A contractual dispute between a builder and a homeowner is not one on one with a land dispute between a seller (or sellers) and a buyer (or buyers) of a disputed land or house.

For those who are curious, a bank placed a PND on an account without due process, the guy understood the language of rights/liabilities, he also understood that the law does not take kindly to trampling a legal right, in less than 2 years, he was 5m richer, bank knew the judgment was solid, instead of appealing, they simply complied with the judgment of the High Court.

I will not go into the details of 10m judgment, the above example suffices.

You have a choice, go to CBN or go to the courts, it is your call.

You have a choice, use police or army to resolve a civil misunderstanding, and bear the consequences, if the other party understands the language of rights/liabilities, and also understands that the law does not take kindly to trampling a legal right, and that the police/army have no place in civil disputes, then be ready for the floodgates that will pour afterwards.

A contractual dispute is always based on the BINDING CONTRACT, and I simply pointed out that the proposal of a third party resolution cannot be legally binding to any party if it was not in the contract ab-initio. (absent a court decision)

Banking relationships in Nigeria are guided by CBN guidelines that are regulated by Federal govt laws and CBN regulations(different relationships)

And just like you said Police have no place in civil disputes unless ordered by a court of law.

When the parties cannot resolve their issues, it is time for a third party to be involved, a third party that will not take sides, a third party that will review all the relevant evidence, and a third party that will not jump into the fray, and that will give both side sufficient time and space to defend their claims.

There is no civil dispute the judiciary cannot handle!

I will take your naivete on construction disputes to be deliberate at best or innocent.

If there is no third-party adjudication in the contract, It cannot be introduced now unless mandated by a court, and we both know the country we are in. Like I said judge for yourself who is the party at most fault is.

I am sure you are confident in a Judiciary that takes 35 years to solve simple land dispute cases?

If those same clients called the banks criminal, do you know how the banks would use that against the client?

But if the same client is properly advised and proceeds against the bank can milk millions from the bank?

I know two people who fought the banks, one won 5m settlement, another won 10m using our courts.

I speak from experience don't let emotions make a bad matter worse.

I have resolved things this way and you will be surprised how efficiently they work . It is truly one of the few government organizations/processes that works in this country. Every bank is scared of the complaint process and wants to resolve issues quickly before they escalate.

If you doubt check the fines the bank pay for not resolving regular issues promptly.

This is not about emotion but simple decency.

We both know that cases like this do not belong in the courts if we really want to be decent about it.

I agree with FEGEITOK here, both parties need to communicate through their lawyers. While we obviously don't have all the information, from what I've seen, there is nothing concrete that can substantiate the allegation of fraud yet. And there is an active law in Nigeria, whoever seeks redress can always get justice. Egunmogaji has told us that.

I also think QSFemi needs to lend his voice here since he seems to be at the center of the misunderstanding. Did you present a valuation that was found to be erroneous and subsequently reviewed?

That means the client should speak through his lawyer

That also means the vendor should speak through his lawyer

Both professionals are more likely to ignore the emotions and deal with the issues as they are and not as they feel them to be

I think the Vendor needs to institute a case so that he can clear his name if he wins it will be good for his business, the Vendor may even have actionable claims for defamation and Loss of Business Goodwill

I think the Client needs to institute a case and claim for breach of contract to recover any amounts allegedly owed and damages for the pain and suffering occasioned

The time has now come for an impartial authority to be involved whether that be a judge or an arbitrator

Business disputes are common, more common that most people realize. Think Innoson versus GTB, also think Epic Games versus Apple.

Sometimes they are resolved quietly, at other times, they need external intervention to resolve. It seems this one belongs to the class that needs external intervention

I am guided by the words of the Bible that I need to be fully seized on the matter before I can make definite pronouncements as to guilt or otherwise. These snippets here are there are not enough to be fully seized of the matter to make definitive pronouncements

Since I have not seen/heard and studied all communications between the parties on the matter, I will reserve my comments.

But I encourage either/both sides to act the necessary actions to resolve this issue within the ambit of the law.

I believe you gave them a Program before the commencement of the contract. Did you work according to program or you defaulted in time ( as per items in your contract bill).

Any additional work or variation cost should be presented to the client along with its time implication for approval. Hence, the moment the client has given you approval on the additional work, you are expected to present a revised program incoporating the approved additional works


This will keep both parties in check as an increased scope of work will not be expected to be completed with the same contract duration.


Determination of the contract shouldn't have been the immediate recommendation of the Q.S. This may not favour the client on the long run. Double expenses on most preliminaries.


Based on what I read, The Clients Qs only visited the site when the project was having this issue, He should have been more frequent with the project from start. Coming in at a critical stage of the project to recommend determination seems too harsh.


Overall, I don't believe in settling issues online. This will definitely affect your brand. Most new client might want to Google your company name before awarding you a contract and seeing all these controversies popping up might not be a good one. For peace to reign, you'll need to make certain sacrifices.

You need to know what is the total linear length of the lintel. That will help you to calculate the quantity of wood and volume of material required.

I will also hire a project manager or QS to oversee your project if you have no building experience. Also always get quotes from several contractors to compare if possible

When I started building, one of my professional colleagues posted in a WhatsApp group that he has sand, gravel, etc, so I private chatted him some 10 questions and he answered less than 3. I told him he has not answered the rest of the questions, he responded that I should drive down to his quarry to get the answers. The distance between his quarry and my site is some 30 kilometers. Imagine making that journey just to ask questions.

I told him I have sent millions of naira to people I have never seen in the country and outside the country, all we ever do is communicate by email and at most phone calls, then I do my due diligence and make the transfers and I have always received what I ordered.

Told him I was going to make a major transfer in tens of thousands of dollars to someone I have never met to purchase some product for a contract I was handling that week I reached out to him. Told him I have never seen nor spoken to the individual/representative of the company in question.

I told him it must be a uniquely Nigerian thing to insist that the person must come to your location before you can answer his questions.

I told him that millions and even billions in Naira and dollars are moved around the globe between people who have never ever met.

I told him that the laptop I am using to respond to him via bought sight unseen. Told him that I would be buying a newer model of the same brand from overseas. Told him that I have never met the seller and never will. Told him same goes for the phone I am using.

Told him to open his mind, that the world has moved on.

I hope those uniquely Nigerian vendors learn, improve and change.

Nigeria is a low-trust society. I also experienced this problem when building also.
People advertise their products but will not tell you the cost or at least a price range until they see you in person.
People do not want to disclose their "last price".

I believe it is better to let people at least know where you start pricing from. So they can save you and themselves some time and self select.

btw COVID lockdown made thing better in this regard. more vendors were willing to do business remotely, but there is a HUGE OPPORTUNITY for reliable businesses in Nigeria that can execute remotely

He has a history of f***ing up his clients and their projects and absolving himself of all blame. Don't be fooled by his self-acclaim, it's all part of his modus operandi - this is the one thing he is actually good at - bluffy marketing. His lack of integrity is also unrivaled in my opinion. For every success he lays claim to, there are usually 1 million disasters...

Never had any contractual issues with him.

I could see through his bullshit back then when I was vetting for subcontractors on this forum ( for a family project).

A family member asked me to consider his services based on this forum ( I am in the building profession in the DMV area and supervise some project locally as time allows) and that is how I stumbled here in~ 2016.

I made a challenge to him years ago on this platform to show a job he has started and completed from start to finish to the satisfaction of his client. He has none to show.
Then he will come here exchanging words with his clients and insulting them calling them broke!
It is all good and flowery words until money has changed hands...then it is unto the NEXT PROJECT. THAT IS HIS SCAM.

I know some of the elders here indirectly gave him thumbs down when I enquired but I know he won't go free from this without a severe scar if he doesn't refund me.

I told him on site that I'm a young man and young people don't forget or let things go easily. I can be a dove if I want to and I can be a beast if need be.

My work hasn't stopped because of the refund but I worked for that money and will get it whichever way possible.

I had to redo 2 lintels that he did anyhow.

The fins he previously casted fell, there and then did we discover there was no rebar used. Just sand, cement and granites.

He was made to redo those ones.

Wanted to build my security house without pillars, had to use unbudgeted money to make sure my PM put pillars there.

He also didn't do German floor for the SH, rather went ahead to erect walls without pillars/German floor.

There are other things not share yet which we have managed /currently managing and correcting. ( low budget electrical and plumbing pipes, low grade steel trusses).

The beginning was smooth and sweet until 97.5% of the funds got to him.

It is sad to see that more people are falling for Nairaland's resident fraudulent builder. The number of shoddy building and damage he has done on this platform is extensive...and people keep falling for his packaging...its all good until he gets the money ....and he is on to the NEXT project

I asked her recently that we need to be praying together for our marriage even if it is 10 minutes every day, after weeks of no response from her,I approached her yesterday and scolded her about it, she cried and I comforted her, I later asked her at night to come for the prayer,and she said she is not coming.
We live abroad and my mum wants to pay us a visit,
She told me the kitchen is her's and my mum should not enter the kitchen, and I told her that it will be difficult, we can pre cook all our food, But she might need to make tea and I will like her to be able to do that by her self , but my wife refused.
In her church she is attending they already branded. My mother a witch. Even if my mother is a witch, we only need to pray against it, should we humiliate her when she visits us? I cannot make my wife my mother, she does not show me much love and does not show that she cares, neither does she respect me. My mum shows me love that I can feel.

Now we are living like neighbours in the same house.
Do you think she is interested in the marriage or has another plan?
