Osun State Governor, Adegboyega Oyetola, who contested the last governorship election on the platform of the All Progressives Congress (APC), has asked the Court of Appeal in Abuja to reverse the majority judgment given on March 22 by the Osun State election tribunal. The tribunal had, by a majority judgment given by two of its three members, voided the election of Oyetola, pronounced Ademola Adeleke of the People’s Democratic Party (PDP) winner. It then asked the Independent National Electoral Commission (INEC to issue him a certificate of return. In a 39-ground notice of appeal filed on March 26, 2019 by his team of lawyers, led by Wole Olanipekun (SAN), Oyetola faulted the majority judgment, given by Justices Peter Obiora and Anyinla Gbolagunte, on the grounds that it was perverse, replete with contradictions and not supported by evidence led by the petitioners. Oyetola wants the Court of Appeal to uphold his appeal, set aside the majority judgment and dismiss the October 16, 2018 petition by PDP and Adeleke. The governor said his complaint, in the appeal, was against the entire majority judgment, except where the tribunal held that it lacked jurisdiction to set aside INEC Guidelines; that the allegation of over voting was not proved; that the petitioners did not prove voided votes and other parts of the judgment where the tribunal agreed with their arguments. Oyetola is contending, in his first ground of appeal, that the entire of the majority judgment is a nullity because it was written and delivered by Justice Obiora “who did not participate in all the proceedings of the tribunal and who was not present when all the witnesses gave evidence.” He noted that Justice Obiora was absent on February 6 when the respondents witnesses (RWs) 12 and 13 – Ayoola Soji and Oladejo Kazeem – testified and tendered exhibits, which the tribunal admitted in evidence. The appellant argued that, having not attended the tribunal’s siting on February 6, 2019, Justice Obiora could not see the two witnesses and was unable to examine their demeanour, as required, and therefore, unlawful for the judge to have authored a judgment in which he reviewed the evidence given by the witnesses. He said: “The writing of and or the participation of the Honourable Justice P. C. Obiora in the writing of the judgment of the lower tribunal of 22nd March 2019 and delivery of same, vitiates the entire judgment.” Oyetola also argued the tribunal, in its majority judgment, erred in law and acted without jurisdiction when it accepted the petitioners’ complained of non-compliance with the provisions of Electoral Act in relation to the September 22, 2018 governorship election in Osun State and on that basis proceeded to nullify the victory of Oyetola and APC. It was equally the appellant’s contention the tribunal acted without jurisdiction by basing its decision to uphold the petition and set aside the return of the appellants on the basis of allegation of non-compliance with the Electoral Act, in relation to the September 22 governorship election. The appellant noted that, nowhere in the entire petition, did Adeleke and the PDP complained about non-compliance with the provisions of the Electoral Act in relation to the September 22, 2018 election. He added that the only ground, in the petition, alleging non-compliance with the provision of the Electoral Act was in relation to the rerun election held on September 27, 2018. Oyetola noted the tribunal contradicted itself in its conclusion, in page 191 of the majority judgment, to the effect that the information omitted by the election officers in the Forms EC8A in the 17 polling units, where the tribunal voided results, were essential to proving over-voting. He argued that, having earlier found that accreditation is not done on Form EC8A and that same (accreditation) cannot be proved without voters’ register, the tribunal was without jurisdiction to overrule itself. The appellant further argued that the tribunal erred in law when it cancelled elections in 17 polling units on the mere allegation of improper ballot accounting and accreditation details. He argued that since all the witnesses called by Adeleke and the PDP admitted that the voting process was regular; that votes scored by each party were publicly announced after counting and that the announced scores of parties were truly reflected on Forms EC8A tendered by petitioners, the tribunal was wrong to have proceeded to cancel results. Oyetola said: “All petitioners’ witnesses testified and admitted that petitioners were not short-changed regarding the scores recorded for them in each Form EC8A tendered, and that no addition of votes was reflected in favour of the appellants. “The lower tribunal had rightly found that there was no over-voting; there was no voiding of valid votes; that accreditation can only be done through voters’ register; that no single ballot paper was tended before it. “By cancelling of elections in 17 poling units the lower tribunal acted without jurisdiction. The Federal High Court in Abuja on Thursday ordered the arrest of the leader of the Indigenous People of Biafra, Nnamdi Kanu, and directed that his trial on charges of treasonable felony should proceed in his absence. The judge, Justice Binta Nyako, whose decision was anchored on the provisions of Section 352(4) of the Administrative of Criminal Justice Act, 2015, said Kanu had failed to appear in court since April 25, 2017 without any reasonable explanation. The lead prosecuting counsel, Mr. Magaji Labaran, applied for the court’s orders earlier in the Thursday’s proceedings. Kanu’s lawyer, Mr. Ifeanyi Ejiofor, had opposed Labaran’s oral application, and had asked to be given more time to explain why his client had not been in court by filing all necessary papers. He insisted that Kanu’s disappearance was as a result of soldiers’ invasion of the IPOB leader’s home in Afara-Ukwu near Umuahia, Abia State, during military’s ‘Operation Python Dance II’ staged to quell agitation for a Republic of Biafra. But the judge, noting that she had, in a judgment on a civil suit filed by Kanu, held that there was no nexus between the said military invasion and the IPOB leader’s disappearance, overruled the objection, insisting that the request for explanation of the defendant’s absence in court was belated. The judge, who also noted that Kanu had violated the conditions and terms of the bail granted him, recalled that after the defendant was granted bail on April 17, 2017, the following proceedings of July 11, 2017 could not hold due to the court’s vacation. She also recalled that on October 17, 2017 Kanu also failed to appear in court with his lawyer, who claimed that the defendant’s absence from court was caused by the invasion of his home in Abia State by soldiers. Embattled outgoing governor of Imo State Rochas Okorocha has continued to lament the refusal of the Independent National Electoral Commission (INEC) to issue him his certificate of return as Senator-Elect for the Imo West Senatorial district election. Okorocha while begging INEC to do the needful during a parley with newsmen at the government house in Owerri, on Tuesday, said he cannot fathom why INEC will chose to deny him his certificate of return due to a mere allegation. He said; “I cannot understand how a mere allegation of somebody, an individual, talking about duress, which has not been proven by anybody, will stop INEC from giving me my certificate of return for an election that I won properly. “I cannot understand why an individual’s report of a professor who lied, will now be taken more than the report by the Nigeria Police, State Security Service, that said there was no crisis, everything was peaceful. The House Of Representatives Committee on Police Affairs says it is worrisome that the Nigerian Police Force is not well-funded despite the security challenges the nation is faced with. House of Representatives Members of the committee who condemned the act said it was high time that the Police Trust Fund Bill currently before the Senate was passed and transmitted for presidential assent. They spoke on Tuesday when the acting Inspector-General of Police, Mr Mohammed Adamu, appeared before the committee for the 2019 Budget defence in Abuja. Newsmen report that in the 2018 fiscal year, N324, 220, 893, 212 billion was budgeted for the police. Newsmen report that on the capital budget for the year, N25, 197, 675, 020. 00 billion was appropriated for the security agency while only N5, 019, 767, 502.47 which was 19.92 per cent was released. However, N365, 239, 320, 000.45 billion was appropriated for the police in the 2019 Budget presented in Nov. 2018 by President Muhammadu Buhari. Speaking, Rep Johnson Agbonayinma said he was disappointed at the way the police was being handled in the area of the budget. “And we expect the police to protect lives and property, we expect them to do everything humanly possible to combat the various security challenges in the country, we expect them to perform a miracle. ”Miracle doesn’t just happen. There is nothing like a miracle if you don’t work for it,” Agbonayinma said. He said it was disheartening that in spite of the enormous work of the police, the security outfit battled with insufficient funding. He called on the Federal Government to do the needful to enhance its performance. Rep Ezenwa Onyewuchi, who said the police had the sympathy of the parliament because it worked under very excruciating conditions, commended the inspector-general and his officers and urged them to continue to be diligent in the face of the scarce resources. He said a Police Development Bill which he sponsored some years ago if passed, would have solved half of the problem of the police. ”Since security is everybody’s business, the private sector should also be encouraged to come into the security sector, “he said. On his part, Rep Oni Olamide noted that presently the police had three hundred and one thousand personnel and expressed displeasure that the force was being underfunded. Olamide, who sponsored the Police Trust Fund Bill as part of the efforts to tackle inadequate budgets for the police, lamented that though the House had passed the bill, it was still awaiting the Senate’s passage. He said if the bill scaled Senate’s screening, and eventually signed into law by President Buhari, it would go a long way in ameliorating the challenges of funding the police. Corroborating Olamide’s remark, the Chairman, House Committee on Police Affairs, Rep Abubakar Garba, said it was disheartening that the Senate had not concurred the bill. He promised that members of the committee would liaise with the Senate Committee on Police Affairs to accelerate the quick passage of the bill before the end of the 8th assembly. Responding, the inspector-general who gave the breakdown of his office budget, thanked the lawmakers for their support toward ensuring a better policing of the country. According to him, if the police are getting the needed support, most of the security challenges confronting Nigeria today would have been solved. The Nigerian Institution of Surveyors (NIS) has called for the re-certification and regularisation of buildings within the Lagos Island area of Lagos metropolis. Mr Adesina Adeleke, Chairman, Lagos Chapter of the Institution, made the call on Tuesday, at a news conference on “Incessant Building Collapse in Lagos State’’ organised by the NIS. According to Adeleke, almost all the structures within the area were built without the requisite approval plan or due regularisation with the government, and as a result, do not conform to the building specifications and standard of the location. He urged every owner/developer in the state whose property was not covered by a valid building approval plan to regularise the property and ascertain the structural stability of their buildings. Adeleke said that the regularisation and re-certification/validation of the buildings were necessary to ensure they conform to the purposes they are being used for and building plan of the locality. He said the suggestion, if taken, could be a proactive step in curbing the incessant building collapse in Lagos. The chairman commended the Lagos State Government on its current action in demolishing distressed buildings in Lagos Island. “To prevent recurrence of building collapse, the institution has declared support for the state government’s decision to remove all the defective structures hitherto marked and served the necessary statutory notices. “In as much as we support the government to remove the earmarked buildings for demolition, we strongly advocate a re-certification process for buildings in designated parts of the state, particularly Lagos Island. “We discovered there is usually no geo-survey information, and where such information is available, it does not usually conform with the development earmarked for the land. “As-built survey should form part of the requirements for the re-certification process. “This is with a view of not just probing the structural integrity of buildings, but also to determine if the information contained in the building approval is adhered to in the development,’’ Adeleke said. Contributing, Mr Akomolafe Ademola, Chairman, Association of Private Practicing Surveyors of Nigeria (APPSN), urged the state government to enact a policy that every new building in the state must be monitored from inception of foundation to completion of the construction. The Adamawa State chapter of the All Progressives Congress (APC) on Tuesday found reasons to reject the new date, March 28, fixed by the Independent National Electoral Commission (INEC) for the supplementary gubernatorial poll in the state. Ripples Nigeria had reported how INEC, in response to a court ruling, had said it would announce a new date for the supplementary election on Tuesday. INEC had, while reacting on its official Twitter page, said, ”Following the discharge of the injunction stopping the supplementary governorship election by the Adamawa State High Court in the case instituted by the Movement for Restoration and Defence of Democracy (MRDD) against INEC the Commission will now proceed with the supplementary election on a date to be made known before the end of work today.” However, the APC in a swift reaction same Tuesday rejected INEC’s decision claiming that the party was not consulted before a new date was fixed for the poll. The party’s position was made known by the Organising Secretary of the party, Ahmed Lawal. “INEC failed to consult with political parties involved in this election before going ahead to fix a new date for the re-run. “We, therefore, became suspicious due to rumours in town earlier that supplementary election would be conducted on Thursday and it turned out to be true. “We are not afraid of re-run election, but INEC should have done the right thing. “How can you fix an election on a working day?
