorchan: 2:28pm On Jul 30, 2021
Right now we only get one side of this. every accusation sounds good until defense tear them apart. this will be a long drawn out process.
yankari guy better go hire better lawyer and not leave the country grin. And investigation into this should be done by an independent body, not the fvking police

I had this discussion with a friend on how fraudulent guys escape judgment when taken to court. I always feel the Judges have been bribed.

It was my friend a Legal practitioner who told me that our security forces don’t do proper investigation before arrest. They just rush to make arrests that’s all.

Just see EFCC now running up and down into hotels in Lagos like a headless chicken. Them think say Na to where red jacket be everything.

I think KPMG, PWC or some Private security companies should become government recruitment consultants.

Just look at the number of well kitted Policemen guarding Private Citizens as escorts.

Abeg you get any link to USA? I heard street gangsterism is on the high side, but I’ll love to be there. After all, my sister in Benue told me over 20 youths have been killed tin a cult supremacy battle and it never made any news headline. embarassed

I still wonder how most of una dey here alive and well while boatloads of people dey die daily in that disgusting wretched country (sarcasm). I wonder. I'm genuinely curious how many of you guys have actually been victimized in that same Nigeria. Have you been shot? raped? have your home burglarized etc. Most bad sh!t most ppl probably have to deal with was give bribes to cops, what else? I get that there is economic hardship, show me where same isn't true around the world.
I'm not saying Nigeria doesn't have huge issues, but so is the rest of the world, and spending your every living moment to rant on here won't solve the problems.
My parents live right there in Ondo State, 78yrs on this earth, my father has yet to experience any danger that threatened his life, got brothers and sisters all over that same country, and they are alive and well. So what threat have you experienced? pls share. Or you guys just love disseminating rumors without actually witnessing most of these things.
Nigeria bad. rest of the world good. Go to Ecuador, and these latin American countries, then perhaps you'd understand the meaning of crimes. dont tear down your own.
ranting won't make it better. trying to fix it will.
And Oga Dubai, hopefully your issues with fulanis will be resolved in ur life time, hang in there. Me go hold down this Eldorado for ya
