I do not know what "rules of evidence" the military uses.
I read in daily Trust (?) some details of the trial.
The prosecution is so sorry, they did not even attempt to prove their case of mutiny.

1)The GOC had no gunshot wounds to evidence that 20 of his trained marksmen tried to gun him down.
(Did he train them so badly they could not hit the target at stone throw distance?)
2) The GOC's vehicle had no bullet holes. .
(Did Mr. GOC Mohammed train his men so badly they could not hit an elephant across a room? Or where they not shooting at him?)
The car was not even brought before the tribunal as evidence
The Judges should have dismissed the case if Mr GOC Mohammed had no bullet wounds (maybe him get juju) and his car had no bullet holes.
We like to think of the Army as a unit, but even they have disagreements among themselves.

3)Soldiers and policemen have been known to shoot their guns in celebration and on other occasions. the shootings at the barracks should not be misconstrued as attempt to kill mr GOC!
He should not take it too personal that his orders were not understood by these men who were affected by the fog of war!

Maybe the trial officers are taking the drugs we expect them to give to the boys so they can face boko haram without fear or favor but if this case is appealed and gets before a competent civilian court, the judgement will be thrown into the dust-bin where it belongs.

Seized $9.3million Controversy: APC raises 13 questions for President Jonathan
The All Progressives Congress (APC) has urged President Goodluck Jonathan to come clean on the circumstances surrounding the 9.3 million US dollars that was impounded in South Africa, which has become the latest in a series of global ridicule to which the scandal-prone Jonathan administration has subjected Nigeria and her people.
In a statement issued in Abuja on Thursday by its National Publicity Secretary, Lai Mohammed, the party also called on the National Assembly to launch an urgent investigation into the issue, saying the silence of the peoples’ representativeson the issue is deafening, unfathomable and unacceptable.
It said there is no doubt that the President is at the centre of the whole issue, considering the presidential treatment given to the plane and its cargo, since the plane departed from the Presidential wing of the Nnamdi Azikiwe International Airport in Abuja, away from the reach of the Nigerian Customs Service which could not therefore have cleared the plane and its passengers.
”It is absolutely urgent for President Jonathan to clear the air on this alleged off-the-shelf equipment or arms purchase, which runs against all known protocol for such purchases anywhere in the world. Military equipment and weapons are not bean cakes to be purchased by the road side. There are globally-acceptable protocols for such purchases by governments, otherwise what differentiates a government from an insurgent group that is shopping for arms?
”Is the Jonathan Administration not aware that the UN General Assembly on April 2nd 2013 adopted a landmark Arms Trade Treaty (ATT) precisely to regulate the international trade in conventional weapons by avoiding the kind of road-side purchase that the Nigerian government is said to have been involved in? Though the ATT has not come into effect, the fact that Nigeria is among the few countries to have signed and ratified the treaty shows that the country is concerned by unregulated arms trade,’’ the APC said.
The party said the resort to ”procedural error” to explain away the whole issue cannot work, because Nigerian authorities cannot pretend not to be aware that currency brought into or taken from South Africa is monitored by law, and that anyone bringing into that country more than R25,000 in South African currency or U$10,000 or the equivalent thereof in foreign currency must declared such.
It said that in any case, those who are using ”procedural error” as an alibi are being too clever by half. This is because if entering or leaving a country with undeclared $9.3 million is mere ”procedural error”, why was Sule Lamido’s son convicted for not declaring a mere $50,000 dollars at the Mallam Aminu Kano International Airport?
The APC said in the spirit of fairness, it has however decided to give President Jonathan and the government he heads the opportunity to make urgently-neededclarifications by answering a number of questions relating to the $9.3 million scandal.
“Is the money indeed meant to purchase a helicopter as has been reported?
“To which arm of the government or security force does the money belong?
“Who appropriated it and for what purpose?
“Why was the money being ferried in cash by the same government that has been spending huge time and money to promote a cashless policy? Is the resort to cash to avoid a paper trail for the transaction, in which case it is illegal?
”Mr. President, we are aware that each arm of security has an account with the CBN for the purpose of arms purchase and such transactions are properly documented, so why was this not the case in this instance?
‘Mr. President, why did it take your government all of 10 days to admit its involvement in this scandal, considering that the embarrassing incident happened since Sept. 5th and was not known until Sept. 15th?
“Does this saga not give credence to the widely held view that you are indeed benefitting from the the Boko Haram insurgency and that you have deliberately allowed it to escalate to this level?
”Mr. President, has this saga not confirmed the suspicion that your 2015 reelection bid has been factored into your handling of the Boko Haram insurgency?
“Has this saga not given more credence to revelations that the sponsors of Boko Haram are those closest to the President?
Has this saga not finally confirmed that the President knows more than he is telling the nation about the sudden escalation of the Boko Haram insurgency, especially in the run up to the 2015 elections?
”Mr. President, has this saga not confirmed that powerful forces in your administration are all working in concert to use the Boko Haram insurgency to secure tenure extension for President Jonathan?
“Is not clear now why the Senate President infamously declared two days ago that election is not on the table since the country is in a state of war?
“Have we not been proven right in our declaration at the panel discussion in the British House of Commons on Sept. 8th 2014 that the Jonathan administration will attempt to cash in on the Boko Haram insurgency to postpone elections?”
The party said the answers to the questions raised would go a long way in showing Nigerians that their government is not clandestinely buying equipment and weapons to fuel the Boko Haram insurgency and then profit from its own act of perfidy.
It said while the President is compiling his answers to the posers, he should ask his spokespersons to stop adding insult to injury by saying the CIA, FBI, Mossad etc also travel abroad with undeclared cash, in clear violation of the laws of their destination countries, to buy arms.
”Mr President only gangsters and terrorists conduct their businesses in this manner. Therefore, please call your spokespersons to order, while you are preparing to come clean to Nigerians on this latest scandal,” APC said.

Traditional Rulers Challenged to Wade into Osun/Oyo Boundary Disputes

It has been observed that Traditional Rulers in the disputed areas between the State of Osun and Oyo State have a vital role to play in the amicable resolution of boundary disputes between the two States.
This observation was contained in a communiqué issued yesterday in Oyo Town after a peace meeting held to settle the contention over Oba Hill Forest Reserve along with Olori, enclave by both Oyo East and Iwo Local Government areas.
Led by the Regent of Iwo land, High Chief Yekeen Orobimpe and Bariyun of Oyo land, Chief G.A. Adeleke, accredited representatives of Iwo and Oyo had earlier defended their claims on the Hill Forest Reserve.
It was apparent that neither of the two sides was willing to shift ground with regards to its claim on the ownership of Oba Hill Forest Reserve and Olori.
The meeting therefore agrees that the final resolution of the matter should be done by the National Boundary Commission, warning that status quo ante should continue to be maintained pending the resolution of the dispute.
The communiqué also appealed to residents in the border communities not to engage in any other act that could disturb the peace and the ancient bond of unity existing between the two states.
Among those who attended the meetings which was co-chaired by Oyo state Surveyor General, Mr. Issac Akintola along with his State of Osun counterpart, Mr. Raifu Akintola were the Executive Secretaries of Iwo Local Government, Alhaji Kamorudeen Alao, Ejigbo Local Government boss, Alhaji Tiamiyu Akinwale as well as the Chairman of Oyo East Local Government, Alhaji Adekunle Adegboye.

President Goodluck Jonathan has described ‘Black Scorpion’ Gen. Benjamin Adekunle as a very courageous leader, whose civil war heroics, easily made him one of the most celebrated military commanders of his generation.

In a statement by presidential spokesman, Reuben Abati, President Jonathan said that Adekunle will be honoured and remembered as a valiant soldier who served his fatherland exceptionally well at a very trying time in its history.

“President Goodluck Ebele Jonathan extends sincere commiserations to the family of late Brigadier-General Benjamin Adekunle who passed away earlier today.

“The President joins them and other Nigerians in mourning the very courageous soldier who achieved national fame during the Nigerian civil war for his gallant leadership of the 3rd Marine Commandoes in the successful effort to defend the unity and territorial integrity of the country.

“President Jonathan believes that General Adekunle’s civil war heroics, which made him easily one of the most celebrated military commanders of his generation, have ensured that he will always be honoured and remembered as a valiant soldier who served his fatherland exceptionally well at a very trying time in its history.

Fulani herdsmen invade Zamfara villages •Rape 50 women, displace 2,000

|  12.Sep.2014 | A woman was reported to have died, while 50 were raped and about 2,000 others and children were displaced in multiple attacks by Fulani cattle rustlers in Gusau Local Government Area of Zamfara State.

Findings by the Nigerian Tribune gathered that the multiple attacks which started on Monday evening, lasted till Tuesday morning.

The affected villages were Fegin mahe, Fegin kanawa, Kundumai, Ingwai and Tsaunuku.

Other were Gangara,Wonaka, Kuka gandu, Kuliwa and Lahiya.

A survivor, Malama Aisha Ibrahim, from Fegin kanawa disclosed that she and other women ran to Gusau for safety, following the ransacking of their villages by the hoodlums.

According to her, one of the victims, a middle-aged woman, was raped by eight men and she later died.

She further revealed that over 50 women were raped in the attacks.

When the Nigerian Tribune visited one of the refugee camps at Damba on Wednesday, a source, who did not want his name in print, remarked that there were about 2,000 displaced women and children in the four refugee camps set up.

He gave the following statistics; that at Damba camp, there were 478 displaced persons, comprising 263 children and 215 women, while at K/koshi camp, there were 459 displaced persons, comprising 209 women and 250 children.

He added that at Mada camp, there were 600 displaced persons, comprising 300 women and 300 children, while at Yandoto camp, there were 380 displaced persons, comprising 230 children and 150 women.

As of the time of filing this report, relief materials and food items were yet to be distributed to them. However, the state Commissioner for Information, Alhaji Ibrahim Birnin Magaji, said a committee had been set up under the chairmanship of the speaker, to ascertain the level of the situation.

Also, the Police Public Relations Officer(PPRO), Lawal Abdullahi, confirmed the incident, but was quick to add that the security operatives were on top of it.
