Isn't it illegal to file using the form 1040 as an F1 student visa holder?

International students who received the stimulus check must have filed their taxes using the form 1040 (this form is meant for resident aliens and citizens). If you haven't passed the substantial presence test as an international student, the correct form for filing your taxes is the form 1040-NR (this is meant for non-resident aliens).

My advice is not for people currently in the United states, it's for people still pondering the next step.

Im not criticizing anyone or their decisions neither am I predicting the future, I'm talking of the present
There is an anti-immigrant populist movement that is so strong that the odds are not as easy anymore (not that it was ever easy but it's just that rules are changing anyhow and suddenly and mostly politically motivated so for people who haven't even come in you have no idea what its gonna be like at any time, so I only advice consider Canada because they are the ones saying bring your educated and your skilled and the ones willing to have an education so the path is clearer than a country where the message is quite the opposite)

I'm not writing off coming to america, afterall na here we dey na and we never run, however just right now at this time it's tough to adjust status legally (which isn't a crime, but populists are blaming immigrants for every bad vices. Crimes, taking american jobs, name it )
So to me it's very infuriating when you have to compete harder than citizens to get anything, so you begin to question your decision making if it was right or not
Amidst the danger that you know who can change anything at any point in time.
The truth is we cannot know the answer (if the decision was right or not) to that until the end considering that even coming to America itself is not easy (for those using transcripts of here and Canada who takes months to process yet we are comparing weekly approvals even though one gives every day and another every other 3 to 4 months, but lest I digress) coming to america isn't easy, going to canada isn't easy

But based of purely on adjustment of status
The laws of both countries differ in their support for or against it.
Whichever path you choose if successful, promises great rewards in the end


Choose wisely....(for all we know things could turn around here and Canada decides to shut up shop). Make an informed decision is all I'm clamoring for, I share what I share out of love
It's better to know what you're getting into and prepare than jumping head straight and learning what it takes when you're two feet in...

You have missed the point if you think I am talking about getting a visa
What is your plan for wanting to move in the first place ?

Visa is just one part and the most unimportant for me if the purpose for beginning the journey is defeated or under threat what is the solution?
It's just an advice, prioritize what provides an easier path to achieve that which you desire
Especially if you're going to be paying huge fees without scholarships

Canada itself isn't easy now. Have you read the Canada thread lately? I have been following that thread since January last year and still following it now.
We see like one visa approval per month there (and most of them are people with travel histories) compared to several per week we used to witness early last year, and CIC would normally hold your application for months before rejecting you.
I wouldn't suggest Canada as a good alternative at the moment.

True, however it remains unclear what the new rules mean for nigerians who wish to adjust status

This reasons amongst others is why I suggested people try Canada as an alternative as well since it's more friendly at this time
The current american administration is all out for us and we face a lot of uncertainties currently as any politically motivated policy change (very likely since we are in election season) could have adverse effects (politicians will do anything to garner votes from their supporters)

But lest I say more and get insulted again and misconstrued I will say no more from this point.

1. Stop putting blame on Trump adminstration. US Visas has always been laced with uncertainty. Canada n Australia hv always had a much clearer path for stay after schooling. So telling people that Canada is better than US... that's old news. U just came in last year, why didn't u go to Canada instead of US?

2. You paid a lot of money to school there. You hv a huge burden to succeed. And it is natural that any news that relates to bad immigration creates a huge burden for u. But I think u are beginning to pass your personal burden on other members of the group. To your credit, u had expressly said that people who are forking out a chunk of money should look elsewhere. Media houses probably don't like d guy n they will paint up stories. If u see d free money in assistantship, grab it!

Personally I have no qualms with Canada, I even applied to 3 schools there...but I don't just think I can tolerate any more cold.

It's a bumpy ride ahead, but hang on, nothing lasts forever.

What if it's not lifted in no time? Would you advise your loved one at this point to take that risk with what you've seen and what you've known so far, and the possibility of a second term for DJT ?

Having said that, I believe the ban on IV will be lifted in no time, the time-consuming element would have been the e-passport requirement and we already have that. Even without this ban and the various strict measures this man is putting in place including the elimination of D/S hinted in the link above, getting an OPT or H1B employment was a tall order.

In any case, I think anyone coming should not be swayed as things change and you don't know what will happen going forward.

Well said, but I still advice especially if you're forking out a lot of money, go to canada instead since its immigrant friendly so you can have a seamless transition and green card in 3 years, after which you can enter USA at your will

Tuition in canada? There are no lot of scholarships and Assistantships in Canada like the USA. One can easily go and interview in Canada while in the USA. Get nominated for express Entry by a county or Company and then apply. It will be more easier. First, you have got the American experience which is obviously going to be an advantage wherever you want to go. Second, just as we all are saying, there are no lot of opportunities in the USA, the few ones might be meant for you.

Canadians value their degree than one from America degree from america ain't mean nothing to them, however work experience there would go a long way more.

Getting a US work visa while you are in Nigeria is not easy to come by. You have to be a professional at the top of your field. More so, the firm in the US will only get you such document to process the visa if they can't find any other professional/expert with equal skills or expertise within the US, which is almost impossible. And this is America! The chances of getting H1B visa from Nigeria, in my opinion and based on experience, is very low. If you are in the US, this is nice. Even then Pres. Trump is changing the narrative; no organization in the US should hire a foreigner (not currently in the US) except the position and job cannot be filled and done by an American. As for link, I don't have any. The person that I know is one of the best in his field, and he is the type you would call a field pioneer. He has remarkable knowledge and skills, which is what separated him. But you can check google on the process and all. If this is what you intend to use to travel, consider Canada, but note that you must be a professional with considerable amount of experience in your field.
This is my opinion.
