Gov. Makinde Condemns Declaration of State of Emergency in Rivers.

Oyo State governor, ‘Seyi Makinde, has condemned the declaration of state of emergency in Rivers State.

Recall that President Bola Tinubu, on Tuesday, declared a state of emergency in Rivers State and suspended the governor, Similayi Fubara; his deputy Ngozi Odu, as well as the House of Assembly for six months. The President then appointed Vice Admiral Ibok Ibas (Rtd.) as Sole Administrator for the state.

Governor Makinde, in his biweekly newsletter, The Business of Governance Issue 110, which was published on Thursday evening, noted that the suspension of democracy in Rivers State, through the declaration of State of Emergency, is an illegal act which must be condemned by all well-meaning Nigerians.

The governor wrote further, “I stand today to say that the declaration of the State of Emergency in Rivers State and the suspension of the executive and legislative arms of government by the presidency is an illegality that right-thinking members of society must oppose.

“Our democratic tenets must never be trifled with no matter our personal feelings and loyalties. This is the time to take a stand for fairness, equity and justice.”

The governor added: “As our democracy grows and unfolds, we must also be willing to speak up when we see anything that threatens our development as a nation. We must choose to stand up for what is right, even if it means standing alone.”

He continued, “I am glad that our great party, the Peoples Democratic Party (PDP) is demonstrating the needed strength and leadership. Yesterday (Wednesday), the PDP Governors’ Forum rose from an emergency meeting where we unanimously decided to challenge the actions of President Bola Ahmed Tinubu in a court of competent jurisdiction. We cannot fold our hands and watch the democracy we built for almost three decades be trampled upon.”

PRESIDENT TINUBU CANNOT LEGALLY REMOVE AN ELECTED GOVERNOR OF A STATE

INTRODUCTION
In an era where democracy is supposed to reign supreme giving democracy dividends to beleaguered Nigerians, the nation has once again found itself at crossroads, a sober moment of reckoning where constitutional order is being tested in the most brazen of ways. President Bola Ahmed Tinubu, the president of the Federal Republic of Nigeria, sworn to uphold the Constitution, has taken a most unprecedented and unlawful step: the suspension of a democratically elected Governor, Deputy Governor and an entire State House of Assembly under the thin guise of emergency rule. What emergency? Nigerians and Rivers people did not see or feel any such emergency.
Let me be very firm most categorically and unequivocally that no constitutional provision,statute or any known convention grants the President the imperial and dictatorial authority to single-handedly dissolve the structures of an elected state government.That may probably have been in the locust days of military juntas; but Nigeria is today not under the firm grip of a military dictatorship. The last time I checked, she is supposed to governed under a constitutional democracy that operates a presidential and republican form of government. The emergency provisions under Section 305 of the 1999 Constitution exist to restore order only in times of grave national crisis; certainly not to topple duly elected state officials. Lois X1V of France as an absolute dictator could not have done better and would therefore green with envy from his cold grave,having on 13th April, 1655, stood in front of parliament and imperiously exuded," L'Etat C'est Moi" ("I am the State" ).A state of emergency does not and cannot translate to a civilian coup d’état, executed by executive fiat through a national broadcast which torpedoed elected structures and whimsically imposed a sole Administrator who would now illegally receive Rivers State allocations from the Federation account under section 162 of the Constitution contrary to the very judgement of the Supreme Court which President Bola Ahmed Tinubu pretended..

The attached report refers. That was the same facility that the president and his AGF pointedly accused Fubara of masterminding the blast, barely 24 hours after the incident. When was the investigation done to come to such a conclusion? Mind you, that supposed blast was not on ijaw land but in Ogoniland. Remember, Wike was on TV last week, boasting that it's not only ijaws that can blow pipelines, that Ogonis and Ikwerres could also blow pipelines.
Hypothetically, assuming without conceding, that there was indeed a blast,(contrary to this attached report), how are we sure that it was not a decoy by agent provocateurs to give a dog a bad name in order to hang it, by pinning it on Fubara in order to set the stage for a state of emergency?
I say this because we saw it happen during Abacha's time.

At the height of the struggle against Abacha,
there were some incessant bomb blasts in Lagos, particularly around the road not far from Albati barracks, near Ojuelegba. Even Lagos Governor, Buba Marwa was not spared of such blasts
At the time the bombs were going off, the Abacha government was accusing NADECO of being behind the blasts, which was a lie. It was a decoy to rope in NADECO activists.

Incidentally, one of the people the Abacha junta lied against of planting bombs was Bola Ahmed Tinubu, the main reason he had to flee into exile. Buba Marwa was later to debunk that it was NADECO activists that tried to bomb him.
So therefore, we need to be circumspect when we throw out accusations such as this, within 24 hours of such incidents.
Fortunately, this attached report has even debunked that there was a blast. You could still have declared your illegal state of emergency without making up stories against the governor.
This too shall pass.

ALLEGED COMPLICITY IN ATTACKS ON OIL INSTALLATIONS: PUTTING THE RECORDS STRAIGHT

Our attention has been drawn to a number of allegations claiming that Governor of Rivers State, His Excellency, Sir Siminalayi Fubara, did nothing to dissuade criminal groups and militants from making good their threats to attack oil installations in the State.

There was also another claim that after demolishing the Hallowed Chambers of the State House of Assembly on Moscow Road in Port Harcourt, the Governor did nothing to rebuild the facility.

Ordinarily, we would have ignored the statements as mere results of lack of adequate information to the Presidency by those tasked with the responsibility of providing same to guide decision-making, but it has become imperative to set the records straight and correct the erroneous impression such narratives are creating in the minds of the Nigerian people.

First, it is important to clarify that Governor Fubara has nothing to do with the threats by militants and also did not in any way “telegraph” the reported attacks on any oil facility in the State.

It is on record that the reaction of stakeholders in the Niger Delta, especially elders, chiefs, women, Ijaw National Congress, its youth wing, IYC, as well as militants, among others, was triggered by remarks by the Minister of the Federal Capital Territory (FCT), Chief Nyesom Wike, in a live media chat, during which he dismissed Ijaws as a minority of the minorities and powerless in the Nigerian polity, saying that Ijaws are not the only ones that are militants and can blow up pipelines; that Ogonis, Ikwerres, and others are also militants and can as well blow up pipelines.

Most of the Ijaw groups and leaders even demanded an apology from the FCT Minister, which he rebuffed.

Available public records show that Governor Fubara, on several occasions and at every forum, including all the project commissioning events as well as the handover of the AW139 Helicopter to the Nigerian Air Force, between March 3 and 13, 2025, made it clear that his administration was committed to the peace, security, and safety of oil facilities in the State.

He often recalled his pivotal role as a member of the Presidential Committee on the Protection of Oil Installations in the Region, and repeatedly emphasized the need to protect oil pipelines and other facilities in the State, urging his supporters and the people of the State to avoid acts capable of destabilizing the State or sabotaging the nation’s economy.

Since inception as the Chief Executive of Rivers State, Governor Fubara has prioritized investment in upscaling the welfare and operational equipment of all personnel and arms of the Armed Forces and security agencies in the State by building livable office and residential accommodation for officers and men and donating vehicles, gunboats, helicopters, and other critical needs of the formations to enhance efficiency and effectiveness in the performance of their duties.

His commitment to total peace and good governance in the State has contributed significantly to increased oil production and revenues for the country since May 29, 2023, as the continuous rise in the accruable revenue from the State into the Federation Account has shown over the months.

On the claim that the Governor acted with impunity to demolish the Hallowed Chambers of the State House of Assembly and did nothing to rebuild the Chambers 14 months after, it is on record that Governor Fubara acted based on professional advice and guidance.

Let it be clarified that the former Governor and now FCT Minister repeatedly criticized the dilapidated and leaking Assembly Complex, and during the commissioning of the Assembly Quarters in August 2022, challenged the lawmakers to take responsibility for the poor state of the edifice, rejecting requests to rebuild it to ensure a conducive legislative environment for the lawmakers.

It must be noted that immediately after the incident of October 29, 2023, and experts’ reports, the Government decided to heed the age-old demands of the lawmakers to rebuild the facility and promptly demolished the dilapidated structure to give way to a state-of-the-art Assembly Complex, which is now nearly 80 percent completed.

It would be recalled that in the wake of the most peaceful and violence-free Local Government election in the State on the 5th October, 2024, the supporters of the FCT Minister violently attacked and razed facilities in some local government council secretariats without any reprisals from Governor Fubara’s supporters.

It is also pertinent to draw the attention of security agencies to the fact that LGAs where those attacks were unleashed are the same places that have repeatedly witnessed violence perpetrated by detractors of the Governor Fubara-led administration.

This is why it is important for the security agencies to focus on the real purveyors of violence, critically evaluate these incidents, and diligently undertake investigations to unravel the elements behind the crimes and bring them to justice without let or hindrance.

It is clearly untrue that somebody who has all the while preached peace and non-violence, even in the face of extreme provocations, would be “telegraphing attacks on oil pipelines” and breaching the peace he has worked so hard to promote and sustain for the good of the people of the State.

The Sole Administrator of Rivers State, Vice Admiral Ibokette Ibas assumed duties.

He arrived Government House in Port Harcourt about noon on Thursday.

Thereafter, he had a closed door meeting with the Head of Rivers State Civil Service, Permanent Secretaries and Heads of Security agencies including the Director of Energy Security in the office of the National Security Adviser (NSA), Ojukaye Flag Amachree at the Executive chambers.

Vice Admiral Ibas later addressed journalists and commended the manner residents in the State had conducted themselves peacefully.

He assured of doing everything possible to ensure enduring peace in Rivers State.

Vice Admiral Ibas said: "Thank you for what you've been doing so far.

"You all know that I just got in here and decided to meet with the Head of service and and the permanent secretaries and the service commanders.

"I'm going to have to meet with them to get formal briefings from all those I met this afternoon.

"And then, I believe it is only be proper for me thereafter to have something to say to you all and I assure that perhaps later this evening I'll be in the right position to address you and then address the issues that you may want to raise now.

"Port Harcourt is my city and everything appears calm and though, I know that this situation is there but we just want Port Harcourt to get back to what it has always been."

Vice Admiral Ibas had arrived Port Harcourt International Airport at about 11.27 am in 5N-ARA bombardier aircraft.

Why are you even comparing us to the US when it’s Nigeria we are taking about? The President explicitly read out the particular section of OUR CONSTITUTION that supports his action and you’re still here yarning dust.
The section 305 states that in an event where there’s a conflict among the 3 arms of government such that one stops the other/others from functioning and as a result, there is a breakdown of law and order (anarchy) in the state—the one which threatens National security and economy, the President has the right and power to wade in and declare the state ungoverned since according to the constitution, a government is said to exist ONLY when all the 3 ARMS are functioning.
If a fight erupts in any of the 50 states of the US between a governor and the legislatures and violent break downs of laws and order becomes the order of the day and the governor is deemed unable to contain the crisis, the President of the United States can use his emergency powers to suspend such governor. Get yourself educated more and stop being pushed by your emotions.

It has happened in Nigeria multiple times and on both occasions, the Supreme Court of Nigeria did not rule on it whether it’s legal or illegal.

So the President can do it in Nigeria until the Supreme Court says otherwise because the provision in the constitution is ambiguous and can be translated to multiple things.

Lastly, Nigeria constitution is different from USA constitution.

Listen to Elrufai today, the Supreme Court of justice ruling on the suspension of dariye and fayose frowned on the invoking of the section 305 during obj era. The deeds have been done on it before Supreme Court of justice declared their judgment on it.
