Cybercrime act does not apply here because the complainant in this case made the idiot aware he was being recorded and stated why he was recording the idiot .

The idiot did not object to being recorded and gave his explicit approval of the recording.

The complainant made the recording as evidence to insulate himself of any wrong doing as the complainant's job performance and rating would have been negatively affected by a bad review. Secondly , the complainant felt the need to record the video fearing for his own personal safety and to provide evidential proof of no wrong doing on his part and to present video evidence of the idiot acting as an idiot that he is.

The said video is why the complainant is able to secure his release from police detention after being falsely accused and arrested by the idiot. Without that video evidence, the complainant will most likely still be in police detention or at worse charged to court on trumped up allegations initiated by the idiot. That same video evidence was what made the Police IG to swing into action to ensure the victim in this case gets justice - a very rare occurrence in Nigeria .

The idiot is a narcistic pompous brat who thought he can bully just about anybody that he feels is lower than him.

So save your bullshit argument. It's such foolish legal advise that is now seeing the idiot now being arraigned in court. I pray you are part of his legal team so that your client can get convicted for assault, death threats and deliberately filing a false allegation .

Just for the benefit of doubt that you lack comprehension skills, my point in simply terms and please this time read slowly, is that the recording evidence the bolt driver circulated is valid and tenable if prosecution is pursued because it meets the exceptions of the cyber crime act and the right to privacy as guaranteed by the constitution; and that the lawmaker cannot punch a hole in the evidence under the veil of having being unlawfully recorded because he actually proved he was aware he was being recorded and even dared the driver nothing will happen.

I understand the gravity of his mistake but let us please temper justice with mercy since he has apologized and shown remorse. He is a relatively young guy and will learn a serous lesson from this his misadventure and misbehavior.

I pray that his victim(s) will find it in their hearts to forgive him. Sincerely, it's a very difficult place to be when you have ever experienced the humiliation and injustice similar to what that Bolt guy suffered in his hands and the mere thought that others may have previously suffered same or even worse form of injustice from him but got no justice.

Kindly go back to my initial comment to be sure you even understood what I was talking about! Recording someone indiscriminately is a violation of their fundamental human rights.

The legal framework around video recording without consent in Nigeria is primarily governed by the Cybercrimes Act of 2015 and various provisions in the Nigerian Constitution and state laws.

When a person records a video of another in a public space and shares it, the video creator violates the other person’s right to privacy as protected by the Constitution.

Howbeit, there are exceptions which include- Personal Safety i.e recording may be justified if it is necessary to protect oneself or others from imminent harm or illegal activities, such as threats of violence or extortion.

Now to the crux if the matter as I had outlined earlier which you obviously failed to comprehend, bothers on the admissibility of the recording as evidence. It has nothing to do with whether there was provocation or not ( and even if there was provocation, the law maker, in law, resulted to "self help" which has legal implications!). So on the contrary, you are very wrong, the bolt driver can reliably claim he did the recording because he had reasons to suspect threats to his safety and existence, and the Lawmaker did a very good job at establishing the drivers fears!

This is a public forum and people get educated and learn both consciously and subconsciously so do not assert knowledge you are not grounded on. While you are entitled to your opinions, you are not entitled to your facts!

And before you respond, which I believe you would in a bid to win an arguement rather than learn from it, I would advice you read a bit on;
1. The cybercrimes act of 2015
2. The evidence act of 2011 and
3. The constitutional right to privacy and its exceptions.

your argument is trash. Recording someone in his house is illegal and being allowed to walk away with such recording proves the reps member is not troublesome. It doesn't work that way. In law, it's not just about what happened but the cause. The bolt driver might end up getting into more trouble.

You really don't understand how the law works. There would have been a slight controversy if the law maker was unaware of the recording and could actually attack it as evidence, but he goofed when he not only acknowledged the recording but dared the victim to do it and nothing would happen.
