Robbers aided Nigerian journalists office in Ibadan.

A group of burglars raided the office apartment the Correspondents’ Chapel of the Nigeria Union of Journalists, Ibadan at the wee hours of Wednesday.

The thieves forcefully gained entry to the office at Mokola area where the entire place was thoroughly searched for valuables and cash.

According to the chapel chairman, Tunde Sanni, the hoodlums’ attempt to cart away the plasma TV set from the union’s office was futile as they only removed it from the wall without taking it away.

“Items stolen during the burglary incident included, a complete suit, a bag of rice and cash amount whose amount is still being calculated.

“The incident has been reported to the Mokola division of the police which stated that investigations have commenced into the robbery incident,” Mr. Sanni said in a statement.[/size]

THE question, ‘Can President Goodluck Ebele Jonathan contest the 2015 presidential election?’, has been asked for the umpteenth time by the Nigerian literati and politicians alike. The question derives from a befuddled reading of the provisions of the Constitution of the Federal Republic of Nigeria, 1999 (the 1999 Constitution) and a certain misconstruction of the zoning formula of the ruling Peoples Democratic Party (PDP), which, in its constitution, has divided Nigeria into six geo-political zones, to wit, North-Central, North-East, North-West, South-East, South-South and South-West. Each of these zones is expected to produce the President of Nigeria in turn, effective May 1999, notwithstanding the fact that, of the eleven former heads of government that had previously presided over the affairs of Nigeria (1957-1999), eight of them were from the North. On May 29, 1999, Gen. Olusegun Obasanjo (rtd.), a Southerner from the South-West, became Nigeria’s President and Commander-in-Chief of the Armed Forces of the Federation. He was President of Nigeria from that date to May 29, 2003, when he was re-elected for a second and final term (2003 to May 29, 2007).

That Obasanjo remained in office for eight years was due to the sweet will and pleasure of the Nigerian electorate, which decided to bring him back to power “for a job well done”, doubtless, and not because the 1999 Constitution provides for an unconditional second term for any person elected to the office of President or because the PDP constitution has provided for a mandatory second term for such a person! If the first term of four years for a President after a duly contested presidential election pursuant to the provisions of Sections 132-134 of the Constitution is the ‘cake’ that is strongly protected by the Constitution, subject to the provisions of Sections 143, 144 and 146 thereof, the second and final term of additional four years is the ‘icing’ thereon. This icing, we submit, is contingent upon the sweet will of the Nigerian electorate: A second term is not automatic. An incompetent President would, as it were, be thrown overboard by the Nigerian voters at the end of his first term, in which event the geo-political zone producing the feckless President would lose out in favour of the next geo-political zone. The same zone that produced the defeated one-term President does not, cannot, and should not be heard to, insist on producing another presidential candidate or President because a bye-law has allocated a two-term of eight years to it!

This is the fact that is lost on all those regional leaders who imagine that the PDP’s concept of zoning automatically entitles a President from a given geo-political zone to an eight-year stay in office, regardless of the President’s performance in the first four years or even where the President from that particular geo-political zone dies in office after being inducted into it (a classic case of force majeure). If that were the intendment of the PDP’s constitution (a bye-law, be it noted), it would be anti-democratic, unreasonable and unconstitutional: Section 1 (3) of the 1999 Constitution forcefully declares that “If any other law is inconsistent with the provisions of this Constitution, this Constitution shall prevail, and that other law shall to the extent of the inconsistency, be void.” The meaning of this is that there is no zone of twilight in which the 1999 Constitution and any other law possess concurrent authority.

Sections 143, 144 and 146 of the 1999 Constitution provide, respectively, that, in the event of the removal of the President from office, his permanent incapacity or death, the Vice-President “shall hold the office of President…” Once any of the incidents assiduously delineated in those sections occurs, the geo-political zone currently producing the President, loses out, under the principles of force majeure (a superior force or an unforeseeable natural or human event or occurrence beyond the control of the parties to a contract, an occurrence that renders the performance of the contract impossible).

When a President from a given zone either dies in office or is pronounced permanently invalided and, therefore, incapable of performing the functions of his office or is impeached under the provisions of Section 143 of the 1999 Constitution, the next geo-political zone whose candidate occupies the Vice-President’s office, automatically takes over as President. That is, or should be, the correct interpretation of the PDP’s zoning formula. It is, perhaps, pertinent to remind ourselves at this juncture, that the so-called zoning formula is the brainchild of the ruling PDP, one, just one, of the numerous political parties in the land!

Section 135 (2) of the 1999 Constitution unequivocally provides inter alia as follows: “Subject to the provisions of subsection (1) of this section, the President shall vacate his office at the expiration of a period of four years commencing from the date, when -

in the case of a person first elected as President under this Constitution, he took the oath of allegiance and the oath of office; and in any other case, the person last elected to that office under this Constitution took the oath of allegiance and oath of office or would, but for his death, have taken such oaths”.

It should be noted that the accent in the foregoing paragraphs (a) and (b) is on the word ‘elected’. Indubitably, any person elected to the office of President and Commander-in-Chief of the Federation of Nigeria shall remain in office for no more than four years unless the Nigerian electorate decide to re-elect him for a second and final term of four years under the provisions of Section 137 (1) (b) of the 1999 Constitution. According to this section, subsection and paragraph, a person shall not be qualified for election to the office of President “if he has been elected to such office at any two previous elections…”

President Goodluck Jonathan has been elected to the office of President once (i.e. in April, 2011). He became Vice-President to Alhaji Umaru Musa Yar’Adua in May 2007; when that benevolent President became permanently invalided early in 2010, Dr. Goodluck Ebele Azikiwe Jonathan became Acting President through the instrumentality of the ‘doctrine of necessity’ or implied mandate, supported by the Madzimbamuto case in defunct Rhodesia and suggested to the National Assembly by Alfa Belgore (a former CJN). The necessity for the doctrine of necessity derived from the ‘zoning formula’ controversies. Then, in accordance with the provisions of Section 146 of the 1999 Constitution, Dr. Jonathan became President and Commander-in-Chief of the Armed Forces of the Federation on May 6, 2010, consequent upon the demise of Yar’Adua on May 5, 2010. It should be further noted that Dr. Jonathan did not become President and Commander-in-Chief of the Federation in May 2010 by election under the provisions of Sections 132-134 of the 1999 Constitution. In other words, he was not popularly elected; he was a child of circumstance! Ipso facto, he cannot be disqualified by the said section 137 (1) (b) of the Constitution.

It should, be noted, additionally, that the Nigerian Constitution is patterned after the United States Constitution, almost lock, stock and barrel. According to the Twenty-Second Amendment of the US Constitution (1951), “No person shall be elected to the office of the President more than twice…” Here again, the operative word is ‘elected’. For the benefit of doubt, the Twenty-second Amendment elucidates: “…and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of President more than once….”

The Twenty-Second Amendment was sequel to, and was a correction of, the situation in which President Franklin Delano Roosevelt remained President of the United States America from 1933 to 1945, a period of over twelve years, in contravention of the two-term tradition established since the days of George Washington. By the terms of the Twenty-Second Amendment, Presidents are limited to two terms (see also Section 137 (1) (b) of the 1999 Constitution) or, if they have served at least two years of a previous President’s term, to one term.



We should consider against the foregoing background the fact that President Goodluck Jonathan, apart from having been elected to the office of President only once, was sworn in on May 6, 2010, to replace his boss, who had spent almost three years of his four-year term (2007-2011). The period (i.e. the unexhausted term of Yar’Adua’s tenure) which Dr. Jonathan spent in office as a ‘constitutional’ President (i.e. under the provisions of Section 146 of the 1999 Constitution), in contradistinction to a ‘popular’ (i.e. elected) President, was one year and twenty-three days, not two years! In view of the similarity if not the rum identity of the Nigerian and U.S. Constitutions, the explicit and irrefragable provisions of the latter’s Twenty-Second Amendment should have a binding, or at least, a persuasive effect, on the construction of Sections 135 (2) (a) and 137 (1) (b) of the 1999 Constitution.

Having regard to the foregoing hard facts, the arguments, often slathered in jingoistic sentiments, that President Jonathan had been sworn in on two previous occasions as President or that he was once acting president, then President (after the death of Yar’Adua) and now President after being popularly elected to that office, is non-sequitur, being simplistic, sophistic, irrelevant and antithetical to the provisions of the 1999 Constitution. The proponents of these arguments may be asking a valid question if it is whether President Jonathan, in view of his performance in office in the past several months, is re-electable, come 2015. But that would be a personal opinion, not a legal or constitutional matter. And the answer to the “valid” question would lie with the electorate!

[size=13pt]A former manager with Intercontinental Bank Plc (now Access Bank), Mr. Olayinka Sanni and Personal Assistant to Adeyemi Ikuforiji, Speaker of the Lagos State House of Assembly, Mr. Oyebode Atoyebi have been arrested by the Economic and Financial Crimes Commission, EFCC, over a case of conspiracy, stealing and forgery amounting to about N1.5billion.

Sanni, a chartered accountant and operator of SIDAW Ventures, a Bureau de Change, was alleged to have fraudulently transferred various sums of money from more than seven customers of the bank into the account of SIDAW ventures owned and operated by him without the customers’ consent.

Specifically, he transferred N65million from the account of Babington Junior Seminary; N40million from P.W. Nigeria Limited’s account; N15million from Mikano International’s account; N20million from Viju Industries Limited’s account, N306million from the account of Falana & Falana Chambers and Fafun Nigeria Limited and N1.2billion from Murhi International Limited into his SIDAW Ventures account without the consent of the account owners.

Besides, Sanni also collected the sum of $461,200 USD from one Chukwurah Nkiru, who sold it to him for the equivalent of N76, 559,200 but was not paid.

Sanni is also embroiled in a foreign exchange scam where his SIDAW Ventures account was used to handle the sum of N104, 405, 000 where only N72,229,000 worth of foreign exchange was paid to the customer leaving a balance of N32, 185, 000 being hotly contested between his firm and the customer. Oyebode Atoyebi, Personal Assistant to Ikuforiji was also arrested for complicity and conspiracy with Sanni for allowing his passport-sized photograph and name to be used to open an account in SIDAW ventures limited in the name of Akanmu Babatunde. With this fictitious name, Sanni brokered many shady deals and duped many innocent people.

The two suspects will soon be arraigned in court.[/size]

kennytidistar: Former President Olusegun Obasanjo Wednesday said the Peoples Democratic Party (PDP), in Lagos State has the political willto dislodge the Action Congress of Nigeria (ACN) in the 2015 elections.

Obasanjo, however, noted that for the PDP to take over Lagos from ACN , the leaders must subjugate their egos and set aside their individual interests for the general interest ofthe party.

The former president stated this when the PDP executives in Lagos State paid him a courtesy visit at his Hilltop residence in Abeokuta, the Ogun state capital.

But ACN has accused the PDP of stoking the fire of ethnic and sectional politics by implying that President Goodluck Jonathan is being criticised by opposition parties because he (Jonathan) is from a minority tribe.

Obasanjo, who described PDP as a party in wilderness in the state, noted that leaders of the party needed to work together to build the party.

He expressed optimism that if the leaders and members are united, they could capture power from the ACN in the state.

“If only the leaders would sink their egos andregard the party’s interest as supreme and above that of individuals, then the party will come out strong and able to wrestle power from the ruling party,” he said.

Speaking on the fire incident at his residence last week, the former president said the fire would have killed him if the incident had happened in the middle of the night, describing the damage done by the fire as “enormous.”

He said the fire, which occurred inside the office of his private secretary, consumed a number of inflammable items that aided the fire, resulting in a thick smoke that found its way into his bedroom.

“The fire incident, which occurred in the office of my private secretary, resulted in thick smoke which pervaded my bedroom. If it had happened at night, I would have been a dead person now,” Obasanjo said.

The former president, who was full of praisesto God for sparing his life, as well as protecting him to be part of the living to witness the new year, stated that he had continued to receive telephone calls from within and outside Nigeria over the incident.

“I want to thank all; and all those who called me on phone both within and outside the country. Let us appreciate the mercy and kindness of God. There are many, we started last year together but no more today, we are not mocking them, but to extol God,” he said.

“In fact, that I’m able to stand erect is God’s blessing, Many of my age group cannot standwell, I am not mocking them, but I am thanking God. My hope and prayer is that thisyear 2013 will be a glorious year,” he added.

Earlier in his speech, the Chairman of the Lagos PDP, Tunji Shelle, told Obasanjo that theparty executive came to see him for three reasons.
“Our Baba, our leader and our president, we are here for three reasons: to sympathise with you over the fire incident, to celebrate New Year with you, and to get your blessingsfor the 2015 elections,” Shelle said.

The PDP leader said the party thanked God for sparing Obasanjo’s life.

However, the war of words between PDP and ACN over Jonathan’s administration raged on Wednesday.

The source who confirmed the story added that even President Goodluck Jonathan was fully briefed of the development and got a real picture of how his Vice President is juggling the turbulent politics of Kaduna State to match his own unpublicized presidential ambition.

Investigations carried out by SaharaReporters also revealed that Sambo is unilaterally running the affairs of the state from Abuja and has been shuttling to Kaduna mobilizing support for his godson governor. Two freight trucks, a luxurious bus, coaster and at least five cars were involved in multiple accidents near Ijebu-Ode along the Lagos-Benin express-road on Sunday.

It could not determined if there were casualties, but towing vehicles and road safety officials and plain clothe policemen were sighted around the scene with Ogun State fire truck on standby.

The luxurious bus cashed into the hole dividing two small bridges overlooking the river below.

Several passenger and onlookers sat around the scene as a huge traffic formed on the other side of the crash scene.

The Joint Task Fork Force (JTF) in Yobe State had killed four suspected members of Boko Haram, while one police of the JTS lost his life in the gun duel yesterday in Potiskum, Yobe State. A soldier too was injured.

The spokesperson of the JTF, Lt. Eli Lazarus said in a statement.

He said, “ At about 2pm yesterday Saturday 29 December 2012, men of the Joint Task Force (JTF) Operation RESTORE ORDER III Yobe State on cordon and search operation in Yandiski area of Potiskum had an encounter with suspected terrorists. Four of the suspected terrorists were killed in the encounter. One policeman attached to the JTF lost his life and a soldier sustained injuries.

“Four AK 47 rifles, one double barreled gun, sixteen magazines and three hundred and eighty rounds of ammunition were recovered. Other items recovered are; two gas cylinders and several Improvised Explosive Devices (IED) making materials. Fifty nine persons were arrested during the operation for interrogation.

“ JTF urges all law abiding people of Yobe State to go about their lawful activities and support the Task Force through the provision of relevant and timely information that will assist in ridding the State of terrorist activities.”

I reside in IMO state for about twenty something years now and i schooled in Abia state(although i was posted to Ekiti state , so let me help you...
[size=14pt]1. LIGHT - This Rochas regime, electricity has improved, we have at least 18hrs of electricity.
2. SECURITY - this is one of the greatest problem we have...in fact kidnapping is increasing...but God will protect you as long as you are careful(avoid loitering after 9pm during your PPA, especially around Orji/AMA wire/world bank)...
3. WATER - although where I usually stay pipe borne water doesn't exist...only bore hole...but you will always find water...
4. SOCIALIZATION - IMO has about 6 universities(enough girls and boys to interact with)and numerous Hotels and bars...
5. EMPLOYMENT - corpers are usually posted to schools(they pay N5,000 TO N10,000),ministry(they pay N5,000)and others...
6. TRANSPORT - there is usually keke and i advice you to patronize them, coz you might get robbed in a taxi(it usually happens) ...they usually collect N50 to short destinations and N200 for drops anywhere...
7. ROAD - i will rate the roads 67% (although many roads are still under construction)

Specialist900: I'm currently servin at Ekiti and i'm not regretin any part of it. It might not have been what some pple desired but we are all supposed to adapt. Ekiti state might not b rich as compared to other states but they are still better off than some.

Until i got to Ekiti before i knew pipe-borne water still existed in Nigeria, 24hrs pipe water, electricity is good (might not b all over the state) but in my LGA and a few i've been to it like 18hrs or more daily. Students even respect corpers more than they do to their teachers.

Incomin corp members, dont be afraid, its not as bad as its painted here, come with an open mind and u'll sure enjoy ur stay.


N.B other LGA are better off for corpers than the state capital (ado-ekiti).

take a bus going to Lagos and stop at ore...from there you can get to Ado ekiti(the state capital).or get to owerri, take a bus to Oshogbo direct, then get to Ekiti from there(its not far).
