Malaysia High Court today sentenced a security guard toseven years in jail after he pleaded guilty to causing the death of a Nigerian in April last year. Judge Noor Azian Shaari sentenced T. Kumar, 29, after he pleaded guilty to a lesser charge under Section 304 (b) of the Penal Code which was proffered by the prosecution yesterday.

Kumar and his friend V. Ganesan, 29, assaulted Nwabudike Emmanuel Chukwuma at a house in Taman Puncak Jalil Seri Kembangan on April 23.

Noor Azian sentenced Ganesan to one year jail after he too pleaded guilty to the assault.

The duo, who were initially charged under Section 302, were ordered to serve the sentence fromthe date of their arrests on April 23.

During the proceedings, lawyer Datuk N. Sivananthan, who represented both the accused, appealed for a lesser sentence, especially for Kumar, submitting that they had no intention of killing Chukwuma and had only wanted to confront him over an alleged loss of money.

He said the Nigerian had been charged in the Melaka Sessions Court for cheating and overstaying in Malaysia.

The early morning meeting had instead turned into a fight which led to the Nigerian's death, he added.

Deputy public prosecutor Muhamad Asyraf Md Kamal however asked the court to mete a deterrent sentence as the offences were serious, especially Kumar's.

He stressed that even if Chukwuma had been convicted of cheating there was no excuse to assault him to death.
