Hi house, my husband currently has a UK visiting visa, will he be allowed to enter now that we are married. We are waiting for settlement documents to be complete before applying. Worried if he can still come visit me on this visa or we have to wait.

Timeline

Spousal application August 6 2016
Biometrics 12th August 2016
23rd Oct - application not straight forward email from ukvi.
January 17th 2017 - visa refused - based on financial requirements cos we submitted details for self employed and full time employment, English language and not enough evidence of our relationship

Feb 3rd - appealled asper lawyers advise

March - found this forum and was taking screenshots of everything............

April - notice of pending appeal

June - emailed Manchester MP who happens to be a labour candidate and they are in full support of immigrants - got the advise from this forum


July - got letter appeal listed for December 8th 2017 - Same day the MP replied me. Lol

August 9th - reapplied since the appeal was taking too long.

August - MP wrote me to find out the progress but I told her about the new application and that I wasn't coping, i was depressed and have to move in with my mother and appeal is taking too long.

17th August - Biometrics

Oct - tls hasn't updated that his application has been received by ukvi - I asked on this forum and Lamakinde advised to fill in their complaint section.

Within 2 working days the necessary adjustments was made on the tls tracker.

25th Oct - emailed mp to say I haven't heard anything from the second application.

Nov 6th - decision made email and passport ready for collection about 20 mins apart.

Hubby who has been carrying his collection letter in his car since last week just drove straight to Ikeja to go pick it up and low and behold his visa was there.

Just need to withdraw the appeal lo ba tan and of cos update the MP. Lol

Please everyone don't ever give up. Good luck to everyone waiting.......we shall all celebrate together here in this UK....my prayers are with you always.

Spousal application August 6 2016

It's unusual for you to get not straight forward email twice in my opinion. However, There's not much you can do until you get their verdict. Until then, just keep praying and keep your faith. God will do it in his own time.
Everything you need for a successful spousal application is on these thread. I wish I knew about it before we applied.......ill advise you read from page 1 upwards. God help us all.

Just found out about this forum and wish I did earlier.Please I need everyone’s help here as I’m genuinely freaking out as this has taken way too long.

So I applied for a UK spousal visa on May 30th 2017 and I’m yet to get a response till date.
Wedding registry in feb 2017 (ikoyi registry)
Engagement and wedding in July 2017

So here’s my timeline soo far:

Application online submission- may 30th
Biometrics - June 6th
Documents sent to Sheffield - June 12th
Email confirming application received in Sheffield -
June 27th
Application not straightforward email received - Aug 24th
Escalation to MP by husband-September 13th
Email from Sheffield apologizing for delay as it’s been a busy period and aim to make a decision on or before October 31st - sep 25
Not straightforward email - Oct 16
Email received stating still working on application - Oct.30th

Should I be worried??
Also they haven’t asked for any extra documents,so we are just waiting daily for goodnews.

Please any suggestions or advice will be appreciated.

Got tls message that decision has been made in the morning while just now I got message that it's ready for pick up. Today is 57th working day.

Hi,

As long as she's been in the job for 6 months and has pay slips and bank statements to reflect these i don't think it matters if it's probabationary period or not.

2. You won't be allowed to use priority service if you've been refused a visa in that category before. I tried using priority for my husbands application after first refusal but it just wouldn't go through. Check out the exclusion criterias for the priority service to know more.

Day 55 today after biometrics :-(

Hello house.... I'm back again after about a year off this forum... @Lexusgs360, @Justwise and a few people here may remember me. Anyway straight to the point, I was denied my spouse application around this time last year for discrepancies especially because we combined two jobs for my wife to meet up with the financial requirement as her main job wasn't paying up to 18,600. They had no reason to deny because everything was legit in both jobs only that my wife contradicted with her employer during the interview with the UKVI officials due to pressure and naivety. I decided not to appeal because of the time and money that will be involved.

Fast forward to present... My wife now has a job which pays well above £18,600 and will be 6 months on the job early January which means I'm preparing and waiting patiently till January to reapply. Now to start with, I have two questions for the house (I have experience in this area of spouse visa and other UK visa applications like tiers 4 and 2 but I'm sure you all will agree with me that no one knows it all).

1. Does it matter if one is in a probabtional period at work (I'm asking on behalf of the sponsor now) in order to count the six month in the new job or the counting begins after the probational period?

2. I heard someone sometimes ago saying once one uses a standard way of applying for ones first application, one cannot use priority for the subsequent applications that one can only continue to use standard. Please how true is this.... Anyone knows?

Thanks for this. The TLS portal for my husband has now been updated to received by ukvi for a decision after I took your advice to complete the complaint form on the site...........53 days post biometrics........ this cold is no joke o.

You can actually lay complaints on the site. There's a column for complaints and your e-mail. They actually replied after I have sorted it out. They mentioned that they noticed I have figured it out myself and close the complaint.

It's safer to count from when you did the biometrics. The person that got their visa on monday got it day 58 days from the day they did biometrics......yes I counted lol. Just relax. Do things to distract yourself. I'm locking my phone up in my bag at work and turn off data completely to stop myself refreshing my emails every 5 minutes......

I don't think there's any contacts for them o. They've not updated the progress of my husband's application since the online submission 51 days ago and apparently you just can't visit the site for queries. Please do let me know if you find contact details for them.

My wife picked up her visa this morning . Thanks to all who answered my questions. Sent the application mid august and got the pickup email on Friday . For a non priority ,was quite fast . Thank God,good luck to all August applicants

It has not changed on the tls tracker but we received this email on Sept 7th. Did you get the same email as well?

Your online application has been received at the UK Decision Making Centre. Your application is currently being prepared for consideration by an Entry Clearance Officer.

If you have made a Settlement application (except for applications lodged in USA and Canada): you must ensure that your UK sponsor has sent all relevant supporting documentation to the UK Decision Making Centre in Sheffield. The documents should be arranged in this order: application form and relevant Appendix* (See below); English language evidence; relationship documents; maintenance documents; accommodation documents. If documents are not received a decision will be taken on the basis on the information that has been provided.

If you have already had your supporting documents scanned in at the Visa Application Centre, or if you have already sent them in to us, please ignore the request for documents.

Please note that UKVI aims to complete all Visit Visa applications within 15 working days and all Settlement Visa applications within 12 weeks of the application date. If it is not possible to complete your application within this timeframe a member of our team will contact you to explain why.

If you have paid for Priority Service, your application will be placed in front of the queue and assessed ahead of other non-priority visa applications. As indicated in the terms of service, the amount paid for the priority service, as well as the visa fees, is not refundable if the visa application is refused or if the decision is delayed.

Appeal takes a long time......trust me I'm still in it and yes I got the mp involved. But if you're still in the country then you have a leverage cos you can still be able to work. Good luck

Please does anyone know how the applicant can get interview at the British embassy in Lagos for spousal visa? I'm happy as the sponsor to attend the interview with him. Any ideas how to go about this? Does the applicant still has to submit his application at the submission centre?

You only need a letter from your mum stating that you are allowed to live there with your spouse. You also need to the land registry document to prove that the house belongs to your mum and also an inspection report to show there will be no overcrowding. Utility bills are NOT required for spousal visa applications only for the FLR application after the first 30 months. You probably also have to explain in the additional section or cover letter that you will be living in your mums house. The letter, land registry documents and inspection report should be enough.

Get a letter from your landlord stating spouse is allowed to live with you, including your tenancy agreement if possible and an accommodation report to state that there will be no overcrowding.

The hold on spousal applications has been due to backlog on applications not meeting the financial requirements. This was caused by the Supreme Court ruling in February this year. However, the Home Office made those changes on July 20, 2017 and will begin implementing on August 10, 2017. You can see https://www.freemovement.org.uk/home-office-makes-changes-appendix-fm-minimum-income-rule-following-mm-case/ for more details. If your lawyer doesn't know this, then I do advise that you get yourself a new lawyer or do it yourself. There's a group on Facebook that's also great at helping in this process and afterwards.
