A Federal High Court in Abuja has ordered that President Goodluck Jonathan be served with court documents in a suit seeking to disqualify him from seeking re-election in the forthcoming poll. There are two pending suits seeking Jonathan’s disqualification from participating in the presidential election now re-scheduled to hold on March 28, before Justice Ahmed Mohammed of the Federal High Court, Abuja. There is another suit seeking to disqualify the President from the forthcoming election pending before the Court of Appeal in Abuja. Justice Mohammed, to whom the fresh suit was assigned, on Friday, granted an ex-parte order directing the service of the court papers on Jonathan. The judge ordered that the court papers be served on the President either through the office of the Secretary to the Government of the Federation or the Attorney General of the Federation. The judge made order for substituted service on the President Jonathan following the complaint of the plaintiff, Nkemjika Nkemjika, in his ex parte application that it was impossible to effect personal service on the President, who resides in “the well-fortified Aso Rock Villa, Abuja.” The President, the Independent National Electoral Commission and the Peoples Democratic Party are the defendants in the suit. Nkemjika asks the court in his suit marked, FHC/ABJ/CS/1112/2015, to determine whether, having regard to the provisions of sections 135(1)(b) and 135(2)(b) of the Constitution, Jonathan was qualified to contest this year’s presidential election. The plaintiff argued that Jonathan’s second term in office will end on May 29, 2015, because Section 135(2)(b) of the Constitution that determines the tenure of the office of the country’s President, did not make any provision for a Vice-President to complete the unexpired tenure of office or unexpired term of office of a deceased President. He contended that the President would have been eligible to further contest this year’s presidential election if he had won an election overseen by the Senate President in 2010 in accordance with the provision of Section 146(2) of the Constitution. Section 146(2) provides that: “Where any vacancy occurs in the circumstances mentioned in sub-section 1 of this section during a period when the office of the Vice-President is also vacant, the President of the Senate shall hold the office of the President for a period of not more than three months, during which there shall be an election of a new President, who shall hold office for the unexpired term of office of the last holder of the office.” The plaintiff urged the court to nullify the nomination of Jonathan as PDP’s candidate for the forthcoming presidential election in view of the provision of Section 135(1)(b) of the Constitution to the effect that “a person shall hold the office of President until he dies whilst holding such office.” He equally wants the court to declare that the two terms limit, allowed President Jonathan as a democratically elected president under the Constitution, shall elapse on May 29 this year. He further prayed the court to declare that Jonathan is not qualified to stand for election in view of the provisions of sections 135(1)(b) and 135(2)(b) of the Constitution. Says postponement of election orchestrated by PDP Mohammed Aminu in Sokoto Sokoto State Governor, Alhaji Aliyu Wamakko, on Sunday called on the service chiefs and the Inspector General of Police (IGP) Mr. Suleiman Abba, to resign immediately for orchestrating the postponement of the February general elections. Wamakko to Service Chiefs, IGP: Resign Now for Dereliction of Duties Wamakko made the call following the postponement of the Presidential, National Assembly, governorship and state assembly elections to March 28 and April 11 for security reasons. Speaking with newsmen in Sokoto, Wamakko averred that all the service chiefs and the IGP should resign now for failing to perform their duties. He maintained that they had failed the nation and Nigerians and as such had no reason to remain in office. "The service chiefs and IGP should, therefore, honourably resign as they could not guarantee the elections as their statutory and civic duties," Wamakko said. The governor emphasised that the postponement of the election was uncalled for and not the required plausible solution to their phobia. According to him, the elections should have gone ahead on February 14 to allow Nigerians to elect the candidates of their choice in line with their quest for change. Like actions in Hollywood blockbusters, gunmen, which number could not be easily ascertained, on Friday morning raided a printing press in Shomolu area of Lagos State, carting away copies of a book on the administration of President Goodluck Jonathan. Our correspondent gathered that the gunmen harassed the printers and took away copies of the book, entitled Two-Faced Jonathan: 100 Reasons Why Jonathan Must Go, authored by Blessing Agbomhere. Workers in the printing press who were too frightened, could not ask questions or confront the gun-wielding men suspected to be security operatives. Speaking to journalists on the development, Agbomhere said the book was scheduled for launch at the Nigerian Union of Journalists (NUJ) Secretariat in Lagos, before the incident. Agbomhere, who is also the initiator of Change Ambassador of Nigeria (CAN), said, “This book was being printed in Shomolu and I was told that the book that was to be launched today (Saturday) was taken away after someone within the printing press, who has sympathy for the Peoples Democratic Party (PDP), alerted security operatives about it. “They came and confiscated all the printed copies of the book. They came in mufti. “We don’t know the arm of security agency that they belong to, or whether they are private individuals or not. “The printers had to immediately release the books to them, because, they were heavily armed. I am not owing them. I have already paid them.” Agbomhere added that the book mirrors Jonathan as a “President of the cabal, Tompolo, Asari-Dokubo and a few other corrupt elements, who are sponsoring Boko Haram to destroy Nigeria’s unity. “The book says President Jonathan has failed to defend the Constitution of the Federal Republic of Nigeria and as such should not seek re-election or ask for a job he know he doesn’t have the capacity to do,” he said. The author dared Jonathan to act on the Nigeria National Petroleum Corporation (NNPC) forensic audit report and bring those indicted by the report to book. Also speaking, Ibilola Essien, a social entrepreneur with Act Now Nigeria, a non-governmental organisation, said the present administration has not done enough to salvage the country from the many problems besieging it. Boko Haram is flush with cash and weapons after a string of battlefield advances, but the fighting group could face a tougher fight with Nigeria’s neighbours, US intelligence officials have said. In an assessment of the group, whose five-year uprising has included massacres and kidnappings and spread from Nigeria into neighboring states, the officials said they did not believe it posed a major threat to Nigeria’s oilfields in the south. They said the group has about 4,000-6,000 “hardcore” fighters – considerably less than some estimates which have put the group’s size at up to 10,000. The group is “financially secure” from bank robberies, kidnappings and other sources, and is able to go “toe-to-toe” with the Nigerian military after capturing an arsenal of arms, the intelligence officials told reporters. However, the group could soon face an unprecedented test on the battlefield against more capable forces from Cameroon, Chad and Niger, they added. The military intervention of neighbouring powers “potentially can be a game changer in a positive way,” one intelligence official said. The officials, who spoke on condition of anonymity, said Boko Haram were believed to be still holding about 300 schoolgirls they kidnapped early last year and had dispersed them to multiple locations. Around 10,000 people were killed in Boko Haram attacks last year. The Sunni Muslim group poses the biggest security threat in Nigeria, Africa’s top oil producer and biggest economy. Concern over the insurgency appears to be and one of the main reasons for what appears to be a surge in political support for opposition leader Muhammadu Buhari in a February 14 election. Many Nigerians believe Buhari, as a former military ruler, will be able to bolster the army’s hapless efforts to counter the insurgency, and that as a Muslim he may even be able to take some of the wind out of Boko Haram’s ideological sails. The officials said the group had been engaging in both small-scale and larger attacks in recent weeks and they expected this mixed pattern of operations to continue during the election period. The US officials’ comments came as Boko Haram suffered heavy losses after launching a major attack into Niger on Friday for the first time. The Chairman of the Independent National Electoral Commission, Attahiru Jega, has concluded a briefing meeting with 25 civil society groups in Abuja Saturday informing them that all security agencies in the country have indicated to him, in writing, that they are not available to support the elections planned for February 14 and 28. Mr. Jega, who had an earlier meeting with political parties, is rounding up another meeting with his 36 resident electoral commissioners now on what will amount to an INEC position on whether to postpone or go ahead with the elections. Insiders at the meeting said “its pretty much a done deal at this point that the elections will be postponed” and many of the attendees told PREMIUM TIMES they were shell-shocked and depressed at what they characterize as “a clear case of political blackmail of the state against civil society”. Jibrin Ibrahim, a leading African election expert and senior fellow at the Centre for Democracy and Development, CDD, in Abuja, who was at the meeting, said Mr. Jega told the meeting that security operatives from all the agencies told INEC that they were commencing a six weeks special operations against Boko Haram insurgents in the north eastern corridors of the country and would rather not be distracted by the elections. Mr. Jega announced that the security forces also said the operations are due to commence on February 14, the date INEC had planned for the presidential and federal legislative elections. This decision, by the security forces, successfully renders INEC’s hitherto insistence to go ahead with the elections a risky venture.
