INSPECTOR GENERAL OF POLICE, DEPUTY INSPECTOR GENERAL OF POLICE JOSEPH O. EGBUNIKE AND INSPECTOR THOMAS AMONKE DARES ENUGU FEDERAL HIGH COURT, DISOBEYS COURT ORDER.

Tension mounts as D.I.G Joseph O. Egbunike and other top police officers defy court order following the alleged disobedience of the order of the Federal High Court, Enugu Judicial Division presided over by Hon. Justice I.N Buba, made on the 1st day of July,2021 directing the 1st -3rd Respondents, the Inspector General of Police, Deputy Inspector General of Police Joseph O. Egbunike and Inspector Thomas Amonke to stay all actions and release the Applicants forthwith, having been granted bail by the Court.

The applicants Akpa Francis, Obinna Mamah and Joshua Ogbonna through their team of lawyers, stormed the Court seeking to enforce their fundamental rights to life, liberty and dignity vide the notice of application filed on 30th June,2021 in Suit No. FHC/EN/CS/96/2021. In line with Order IV of the Fundamental Right Enforcement Procedure Rules, 2009, the Applicants also filed a motion Exparte praying for bail and interim order directing the Police to Stay all actions relating to and/or connected with the complaints of the Applicants.

Following the grant of the motion exparte, the bailiff of Court armed with the duly drawn order of the Court and other originating processes, proceeded to FCID Enugu Annex office of the 1st - 3rd Respondents being the address endorsed for service of the Processes on the said Respondents.

After placing calls on the D.I.G Joseph O. Egbunike, the Assistant Commissioner of Police in charge of the FCID Annex Enugu Mr. Kasumu refused to accept service of the Court order and accompanying processes. The bailiff of Court in adherence to the rules of service of Court processes, dropped the Court order and the processes in the office of the police officer. The irony that followed was the instant lock of the bailiff and the Applicants' lawyers in the police premises insisting that the bailiff and the lawyers can only be allowed to go if the bailiff takes back the Court order together with other processes. Being constrained and in danger, of unlawful incarceration, the helpless Court bailiff left with the processes and the Applicants lawyers who acted as pointer to the bailiff.

Notwithstanding the above, the bailiff proceeded to Abuja and on 2nd July,2021 with the effected personal service order of Court and the originating processes on the above named police officers who are the 1st -3rd Respondents in the suit pending in Court.

Despite the service of the Court order directing the Police to release the applicants having been granted bail, the D.I.G Joseph O. Egbunike in fragrant disobedience of the order of Court has refused to release the applicants on bail nor stay further action in the matter.

Upon reporting to the Court the refusal of the D.I.G Joseph O. Egbunike to release the applicants as directed by the Court, the Court on 7th July,2021 ordered the Officer incharge of Police Legal Department State CID Enugu to appear before the Court to explain why the Police will disobey the order of Court.

The applicants through their lawyers have initiated committal proceedings against D.I.G Joseph O. Egbunike, I.G.P and Thomas Amonke by filing in Court Form 48 which has been served on the officers.

Meanwhile, the violation of the Applicants rights followed the clandestine moves to shutdown Enugu Political Arena WhatsApp Platform by persons at the echelon of political governance in Enugu State using their surrogates. The crime committed by these innocent citizen (Applicants) were their refusal to yield to the above antics and plots to gag the people of Enugu from airing their views on politics, governance and dividends of democracy in Enugu State.

It will be recalled that sometime ago the news of Police invitation to the admin of Enugu Political Arena WhatsApp Platform Comrade Francis Akpa and other participants emerged. The people of Enugu were anxious to know the reason for the invitation and on whose behest the invitation was orchestrated.

Shortly after the news, one of the participants Joshua Ogbonna was arrested by Police officers from Anti Kidnapping Squad. He was granted bail after being detained for about two days.

The Admin of the platform in strict adherence to the rule of law and respect for constituted authority, honoured his invitation to the Police.

The Admin was confronted with a petition written by one Mr. Ifeanyi Ossai alleging character assassination among others. The principal suspects named in the Petition were Chief Damian Odo and Comrade Obinna Mamah.

After writing his statement, the Admin was released on bail the same day.

Comrade Obinna Mamah who is one of the participants in the platform also presented himself to Police Officers at Anti kidnapping Squad for interrogation based on Mr. Ifeanyi Ossai's allegations.

Comrade Obinna Mamah made statement, interviewed the Commissioner of Police who thereafter directed that he should be released on bail to a reliable surety. The directive was adhered to.

Two days after, Mr. Joshua Ogbonna, Francis Akpa (Admin), Obinna Mamah, Ifeanyi Ossai, Commander Anti kidnapping Squad and his men and the lawyers for the parties, stormed the Enugu CP's office for interview.

Shockingly, the same Mr. Ifeanyi Ossai who orchestrated the arrest of the afore mentioned persons, choose the forum of his choice for the investigation, suddenly wrote to the Inspector General of Police and secured the transfer of the same case to Force CID Abuja,"

The Applicants together with their lawyers were said to have been confronted with the petition to the IGP and the team of Police Officers from Abuja who were in the CP'S office to whisked the case file and the suspects to Abuja.

It took the uncompromised stance of the CP who insisted that due process be followed, for the Applicants to be saved from being whisked off to Abuja that night.

The Applicants presented themselves for investigation, appeared whenever invited throughout the period of investigation, yet Mr. Ifeanyi Ossai and his cohorts were not satisfied, apparently because the CP refused their invitation to incarcerate the above innocent citizens for no just cause.

At the instance of Mr. Ifeanyi Ossai, the petition was transferred to Abuja and assigned to D.I.G Joseph Egbunike who obviously was ready to carry out the wishes of the instigators.

On June 16, 2021, Comrade Obinna Mama, Comrade Francis Akpa and Joshua Ogbonna (Applicants) in obedience to the invitation of the DIG went to FCIID Abuja. In a bailable offense, and considering the fact that the Applicants were already on police bail at Enugu and that they obediently came to answer the D.I.G's invitation. The DIG arrested and sent them to detention despite providing a level 15 civil servant in the Federal Service who is with every documents required by the police and ready surety for the Applicants.

The Applicants have been in detention since 16th June 2021 till date. Millions of tax payers money were alleged to have been wasted in sponsoring the illegal detention of the Applicants, all aimed at stopping the people of Enugu from speaking out.

As a party man and 2019 House of Assembly Candidate, Awka South Constituency B, I placed so much interest just like other party leaders to see a return of Official Peoples Democratic Party (PDP) Nigeria to Agu-Awka come Nov. 6th.
Having been in apposition party(PDP) in Anambra State for almost two decades, I'm so passionate about this election and it took me so much time in declaring my position openly.
Presently, our noble party PDP under the able watch of Hon. Sir Ndubisi Nwobu - Obuka Awka as the State Chairman, has Sixteen (16) ably qualified, intimidating profile and enviable track record of achievements which I believed endeared the party more to Ndi Anambra.
My own personal assessment placed Senator Uche Ekwunife - IYOM above her peers(other Aspirants) and if the Delegates sees her as such, the Nov. 6th will be a Carnival for our party men and women.

Today in the history, IYOM has been consistent in her touch to the grassroot and her 8Years as a Rep Member and present achievements in the Senate speaks volume and would be considered a credit for our party PDP while marketing her Candidature to Ndi Anambra.

MY SOLEMN APPEAL

The attention of the AFN has been drawn to a social media backlash against the person of Alhaji Atiku Abubakar (GCON) on his purported silence over the allegations against the Minister of Communications and Digital Economy-Dr. Isa Ali Pantami, bordering on incitement of terrorism.

While the AFN wholly aligns with well-meaning Nigerians in their call for the resignation and possible prosecution of the Minister, the AFN wishes to state that the views of His Excellency, Alhaji Atiku Abubakar, on issues in our march through nationhood, including those relating to Dr. Isa Pantami's past, and purportedly renounced ideologies, are personal to him, and would be expressed when they become most expedient.


His Excellency has been a constant voice of direction and wise counsel on issues affecting our great Nation, and reserves the right to react on any of such issues upon a proper evaluation of its varying dynamics and implications for national security.

The AFN wishes to state further that the reaction, or otherwise of His Excellency to the trending national issue, does not in anyway, detract from his well known liberal ideologies, nor can it be elevated as an endorsement of the Presidency's somewhat complimentary position on the matter, as reflected in the statement of Garba Shehu, of 23rd April, 2021.


It is gratifying to note that Nigerians attach great value to the usually patriotic positions of his Excellency on our National issues, and Nigerians can rest assured that his Excellency will not shirk that responsibility.


What we have however collectively learnt from this sad episode of our nationhood is the steep price of insensitive and inequitable leadership manifesting in setting of different standards for different category of persons. No goverment which operates on the basis of such selective justice, can be able to unite a secular and pluralistic Nation like Nigeria. Little wonder the country is falling apart on all sides.


While 2023 may still be far off, the AFN urges Nigerians to remain steadfast in the hope that howsoever long the night might be, morning soon comes. Only then, can we take back our country, and set it again on the path of equity and progress, hopefully under an Alh. Atiku Abubakar, Presidency.

We need a better Nigeria, a country we all can be proud of, not a third force

Enugu and 2023: Much Ado, about Zoning.

So much ink, has been spared; and much energy dissipated in recent months over the dynamics of Zoning in the politics of Enugu State. The permutations seem to be gathering more momentum, as we gradually inch towards 2023.

I have extensively analysed the differing positions of the various Schools of Thought, and have juxtaposed the competing claims with the incontrovertible political history of our beloved State, at least since the dawn of the 4th Republic which started in 1999.


That meticulous inquiry readily shows that the bloated reference to zoning, has no place in the emergence of successive administrations in Enugu State from Chimaroke Nnamani in 1999 through 2007; to Sulivan Chime- from 2007 to 2015; and of course Rt. Hon. Ifeanyi Ugwuanyi in 2015 and 2019 respectively. To the contrary, historical fact shows that each of these men from across the three Senatorial Districts of Enugu, at all times battled, in line with the precepts of democracy, with other aspirants and candidates from other Senatorial Districts, both at the party primaries, and subsequently, at the general election.


If there happens to be a pattern suggesting a zonal arrangement in the change of guard at the Lion Building from 1999-2019, then, it is at best, the product of coincidence which should not be elevated to an official State or party-policy, with consequences for persons who may have interest in succeeding Gov. Ifeanyi Ugwuanyi come, 2023, should they come from political zones not considered 'qualified' to vie for the office, by the zoning apologists in Enugu State.


It was Charles De Gaulle, former French President, who rightly admonished that politics is too serious a matter to be left in the hands of politicians. As we inch towards 2023, the ultimate consideration in terms of power shift in Enugu, should be limited to issues around capacity, competence and relevant experience of interested aspirants; and not the petty and sometimes, defeatist argument of Zoning, which narrows the political options for Ndi Enugu.


A fact of our existence is that our people are grossly in need of governance. From healthcare to education; from security to employment opportunities; from food security to human capital development, Enugu, nay Nigeria, continues to lag behind. In my view, these are emergency concerns too germane to be sacrificed on the altar of zoning.

Assuming for a moment, one buys the argument of the Zonists, to the extent that each of the three Senatorial Districts in Enugu have all produced at least one Governor in the extant 4th Republic, it thus opens the door for aspirants from any of the Senatorial Zones to enlist in the 2023 contest. And so either way, Enugu cannot be made to suffer the defeatist position of having to choose its next Governor, from a single Senatorial District as peddled by the Zonists.


As I conclude this intervention, I wish to state that my attention has been drawn to comments credited to my brother Rt. Hon. Chima Obieze-the member representing Ezeagu in the Enugu State House of Assembly, where he told a political gathering that it was the "turn" of Enugu East Senatorial Zone to produce the next Governor, and concluded with a dose of arrogance and overestimation of himself, that this position was non-negotiable. In the said video, my brother Hon. Obieze, also told his audience that he was a product of zoning, and would work to ensure its entrenchment, irrespective of what some persons in the State thinks.


While Hon. Obieze is entitled to his opinion on the political future of Enugu State, it is however unfortunate that a legal practitioner of his standing, and expectedly a progressive democrat whose political ideologies ought to be punctuated by progressive ideals as well as best practices on politics and governance, is rather seen preaching the backward and antideluvian gospel of Zoning.

And if we may set the records straight, let it be known, that Hon. Obieze is not a "product of Zoning" as he claims, but rather a product of politics of croyinism and godfatherism which saw him occupy what is clearly a "stolen mandate", having not participated in any primary election sequel to becoming the candidate of the PDP for the Ezeagu Seat, in the Enugu State House of Assembly in the build up to the 2015 election. If therefore anyone should be heard making a case for the defeatist political option of zoning, on the basis of "justice and equity", it should not be Hon. Obieze who lacks the moral wherewithal, all things considered. The rule of thumb, is that he who comes to equity, must come with clean hands. And he who seeks equity, must do equity. Hon. Obieze fails on both scores.


The beauty of democracy is the opportunity it affords interested and competent persons to participate in the political contest, and having the electorates make the ultimate choice of who should govern them, per time. In that connection, excellence, capacity, character and worldview of the individual aspirant, takes priority, and not the part of the State they come from, which is what Zoning presupposes.

Enugu, should not be made the theatre of such undemocratic ideologies and tendencies.
