Then let him take a bow by honourably resigning from his position upon inauguration come Jan 27th. He didn't follow the proper procedure to facilitate his withdrawal therefore his nomination stands. Governor Yahaya Bello only need the support of just a simple majority of the members of Kogi State House of Assembly to perfect Faleke's replacement.

A deputy Governor in Nigeria is like a spare tyre. U will have basic little to contribute in terms of decision making that s why some States Governor normally give a Ministry to supervise.

As for the Ikeja Federal Constituency Seat at the House of Rep, Upon Faleke's inauguration a rerun will be conducted to fill the vacancy.

I beg top disagree with you. Faleke can claim the supplementary election that brought Bello in is null and void since he has written to INEC and APC to remove his name as a deputy governorship candidate for the supplementary election. INEC and the APC cannot force a candidate to run in an election, and since one cannot run in an election without a complete ticket it makes the election null and void.

Faleke can dispute INEC's claim based on the PVC's distributed and the difference between the votes of Audu/Faleke's and Wada's. Yes, the electoral act only recognises the registered voters but Faleke's legal team will challenge INEC to explain who is a 'Qualified Voter' on an election day. If INEC's argument only supports 'registered voters and not of the use of PVC's, INEC would have shot itself in the leg meaning that elections conducted using PVC's are meaningless and unconstitutional and as such INEC cannot force the electorates to produce a PVC before voting since what they recognize is the registered voters only.

Thirdly, can you claim Bello has fulfilled all the constitutional requirements? Did Bello take part in the more than 2,500 polling units where elections were concluded in November? Isn't that part of the constitutional requirement?

Lastly, when the returning officer for the elections was returning Bello as the winner, he did not say APC alone but said Alhaji Yahya Bello of the APC haven polled the highest number of votes and satisfied all constitutional requirements is thereby returned elected'? Did Yahya Bello in actual sense pull the highest number of votes?
The INEC guideline is very clear on this matter. Emphasis is on the number of the registered voters in the
area where election was cancelled and/or not held. Though Audu/Faleke satisfied the provision of section
179 (2) of the 1999 Constitution, the same constitution empowers INEC to regulate its own activities. The
returning officers decision was in order. There is no letter from the APC to INEC communicating her intention to substitute the deputy governorship candidate so Hon James Faleke nomination stands. Had it been Prince Abubakar Audu was "dully elected" before his
demise Sec 181 of the 1999 Constitution would have been invoked automatically making his running mate,
Hon James Faleke Governor - Elect. Its so unfortunate, that is not case here!

The Independent National Electoral Commission has declared the candidate of the All Progressives
Congress, Alh. Yahaya Bello as the winner of the Kogi governorship poll.
APC polled 247,752 votes to defeat PDP who came a strong second with 204,877 votes. In today’s
supplementary poll, APC polled 6885 votes to beat PDP which polled 5363 votes.
Declaring the results in
Lokoja, the Chief
Returning Officer for the
election, Prof. Emmanuel
Kucha, who is the Vice
Chancellor of the Federal
University of Agriculture,
Makurdi, said having
fulfilled all legal
requirements, Alh.
Yahaya Bello is declared
winner of the election
and Kogi Governor-Elect.
Kucha declared: “That
Yahaya Bello, having
polled the highest
number of votes and
satisfied the law is
hereby returned
elected”.
The collation of results was temporarily paused when an unidentified agent of the PDP asked about the
status of APC running mate. But the Resident Electoral Commissioner said Faleke remains the running
mate to Alh. Yahaya Bello. The supplementary poll took place in 18 of the 21 Local Government Areas
in the state.
Immediately the results were announced, the streets of Lokoja, Kotonkarfe and Okene erupted in
jubilation as people poured into the streets in hundreds to celebrate the victory.
At Isanlu, Bello Support
Organization said it is
victory for democracy.
Speaking exclusively to
Vanguard at Isanlu,
Chief Strategist of the
organization, Abdulrasaq
Ashiru said Yahaya Bello
is God-sent for Kogi
redemption.
In his words: “This is the
moment we have been
waiting for; the moment
of history. This is the
time we have worked
for; the hour of
renaissance.
Generations after us will
be told the history of this day.
“You can see the state-wide jubilation. That is the level of acceptance of the man, Yahaya Bello. He is
the symbol of a new direction for our dear state. It is high time we placed emphasis on the factors that
unite us. We are one people.
“To the people’s governor, the time for ethnic equality is now. We must be united by the actions of
government so that we can move forward as a state”.
Also, a former Chairman of Okene Local Government Area, Hon. Saliu Ohize told Vanguard that Yahaya
Bello’s victory os a product of the works of the late political leader of Ebiraland, Sen. A.T. Ahmed.
“Today, I am shedding tears of joy and regret. Joy in the sense that a great governor has emerged.
Regret in the sense that our leader, Sen. A.T. Ahmed is not here today to savour the fruits of his
labour”.
When our reporters contacted the governor-elect, Alh. Yahaya Bello, he said the victory belongs to all
Kogites, asking everybody to rally round him to translate the victory to a success. He is expected to
address the press soon.

The National Chairman of the All Progressives Congress (APC), Chief John Odigie-Oyegun on Tuesday evening said the party would conduct a primary election where a substitute to late Prince Abubakar Audu of Kogi state would emerge for the December supplementary election.
The APC candidate in last Saturday governorship election in the state died suddenly on Sunday, a day after the election which INEC declared as inconclusive.
The INEC on Tuesday said APC would be allowed to field a replacement for late Audu for the completion of the election.

The INEC rule that election is inconclusive, if the number of votes cancelled and, or where elections had not taken place, is more than the difference between the two leading parties/candidates is incurably faulty.
Registered voters for now, does not translate into persons with intent to vote in any election, registered voters with intent to vote, are those that have collected their PVC (permanent voters card).
Those with PVCs are persons assumed to be potential voters, while those registered, but without PVCs are out of the game. Out of the 49,000 registered voters, how many have collected their PVCs? Is the number of registered voters with PVCs amongst the 49,000 registered voters enough to render the election inconclusive? INEC has its job cut out here, they have to dig deep, or else the Courts should help them.
Was Kogi state gubernatorial election wrongly declared inconclusive?
The minimum requirement for participating in an election is the position of a valid voters card. The election has to be declared inconclusive because the votings strength of the affected polling units is capable of affecting the outcome of the election. The Returning officers action was in order.
