The learned judge relied on section 159 of the 1999 constitution, which states that not less than one-third of all members of the commission can form a quorum for any meeting at which decisions may be made, which should guide the activities of INEC, so described in part I of the third schedule of the 1999 constitution.

JUSTICE Mohammed Liman of a federal high court in Lagos, on Thursday, said the Independent National Electoral Commission (INEC), as currently constituted, was incompetent to conduct any election in Nigeria.

Justice Liman gave the verdict while delivering a judgment in a suit brought before him by the Action Congress (AC), challenging the composition of INEC and its power to conduct or take any decision.

According to him, the electoral body was not competent to conduct or organise any election in the country, because the quorum of member recommended by the constitution was not met.

The court said the quorum of INEC was five members, by virtue of Section 159 of the 1999 Constitution and not four as it was the case presently, adding that the four members currently on the board of the commission were not competent to take any decision in the name of INEC.

The AC had, in December 2009, dragged before the court the INEC chairman, Professor Maurice Iwu and three other members of the board of the commission, alleging that the respondents lacked the quorum to conduct the rerun in Osun State.

Apart from Iwu, the party also joined Philip Umeadi, Victor Chukwuani, A. Shoyebi, the Resident Electoral Commissioner (REC) of Osun State and INEC as respondents to the suit.

The party, through its counsel, Mr Femi Falana, sought an order of perpetual injunction, restraining the respondents from taking any decision on the election until the quorum was formed in accordance with Section 159 of the 1999 Constitution.

However, INEC, in its reply to the suit through its counsel, former Attorney-General and Minister of Justice, Mr Kanu Agabi, said the objective of the application was to review the judgment and orders of the court of appeal and to frustrate indefinitely the conduct of the election.

Justice Liman noted that the reliefs sought by AC were within the jurisdiction of the court and that the reliefs were never an issue before the court of appeal.

The judge also refused to upheld the prayer of the AC that the tenure of the Osun REC had expired before the rerun, stating that the plaintiff failed to provide the court with any evidence showing the date the REC was appointed to enable it to take a decision.[/b]

[b]The memo presented to the Federal Executive Council (FEC) yesterday by Information Minister Dora Akunyili asking Yar’Adua to present a letter of vacation to the Senate as required by section 145 of Nigeria’s 1999 constitution. The full text of the memo below:
STATE OF THE NATION

1. I want to start my humble submission by stating that I am a 100 per cent loyalist of President Yar’Adua. He appointed all of us because he trusts us and wants us to help him to run government effectively and efficiently. Mr. President has given all of us seated in this chamber the opportunity to serve our nation as members of this council.

I believe that in the choice of all of us, as individuals and group, Mr. President must have considered our ability to guide him aright to serve our people better, promote and protect the constitution in line with the oath of office taken before him in this chamber by each and every one of us. President Yar’Adua is very dear to me just as he is to all of you.

2. We are all aware of what has been happening in Nigeria, especially as it concerns the issue of making the Vice President an acting President. There have been debates for and against. 3. Some have argued that there is no vacuum and that it is okay for the Vice President to function as Vice President, not as Acting President pending the return and recovery of Mr. President. For the proponents of this theory, I want to remind them that Permanent Secretaries had been waiting to be sworn in for over two months now. Consequently, many ministries are without Permanent Secretaries including my ministry.

As it is today, the Vice President cannot take any document to National Assembly. In a very desperate situation like the recent Jos crisis, the Vice President deployed troops to Plateau, but many have openly said that he does not have the right because there cannot be two Commanders-in-Chief at a time.

4. Just recently, Movement for the Emancipation of Niger Delta, MEND, has opted out of the amnesty and resumed hostility. They argued that they have been kept in limbo since the President took ill and they appeared to have been abandoned since nobody could talk to them or keep the promise made to them. Our economy is once more being threatened.

5. The past Chief Justice of the Federation swore in his successor for the first time in the history of our nation. The power vacuum at that level has also compounded our ‘poor image’ at the international level because of our failure to rise to international expectations, commitments and engagements that require the presence of our President.

Many of those opportunities have existed in the past 70 days that I do not need to recount. I do not need to repeat the uncomplimentary statements made by United States, United Kingdom and EU concerning the current state of affairs in Nigeria .

6. There has been persistent agitation by the public for members of the Federal Executive Council to do something. Nigerians expect us to rise to this challenge on behalf of our President as the leader of this administration. Some eminent citizens have spoken. They include former Heads of State and others who have served our nation in various capacities.

The Senate has also taken a position of which we are all aware. The looming crisis in the system is over boiling. Our hard earned democracy is being threatened by the day.

7. What went wrong? We love our President but we should remember that he is not infallible. Before he left Nigeria he had a moral and constitutional obligation to officially inform the Senate and hand over the mantle of leadership to the Vice President pending his return and recovery. That did not happen. Yes, the mistake has been made by our Boss and our brother.

Mr. President is ill and did not choose to be sick. But while we continue to pray for his recovery, we should try to right the wrong.

8. Some have argued that he left the country in a hurry. This argument has been punctured by the fact that he signed the Appropriation Bill for National Assembly. If he could sign the Bill, why did he not sign a letter for Vice President to act on his behalf until he is well enough?

9. We have a local proverb that says that “A goat does not get strangulated by the rope used in tying it when an adult is present.” We are all in a better position to know that the polity is overheated to a frightening level. Posterity will judge us harshly if we do not positively intervene to resolve this logjam.

10. I wish to call on the Federal Executive Council to act now in the best interest of our dear President and our dear Nation.

We also need to save ourselves from shame because our stand is becoming very embarrassing. He has been away for about 70 days now, even if he returns tomorrow, is it not better for him to rest and recover before taking over from the Vice President?

11. We need to do what is morally right and constitutional for the President to officially hand over to the Vice President to function as Acting President. If he does not, we can evoke whichever aspect of the constitution that should make the Vice President an Acting President.

On the other hand we can take advantage of the 14 days ultimatum by the court which will expire on Friday. When the President resumes duty as soon as he recovers, by the grace of God, he takes over his position.

12. I am not saying that President Yar’Adua should resign or condemn him for being sick. He did not choose to be sick. We will continue to pray for him, but all I am saying is, let us encourage him do the right thing so that our hard earned democracy will not be truncated. Anybody who feels otherwise is unfair to our President (who has been preaching the rule of law), and utterly unfair to our country.

13. The name of our President and all his achievements are being rubbished by this unfortunate debacle. The President and his family are also being put under undue pressure which will not help his recovery.

14. If we fail to act now, history will not forgive us. I rest my case.[/b]

Yar’Adua’s Minister for Information, Dora Akunyili, created a fiasco at the Federal Executive Council meeting in Abuja today as she submitted a memo calling on the FEC to face up to the reality of Yar’Adua’s incapacitation. She expressed the view that they should urge their principal to transmit a letter to the National Assembly to facilitate a smooth transition. Predictably, the memo, in which she warned that the FEC had taken the Nigerian people for granted for too long and should do the right thing by urging the president to step down, was shot down by hawks in the cabinet, who did not permit it to enter the agenda.

An FEC source told Saharareporters that although Mrs. Akunyili's brave memo was rejected by the hawks, a “cowardly” majority of the members actually supported her position and some of them even congratulated her after the meeting, which lasted only 90 minutes.  After the meeting, Mrs. Akunyili briefed the media about the downward “review” of Federal Capital Territory land rates, but did not say anything relating to Yar’Adua’s health.

The atmosphere after the FEC meeting was reportedly tense, and the ministers hurriedly left the Aso Rock Villa to avoid speaking to the press. Last week, the Attorney General of the Federation, Michael Aondoakaa, claimed after the FEC meeting, in response to a 14-day Federal High Court order that lapses this Friday,  that Yar’Adua was fit to continue in office

Great, I envy those students. I think the reason Y we have lots of 1st class grads from mostly 1st generation university, even though Unilag isnt one, is that U have lecturers who also graduated wit 1st class when they were students 2. Though I didnt go finish from a 1st generation University, not even a 2nd generation, but a state university. It baffled me that weneva i wrote an examination 4a course taken by a visiting lecturer I score nothin less than 'A', but rarely would I score A in a course lectured by say my HOD or other lecturers in my department. A reason Y couldnt make a 1st class but a weak 2nd class upper

pls get ur facts,unilag(1962) is a FIRST GENERATION UNIVERSITY, other skls in that class are UI(1948),UNN(1958?),ABU(1962),OAU(1962).Prior to independence in 1960,U.I was just a university college affiliated to university of London and became a full fledge university around 1960-1961.any other skl whether uniport,uniben,unilorin etc ARE IN THE LOWER or later CLASS,they were set up and even up till now run by products of these 1st generation skls,OSU came to akoka to get VC,LASU went to UI to get VC,this trend still continues till today,it smacks of infantile rubbish wen u come online and compare unilag with lasu,delsu,unilorin etc.IN FACT,UNILAG dons were consulted in the setting up of lasu etc.

If u re privileged to attend unilag,walahi,just try it,u'll see extremely gifted students who are enormously talented in the skill of managing acada with paroles,the school is not strictly for bright,poorly-exposed and socially awkward students/lectures unlike other skls, give it to unilag,the school is tough to even enter!you will anyday prefer admission to unilag than these abraka high skl(delsu),"young shall grow"unilorin,ojo high skl(lasu) and wot have u., i once met a unilag student from kano who in his set in prestigious NMS(Nigerian Military skl) was the best complaining that in his unilag class every semester produce new champion and he only topped his class once wen he was in his 200level and since then its very difficult to get to the top even though he is still doing great!The guy was seriously challenged by the enormous pressure he is facing to even get a first class even as very smart as he is,he is still on 4.3 cgpa with a session to go!

until i read this,i neva thought there really could be this dirty politics in wage particularly on issues that would benefit members of the same sectors!The Nigerian doctors tink increasing the pay of other health workers is nt in their interest!even after their pay has been jacked up and in the midst of this,where does the interest of nigerians lie?
read this and pls comment if this politics is in the interest of Nigerian health progress or politics?
Are the doctors truly selfish?

The Pharmaceutical Society of Nigeria (PSN) has kicked against the alleged attitude of doctors in ensuring that they determine what other health workers can earn in the health sector.

Reacting to a statement by the Nigeria Medical Association (NMA), PSN Secretary-General, Pharm Gbenga Olubowale described as the height of professional recklessness and selfishness for doctors after getting the new medical salary scale (MSS) approved for them by the Federal government are busy monitoring negotiations of other health workers with government so as to determine what they can earn.

Pharm Olubowale noted that ever since the Medical Salary Scale (MSS) was imposed on the Public Sector in 1991 by late Prof. Olikoye Ransome-Kuti, the health sector has not known any peace.
According to him, “we at the Pharmaceutical Society of Nigeria (PSN) make bold to equate the position of the Nigerian Medical Association as the pinnacle of its numerous absurdities. The disposition of the Nigerian Medical Association (NMA) to negotiate wages for its members and proceed to dictate what others can earn is a grievously despicable act which has been encouraged by the Federal Government and its retinue of officials since 1991 when late Olikoye Ransome Kuti imposed the infamous Medical Salary Scale (MSS) on the Public sector in utter disregard of due process, as the Medical Salary Scale (MSS) proposal was tabled at a Federal Executive Council meeting without inputs of the Labour ministry at that time.

“Doctors had argued in the 90s that the major imperative for the Medical Salary Scale (MSS) was the prevalent economic hardship and the brain-drain syndrome in the health sector. The PSN believes that it is a matter of commonsense that the economically inclined problems affect all workers in Nigeria including those in the healthcare sector. The brain drain syndrome affects all cadres of healthcare workers in Nigeria today. In the profession of Pharmacy, less than 5,000 pharmacists practice out of about 13,000 practitioners who have registered at one time or the other to practice Pharmacy in Nigeria.

“The interesting feature about brain-drain in pharmacy practice is that we have both an internal and external dimension. While over 5,000 pharmacists have migrated abroad, another 3,000 have moved to more lucrative sectors like telecommunications, oil and gas and banking within our shores. For obvious reasons the broad spectrum orientation of Nigerian Pharmacists enables them to adapt to other terrains with ease because of versatile skills their training compels.

“It is strange and unimaginable in the antecedents of labour struggles for groups to negotiate what they want and still insist on being sole determinant of what other aggrieved colleagues/workers must earn. For too long stakeholders in health and government have allowed doctors to glamourise stupidity by giving the impression that healthcare begins and ends with the input and outputs of doctors. We find it necessary to remind the Federal Government that the politics of wages and salaries in organized labour has not attained equilibrium since 1991 when the Medical Salary Scale (MSS) was introduced by the Babangida government.
“The discriminatory wages for doctors in the 90’s triggered agitations for exclusive wages for University lecturers, teachers in public schools (TSS) and other group of workers.

Every responsible government must see beyond the philosophy of a superiority complex doctors continue to foster on others in health sector, because discriminatory wages will inevitably result in vicious cycle of industrial disharmony with the attendant negative health indices and indexes which confine us to being one of the worst 10 health systems in world ranking.
“Over time, we have continually witnessed a propensity by doctors and Nigerian Medical Association (NMA) to mouth a process of dialogue and cooperation with Pharmacists and the Pharmaceutical Society of Nigeria (PSN) its umbrella body. Ironically, the NMA agenda is always laden with an abundance of mischief and ignorance of prevailing world standards. Postulations and posturing in matters of health policy have also been characterized and based on imperfect logic founded on defective logic. We therefore call on the Federal government to re-focus to avoid a major catastrophe in the health sector in the months ahead as we shall insist on our rights as Nigerians who must enjoy equal status with fellow citizens.

“Maybe we should remind our medical doctor friends that a profession is identified by the willingness of practitioners to comply with ethical and professional standard which exceed minimum legal requirements.
“We are aware that medical ethics globally encourages the appreciation of the skills and experience of other health workers and the team concepts in healthcare delivery in so far as this contributes to the care of patients and we ask where indeed is medical ethics in Nigeria.

Continuing, he said, “the Pharmaceutical Society of Nigeria (PSN) believes there must be reward for labour for all categories of workers in Nigeria. Government must be inclined on moral perpendicularity and forensic righteousness to make this attainable. The PSN reiterates very strongly that irrespective of the many unnecessary salary nomenclatures, government must embrace the recommendations of its own job evaluation report conducted on all health workers in Nigeria by the Federal Ministry of Health and office of the Head of Service of the Federation.

“That appraisal process took Federal Government officials too many states of the federation and the various teams discovered that over 97.5percent of those who visited doctors ended up in pharmacy departments for drug therapy which is still the prime solution in most clinical discourses. The job evaluation report prescribed a ratio 10:8.7 in the fixing of wages of doctors and pharmacists. We reluctantly accepted this because of the extra year doctors have to go through at the undergraduate level of training.

The PSN makes bold to declare that it will not accept anything other than the scientifically based indexes employed in the job evaluation report and we have in furtherance to this solidly posited to government. We submit that we do not thrive on ventilating invectives, but it pertinent to put on record that nothing that is morally wrong can be politically right. If Nigeria wishes to redefine values then we must not encourage the personality and professional cults which promote a cycle of redundancy in human capital development for self serving and egocentric reasons at the expense of national growth.

I was just thinking about the way our leaders,particularly the minister ve behaved and performed in the discharge of their duties so far,I took the liberty to make my own list of worst performed/performing ministers(call it a hall of shame if you like),i am sure you ve yours,i tink we owe it to remind them that we have a dossier on them and justifiably disappointed in them and our prayers(not curse oh) are not with em
1.MIKE AONDOAKAA(minister of Justice and attorney general of the corrupt/ibori affairs!
2.SAM EGWU(minister of education,partying wen all public universities were shut!
3.RILWAN LUKMON(minister of petroluem,holidaying in vienna right now wen people are sleeping in fuel stations due to fuel scarcity!
4.DORA AKUNYULI(minister of info,incompetent, plain dumb and incandescently annoying in the handling of NTA #8.5b fraud and Yardua's failed govt.policies!
5.OJO MADUEKE,(minister of foreign affairs,spent a whooping #2.5b on foreign travels doing God knows and demanded for increase budget for 2010 budget!

human kinetics isnt useless,its an edu course,all edu courses have an advtge over single sci ,arts,soc-science non-professional courses,edu courses have a guaranteed edge in securing edu jobs and career while maintaining equal chance with the other courses in other fields like banking,oil and gas,telecoms etc.There's also the advantage when eventually teachg profession is fully professionalised,others must take exams to get license to even set up and register skls and teach in accredited skls,just do ur best to make the best of any opportunity that presents itself to you at all times.

you can but its very risky,if you get caught,damn,you are OUT(its called double matriculation and in the students handbk,the punishment is expulsion).you can do ume again and choose another skl ,wen u finish com bak 2 lag for ur PG.or reject ur admission TO CHOOSE LAG again or risk it if you can,best regards

If she's sincere and upright as i would wANT to beleive,I think the least she can do to assuage nigerians is to render a public apology simply cos apart from the taxpayers money already wrongly appropriated(due to her failure to peruse and exhaustively debate the merit of the contract particularly when the money wasnt in the 2009 budget and AIT had gotten favorable overtures from FIFA to cover the world cup),the fact that these items failed to serve the purpose for which she publicly announced would be served and yet to even arrive in the country almost 2months after the event ended is a hugely embarrassing indictment on her!For Godsake,this mess could have been averted if she's patriotic in a deal between ur country and an international company!
I personally expect her to be sober!Infact resign,it would be one-less-arrogant incompetent elitist who made a fool of my country in the face of the world.Shiorrr. angry

It is with disappointment that I throw this question to n/ldrs.When I watched the amazon of NAFDAC,Prof. Dora Akunyuli (now minister of information)on AIT this morning,this question came to my mind.She was asked by senators how the NTA contract letter(crafted by NTA execs to steal a whopping #8.5b) got to the presidency,she said,"I didnt study it,as soon as i recieved it,i produced a cover letter for it and forwarded it to the presidency! shocked
This statement shocked the senators and Sen.Manzo asked her if the letter contained insults to the president,she would have covered it and taken it straight to the president!(Our Dora just sat there looking, ,infact i tink for a minister cum Prof of her calibre,its either plain stupid or she's part of the plan to steal #8.5 b)
The contract was for OB VANS and HD cameras for the FIFA under 17 world cup,and after part payment by FG,THESE ITEMS are yet to arrive in the country even almost 2months after the conclusion of the world cup!
