Let's assume that he's the chairman.... APC's constitution says NWC, not the chairman has the right to conduct an election.

You're partially right, the technical aspect here is that the NWC not chairman or the state chairman of the party can conduct primaries. And except the court says it's not properly constituted, then it holds....I'm sure the court will affirm that.

The NWC is responsible for the mode of primaries not the state chapter of the party, nor the National chairman of the party.

Primaries are organized by the NWC and not the chairman of the party.
