Actually the speaker can declare their seats vacant. Which the formal speaker that resigned have done. The governor just allowed them because of the peace deal with the president. But they refused to respect themselves and begin to act anyhow. They are the once that will now go to court to challange the matter. By the time the case will reach the supreme court their tenure will have Expired. They are losers

Their seats have been declared vacant, and until a superior court says otherwise, they are no longer members of the Rivers House of Assembly.

Those that went to court have fact that you don't have. Their records of defection may be handy with them. I think they have even started attending PDP meetings. That alone can nail them. Even after the man had quoted relevant section of the constitution on what constitutes defection and the consequence of defection.
That you go on the floor of the Senate or house assembly to declare that you have defected or what have you, is just a sign of senate or house assembly protocol and not written in the Nigeria constitution or any extant law.
If the defector has written to his party and verbally declared same, the defection protocol has completed and can be tender in evidence.

A court would still need to establish wether or not there is/was a division in the political party both at National or State Levels... PDP is obviously not in their best moments so problems in the party is very arguable.

Aside from that, I believe the law gives the power to the speaker of the house to even give effect to the said law by declaring the defected lawmakers seats vacant.. so who is the speaker of the house? Or u think the minority 4 lawmakers will just impeach the speaker & suspend the other 25 majority to do this? That hatchet job is possible in Nigeria with only the backing of the Presidency like Obaseki in Edo.. can Fubara boast of such backing in 2024?

Why those who support Fubara reason like Ipobidients I do not know. They claim these guys defected who read their detection letter? As of when they defected the court had Ehie as the speaker. Ehie passed the budget for Fubara. If Fubara thinks otherwise he has no budget presently. Now did Ehie read their defections on the floor of the house?

Stop talking like a child! Constitutionally those assembly members lost their seat the moment they decamped to APC. so they can't impeach him that was their Bleep up. They should have stayed in PDP then impeach his ass.
Section 109 of the Constitution provides,thus:

(1) A member of a House of Assembly shall vacate his seat in the House if:

g) Being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of any other political party before the expiration of the period for which that House was elected: Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored;

Are you aware that the governor can join in the enforcement of the constitution, since they fragrantly go against the constitution by their defection? I remember OBJ and the Attorney General of the Federation suing Atiku then when he defected to AC in 2006. What saved Atiku was, defection doesn't affect executive arm but only legislature.
My only grouse is that figure head Damagum that refused to do anything about it till date. How would those elected under your platform defected and you kept mum since that time, without using them to reclaim your mandate back or boot them out for bye election.
