Individuals and even corporate organizations are mere tenants to the the real owners, the governments! hence, the issuance of cofo, consent, excision, ratifications et al. Once a property is abandoned as it will be, when the biafrans bolt, the properties will revert to the real owners that is the state government, local government or federal government vide a legal principle called bona vacantia. Note the legal principle of quic quid plantatur solo solo cedit, he who owes the land owes what is on it, all the developments on the lands become that of the real owner. Assuming a fire incident just occurred that damaged parts of a building belonging to a widow. And the widow discovered that her husband while alive took a fire insurance on the building. If the widow approached you for advice, what are you supposed to tell her on how to make such claim under the fire policy of her late husband? First, you need to establish the following: Was the premium due on the fire policy paid before the incident? Was the fire policy still running as at the time of loss? The above questions form part of the general claim conditions in insurance. Now if the answers you got to both questions is Yes, then you can proceed with the claim processing. However, before you proceed, you need to understand what a Fire Insurance Policy is. A Fire and Special Perils insurance policy is a policy that indemnifies the insured against loss as a result of a fire incident. The policy covers not just that, but other perils called Special Perils which include storm, flood, impact, landslide and so on. A fire policy will respond when there is a fire damage to a building (partial or total loss). The following are the steps you will take to make a fire insurance claim: Notification: The single most important thing immediately an event that led to a claim is to notify the insurance company. Notification is quite important that delay of it can spell doom on the claim. It could make you forfeit the claim if you did not report in time. It should not be more than 15 days or depending on the insurer’s policy stated in the policy document. The notification can be by either phone call, email or letter. Documentation: After the notification, the insurance company will write acknowledging the claim and stating in their letter those documents you will provide and forward to them as evidence of substantiating the loss. Such documents as: Completed Claim Form (Blank copy to be provided by the insurer) Photographs of the damaged structure List of Items damaged Estimate for reinstatement, replacement or repairs of damaged or destroyed items Fire Brigade Report/Eye Witness Report Relevant Invoices/Receipts Stock record taken before and immediately after the incident Recent valuation report prior to the incident Note here that all the above claim substantiating documents must be forwarded to the insurer to foster the processing of the claim. Inspection: After the documents, has been received, the insurer will review them and appoint their adjuster to inspect the premises. The adjuster confirms the authenticity of the amount demanded as the cost of the repairs. He adjusts the claim accordingly making use of the present market value of the items as the basis for his adjustment. At this stage, a fraudulent claim is spotted. Also, outrageous or over bloated claims are cut to size. During this stage, the adjuster may demand for additional documents which must be provided without delay. After all that, the adjuster prepares his report from the investigation and forward same to the insurer. Settlement offer: The insurer uses the report to issue their offer which must be in line with the terms and conditions of the policy document. The offer will be an adjusted figure from the claim (not the exact figure). Here it should be noted that it is not possible for you to get the full value of your claim as a result of a term called ‘indemnity’ (we shall deal with this in our subsequent post). The offer will be sent to you with the discharge voucher for you to executed (sign). If you accept the offer, then you sign the discharge voucher are return same to the insurer. However, if you reject it, then you send the offer back to the insurer with a letter for re-negotiation. It is important to note here that as an individual you are at the mercy of the insurance company. There might not be much you can do regarding negotiations, that is where you need an Insurance Broker. An Insurance Broker is a professional like a lawyer, doctor and so on. Their role is to interpret policy documents, negotiate rates, administer claims, negotiate settlement offer and so on with insurer. They have a huge influence on insurers.
