Although the Taliban’s takeover of Afghanistan initially raised concerns over the destruction of Buddhist statues and artifacts at the ancient city of Mes Aynak, Taliban leaders now seem to be intent on preserving the archaeological site. Hundreds of meters below Mes Aynak lies one of the world’s largest untapped deposits of copper, estimated to be worth $1 trillion. With fighters standing guard on the rocky hillsides of the site, the Taliban aims to protect the relics in the hopes of securing a contract with China to extract the copper. “[Preserving the relics] is key to unlocking billions in Chinese investment,” said Hakumullah Mubariz, the Taliban head of security at Mes Aynak. In 2008, Hamid Karzai’s administration signed a 30-year contract with a Chinese joint venture to extract copper from Mes Aynak, but the project ceased in 2014 due to continued violence in the area. The Taliban’s Ministry for Mining and Petroleum has reached back out to Chinese investors, urging them to return to the mine. China’s ambassador to Afghanistan has said that talks are ongoing, but nothing more.

For nearly two decades, the Department of Defense has used 10 U.S.C. § 127e, an obscure counterterrorism funding authority, to create and command proxy forces across Africa and Asia. The full list of these proxy forces is highly classified and yet unknown. But journalists like Nick Turse, who was recently featured on The Lawfare Podcast, have so far uncovered § 127e programs in Afghanistan, Cameroon, Egypt, Iraq, Kenya, Lebanon, Libya, Mali, Mauritania, Niger, Nigeria, Somalia, Syria, Tunisia, and Yemen. While some of the countries in which the Department of Defense has run § 127e programs are unsurprising—the United States’s counterterrorism operations in Afghanistan, Iraq, Somalia, and Syria are no secret—other locales may raise eyebrows and constitutional concerns alike. What gives the Department of Defense the legal authority to run counterterrorism operations in Cameroon, Egypt, or Niger? Particularly when the operations in these three countries have reportedly involved sending § 127e proxy forces on security sweeps, raids, and kill-or-capture missions? The Department of Defense may conduct its § 127e programs in the shadows, but the range of programs involving combat hints at how the Pentagon interprets its authority to use force. Section 127e does not itself authorize U.S. forces to conduct or direct proxy forces into hostilities; it can only amplify the United States’s capacity to conduct hostilities already permitted by an Authorization for Use of Military Force (AUMF) or Article II of the Constitution, which confers on the president an inherent authority to use force in self-defense. Working backward from independent reporting on § 127e, we can infer how the 2001 AUMF and Article II have been used. And we can conclude that these authorities may have been stretched beyond the executive branch’s representations to Congress and the public. Located about a thousand miles from Florida in the Caribbean Sea, Puerto Rico is a United States territory—but it's not a state. U.S. citizens who reside on the island are subject to federal laws, but can't vote in presidential elections. Why? The answer lies in the island's long colonial history—one that arguably continues to this day. Puerto Rico had been a Spanish colony since the 16th century, but hundreds of years of repression, taxation, and poverty took their toll. By the 19th century, an independence movement sprang up on the island. Though Spanish forces quickly quelled an armed insurrection in 1868, the country tried to diffuse tensions by allowing the island more independence. But a few decades of relative autonomy came to a halt in 1898, when the United States declared war on Spain—ostensibly to liberate Cuba from colonial rule. On July 25, 1898, U.S. forces invaded Puerto Rico and occupied it during the ensuing months of the Spanish-American War. As part of the peace treaty in December 1898, the colony was transferred to the U.S. and a military government took over. (How yellow journalism helped spark the Spanish-American War.) Puerto Ricans continued to call for autonomy. In 1900, the Foraker Act established a civilian government—but stopped short of conferring full rights on Puerto Ricans. As legal scholar José A. Cabranes explains, white American legislators thought granting statehood to Puerto Rico would force the United States to admit the Philippines, which was another U.S. territory at the time, as well asendanger the interests of white laborers and farmers, and increase racial mixing within the U.S. Instead, they granted Puerto Rico “unorganized territory” status and offered Puerto Ricans limited self-governance without U.S. citizenship. In 1917, that changed with the Jones-Shafroth Act. Seeking to address ongoing tensions on the island, Congress passed the law which gave most Puerto Ricans U.S. citizenship, but allowed the U.S. president and Congress to veto Puerto Rican laws. As citizens, Puerto Ricans also became subject to the newly enacted Selective Service Act, which led to the conscription of nearly 20,000 Puerto Rican men in World War I. But it wasn’t until the Nationality Act of 1940 that all people born in Puerto Rico were designated citizens by birthright regardless of their parentage. Then, in 1950 the United States gave the territory permission to draft its own constitution, provided it didn’t change Puerto Rico’s territorial status. In response, Puerto Rico held a constitutional convention, establishing its own republican form of government and bill of rights. In 1952, Puerto Rico adopted the official name of the Commonwealth of Puerto Rico and a new constitution. Since then, there’s been an ongoing debate about what “commonwealth” means. Some scholars and policymakers contend the term is a mere moniker, as in the state names of Massachusetts or Pennsylvania. Russian President Vladimir Putin unveiled previously undisclosed details of a draft treaty on Ukrainian neutrality during a meeting with African leaders in Saint Petersburg on Saturday. The African leaders’ delegation, which included representatives from Senegal, Egypt, Zambia, Uganda, Congo Republic, Comoros, and South Africa had visited Kyiv Friday before arriving in Saint Petersburg. South African President Cyril Ramaphosa presented a 10-point roadmap for de-escalating the conflict, urging both sides to work towards a resolution, although the first point was just to listen. The African leaders were on a peace-building mission, and Putin took the opportunity to showcase the documents that emerged from peace negotiations between Moscow and Kyiv in March 2022. However, he said that the Ukrainian delegation abruptly abandoned the agreed-upon terms after signing them. Putin showcased the draft documents, which had been under discussion between Russian and Ukrainian representatives over a year ago in Turkey. One of the documents, titled the “Treaty on the Permanent Neutrality and Security Guarantees for Ukraine,” had been signed by the Ukrainian delegation. The treaty aimed to establish “permanent neutrality” in Ukraine’s Constitution, with Russia, the US, Britain, China, and France listed as guarantors. Putin also presented an addendum outlining proposals from both Russia and Ukraine regarding the size and equipment of Ukraine’s standing army during peacetime. Moscow proposed capping the number of military personnel at 85,000 and the National Guard members at 15,000, while Kyiv suggested maintaining up to 250,000 troops in its Armed Forces. The draft further detailed the suggested numbers of tanks, armored vehicles, multiple rocket launchers, combat aircraft, and “auxiliary” aircraft, with Moscow advocating for more conservative figures and Kyiv aiming for higher numbers. The peace negotiations collapsed in the spring of 2022 following accusations by Ukrainian officials that Russian troops had killed civilians in several small cities near Kyiv. These allegations emerged after Russian soldiers had withdrawn from areas outside the Ukrainian capital as a goodwill gesture. The Kremlin consistently denied involvement in any atrocities in Ukraine. During the meeting, Putin blamed Ukraine for sabotaging the negotiations, accusing Ukrainian authorities of disregarding their commitments. He expressed concerns about the lack of guarantees for future agreements but emphasized Russia’s willingness to continue negotiations despite the setbacks. Kyiv, however, reiterated its position that negotiations could only commence once Russia surrendered Crimea, which voted to join Russia in 2014, along with four other regions that followed suit in referendums held in September 2022. Operation Cyclone was the code name for the United States Central Intelligence Agency (CIA) program to arm and finance the Afghan mujahideen in Afghanistan from 1979 to 1992, prior to and during the military intervention by the USSR in support of the Democratic Republic of Afghanistan. The mujahideen were also supported by Britain's MI6, who conducted their own separate covert actions. The program leaned heavily towards supporting militant Islamic groups, including groups with jihadist ties, that were favored by the regime of Muhammad Zia-ul-Haq in neighboring Pakistan, rather than other, less ideological Afghan resistance groups that had also been fighting the Soviet-oriented Democratic Republic of Afghanistan administration since before the Soviet intervention.[1]
